Skip Blake of Blake Architects at 1202 S White Chapel Blvd., Southlake came forward.
Mr. Blake addressed the variance items. The driveway stacking is an existing stacking
situation with an existing drive that was previously built and we are tying onto that
existing drive therefore we are governed by the existing stacking. We plan on extending
the drive through the front parking that runs east and west if the property to the east
commercially develops then the drive can extend as well. The landscape and curb will
be put in to protect the Hayes property to the east as well. The variance on the
bufferyard to the west is due to the existing drive that splits the property and the
variance on the bufferyard to the south is due to the land remaining vacant. Regarding
the fence variance; the fence would be difficult due to the amount of trees along the
property line. A natural fence would be more appropriate.
Chairman Hudson if there were any future plans on the southern portion.
Mr. Blake stated that it depends on how Zena Rucker Road develops.
Commissioner Smith asked about the existing fence that is there.
Mr. Blake stated that it a mixture of barbed wire and metal cattle fencing with some
open spaces.
Commissioner Springer asked if the area would be trimmed up and landscape planted
along the property line.
Mr. Blake stated yes.
Chairman Hudson opened the public hearing.
Carolyn Hayes at 807 E Southlake Blvd., Southlake came forward. Mrs. Hayes stated
that she will not agree with the 8 -ft. fence variance. The fence that is there was there
when we moved there and there was no trees. We would like a solid fence to separate
the property in order to protect their livestock. Mrs. Hayes also expressed concern
regarding the shrubbery where the fence ends across the stubbed in driveway. Mrs.
Hayes wants to make sure they have privacy and protection of their property.
Commissioner Smith asked Mrs. Hayes to point out her property and to describe what
livestock they have.
Mrs. Hayes pointed out her property and stated that they have cows, longhorns, horses,
lamas and buffalo. Mrs. Hayes stated that they are currently on another piece of
property until they are able to move them back.

Commissioner Parrish asked what kept the livestock on the property before.
Mrs. Hayes stated barbed wire and cattle panel fence.
Commissioner Forman asked if Mrs. Hayes wanted to have the entire property line

Mrs. Hayes stated just along the property line just to the south of the large barn.
Chairman Hudson closed the public hearing.
Mr. Blake came forward. Mr. Blake expressed that he was looking for more compromise
regarding the fence especially since the property is currently up for sale and the fence
may be temporary due to near future development.
Commissioner Smith asked Mrs. Hayes on whose property the trees were on.
Chairman Hudson reopened the public hearing.
Mrs. Hayes stated that the trees were directly on the property line, in fact the fence and
the trees were intertwined. Mrs. Hayes also stated that she was not concerned with the
trees.
Commissioner Smith verified with Mrs. Hayes the placement of the fence request.
Mrs. Hayes also expressed that her property is not for sale.
Chairman Hudson asked if Mrs. Hayes would be alright with a portion of the fence on
her property in order to preserve some of the trees.
Mrs. Hayes stated no, preservation of those trees is not her concern.
Zena Rucker at 650 S Carroll Avenue, Southlake came forward. Mrs. Rucker stated that
it was her understanding based on what Mr. and Mrs. Hayes have told her that they
plan to sell their property and move onto the farm they have already purchased. In
regards to livestock, Mrs. Rucker has only seen a few horses and no other animals.
Mrs. Rucker would like to save as many trees as possible.
Chairman Hudson closed the public hearing.
Commissioner Springer asked staff about the difference between the screening and the
fencing.
Dennis Killough stated that the way our ordinance is written, it requires a solid fence in
this situation and specifies which materials are permissible.
Commissioner Smith asked staff how far forward does the ordinance require that the
fencing come.

Dennis Killough stated that it is required where the boundary of this zoning request is
common with the occupied residential dwelling on the property. It would be required
from the right -of -way line, Southlake Blvd., to the southeast corner of this zoning

Commissioner Smith asked staff to clarify the zoning of the property.
Dennis Killough stated that the current zoning is Agricultural and is an occupied
dwelling. The land use designation, which is our policy document which aids the
Commission in making zoning decisions, shows to be office /commercial going forward.
Commissioner Smith stated that she is inclined to deny the variance regarding the
fence.
Commissioner Parrish asked about the compromise to take the fence down to the
western property.
Chairman Hudson stated that the applicant is not required to take it that far.

Commissioner Smith verified the location and that Anderson and Thomasville are two
separate entities.

Agenda Item No. 16 - Variance to Lighting Ordinance No. 693, as amended, for the
Carroll ISD Senior High School Baseball /Softball Fields located at 1501 W. Southlake
Boulevard, Southlake, Tarrant County, Texas.
City Attorney, Bryn Meredith explained the voting requirements for this item. There are

only 2 incidents where a recommendation from the Planning and Zoning Commission to
deny would trigger a super majority vote at City Council. The first is a matter involving a
change to zoning regulations and the second matter involved an application where there
is a proposed change to zoning boundaries. The Lighting Regulations are not found in
the zoning ordinance and not zoning in nature. Therefore, the Planning and Zoning
Commission's action on this matter will have no bearing on the simple majority voting
requirements at the City Council level. The Planning and Zoning Commission is acting
on an advisory capacity. The ordinance requires that the Commission exercise
jurisdiction and make a recommendation. That recommendation is not binding on the
City Council and the outcome of that recommendation has no bearing on the voting
requirements at the City Council level.
Commissioner Forman recused himself and left the Council Chambers at 8:42 p.m.
Planner II, Richard Schell presented this item.
Derek Citty of CISD at 2400 N Carroll Avenue and Chris Johnson of Musco Lighting at
2570 W Eldorado Parkway, Suite 135, McKinney came forward.
Mr. Citty gave a brief presentation and power point that covered a history leading up to
tonight's events along with an explanation for the variances requested. Mr. Citty also
attempted to address issues that were directed to him via e-mail and phone calls; 1)
Property value will not be affected by this variance. In the past other improvements
have been made along with upgrades and additions. None of these have affected
property value in the past and Mr. Citty believes that this time is not an exception. 2)
There has never been any type of an agreement regarding the lighting of this ball park.
We have searched our own regards, City records and surrounding HOA records. No
agreement has been found. 3) The concern for the lights spilling over into the
neighboring neighborhoods is a concern for CISD as well. That is why we have
contracted with Musco Lighting. This is the same company the City has used for North
Park and other facilities. Musco Lighting is able to minimize the spill over. 4) The
program being used is the 2006 Bonding Program not the 2009 Bonding Program.
Mr. Citty then read aloud the minutes from the School Board Meeting regarding the use
of the field and the lights. 1) Approve the installation of lights. 2) Limit the use of the
lights to UIL activity by CISD boys and girls athletics. 3) Capping the use to a number of
nights. 4) Pursue a waiver with UIL for a 7 p.m. latest start time for games. 4) Additional
landscaping screening for the neighborhood.
Chairman Hudson asked Mr.Citty if he could give the Commission an idea of how many
nights the lights will be used.
Mr. Citty stated 16 games for both boys and girls combined. That number can and will
change year to year.
Mr. Citty continued to state that to mitigate the noise, speakers will be turned around
towards the bleachers. The outfield lights will be shut down after the game. The infield
lights need to remain on for an additional 15 -30 minutes to prepare the field for the next
use. Games generally last an hour and a half for a 7 inning game. CISD has agreed to
craft a binding agreement with the City regarding the lights and all items addressed here

tonight. The 2 portion of this request is to pursue the construction of a water well for
landscape use. CISD is the largest user of water for the City of Southlake. This will
allow us to maintain our grounds successfully. The 2006 Bond Program will fund the
lighting and the remaining balance of the 2009 Bond Program will fund the water well.
Chris Johnson briefly explained and showed a power point of the technology behind the
lighting with a history of installations in sporting arenas and stadiums.

came forward. Mr. Lehane feels that CISD has addressed all their issues regarding
turning the lights off and is in support of the variance. Alexa Wimberly - 702 Wentwood
Drive. Ms. Wimberly is currently a student and athlete for CISD and spoke in support of
the variance. Stanley Walter - 1907 Water Lily Drive. Mr. Walter stated that this is a
long term solution for today's athletes as well as future athletes. This is about safety for
the kids and remaining on campus versus the kids driving themselves to an offsite place
and /or the cost to bus them. By staying on campus safety and security is addressed.
Jamie Wimberly - 702 Wentwood Drive. Mrs. Wimberly stated that this is part of
progress for our school district and allowing them to move forward and compete with
other 5A Districts. This will also allow students to stay in class for the time required. Ms.
Muller - 1706 Teasley, Denton. Ms. Muller is a former student and athlete of CISD. Ms.
Muller spoke in support of the lighting variance.
The following came forward to speak in opposition; Jane Lash - 1007 Normandy

Drive. Mrs. Lash represents the Stone Lakes HOA in opposition of the variance and
believes that CISD has broken many promises and agreements that have been made.
Mrs. Lash also presented a power point with a brief history. Matt Williams - 810
Stratford Drive. Mr. Williams played a short video clip of Mr. Citty at a previous City
Council Meeting (April 2, 2010). James Keoughan - 501 Stratford Drive. Mr. Keoughan
is president of the HOA for Stone Lakes Subdivision and is requesting that Planning and
Zoning table this item due to the majority of the homeowners still out of town for the
holidays. Mr. Keoughan went over a communication timeline from CISD regarding this
variance request. Lisa Vassios - 1410 Park Place. Mrs. Vassios is in opposition to the
variance due to the bright lights that will be glaring into her backyard. Mrs. Vassios read
over the existing Ordinance 693 regarding the reasoning for the ordinance. Sean
Roberts - 1405 Richmond Court. Mr. Roberts presented a lighting chart that shows that
CISD plans on exceeding the margin that is originally presented. Ray Semadeni -1402
Park Place. Mr. Semadeni expressed his concern of the light poles falling down and
creating damage of surrounding property. Mr. Semadeni read aloud a newspaper article
regarding light poles falling down and damaging surrounding property in various school
districts. Mr. Semadeni continued to state that foot traffic will increase along with
mosquitoes having a breeding ground. Jinx Howell - 1408 Park Place. Mrs. Howell
addressed many broken promises that CISD has made and would like someone to hold
the district accountable for their promises. Teresa Gorman - 1406 Mayfair Place. Mrs.
Gorman addressed tree mitigation and landscaping by CISD and their lack of
maintenance. Mrs. Gorman went through a timeline and list of species that CISD has
failed to implement and wondered if a water well would truly improve this. Todd Prince -
1404 Richmond Court. Mr. Prince addressed other issues that CISD has failed to meet.
This included securing funds for upkeep and maintenance of existing property and
landscaping. Mr. Prince concluded that there have been many evenings that the lights
have been on past the approved time. Ken Schmiedel - 1410 Dartmouth Drive. Mr.
Schmiedel addressed the safety and security that has been brought up. Games and
practices have been conducted safely and securely for 22 years. There is no hardship
that would allow this variance. Dianne Dorman - 100 Ascot Drive. Mrs. Dorman stated
her concern with traffic volume. On several occasions students are dodging cars and
my driveway is blocked.
Bob Morgan - 420 W Chapel Downs came forward to speak in support of the variance.
Mr. Morgan addressed many issues regarding the opposition and asked for the
Commission to support CISD students and athletes.
Chairman Hudson asked Mr. Citty to come forward and asked if there were batting
cages located at the facility.
Mr. Citty stated that there are batting cages located there. However, they are not to be
used after the coaches' leave. If the coaches are not present, it becomes a liability for
the district.
Chairman Hudson stated that we need a facility for these kids to practice and play, but
Chairman Hudson doesn't believe this facility is the correct one. Bicentennial Park
seems to be the best solution.
Mr. Citty stated that the School Board proposed 6 ideas. One of those ideas is to do

nothing. The other 5 involve additional sites which require site to site transport,
appropriate renovations to accommodate use, timeline availability and unknown cost.
Commissioner Smith asked Mr. Citty about why CISD chose not to have a SPIN
meeting and if CISD had gone that route, would there been a difference in the
presentation and requests.
Mr. Citty stated that CISD chose not to have SPIN due to the many meetings already
set up and attended with adjacent neighborhoods and HOAs. Mr.Citty also believes that
having a SPIN meeting would not have changed the presentation and /or requests.
Commissioner Smith also asked if the tennis courts were lighted.
Mr. Cittty answered yes.
Commissioner Smith verified the amount of times that the lights would be in use. The
amount given is in conflict with what a supporter had stated regarding the kids having to
go off campus and practice every night.
Mr. Citty also addressed the video that was shown earlier regarding himself before City
Council and the statements that he made.
Commissioner Springer added that despite public opinion, the main issue is the
exceeded amount of spill over lighting that is called for. A landscaping architect will not
be able to address that and turning the speaker around will not be helpful either.
Mr. Citty disagrees. Based on the photometric worksheet, the outfield will have less
illumination than the infield which is the same as Northpark.
Commissioner Parrish believes that with all the options that went before the School
Board this option is the best one.
Chairman Hudson believes that there needs to be a better option. The CISD athletes
and students deserve a place to be proud of.
Commissioner Smith agrees with Chairman Hudson.
Executive Session: Chairman Hudson announced that Planning and Zoning Commission
would be going into Executive Session pursuant to Texas Government Code, Section
551.071, consultation with the city attorney, 551.074 deliberation regarding personnel, and
Section 551.072, deliberation regarding real property. Planning and Zoning Commission
adjourned for Executive Session at 10:33 p.m. Executive Session began at 10:36 p.m. and
concluded at 10:45 p.m.
Reconvene: Chairman Hudson reconvened the meeting at 10:48 p.m. and same
members and staff are present. Chairman Hudson stated that no action was necessary
from Executive Session.

Dr. Citty stated that the senior high school facility is designed and built for both baseball
and softball. The girls' softball side is not a practice field. It was designed and used for
varsity softball games. It is considered a top notch field but cannot be used due to the
lighting issue.

Agenda Item No. 15 — Ordinance No. 1056, Mobility and Master Thoroughfare
Plan Amendment for the alignment of S. Village Center Drive extending from E.
Southlake Boulevard (FM 1709) to S Nolen Drive.
PUBLIC HEARING
Planner I, Caroline Eckel presented this item.
Derek Citty of CISD at 2400 N Carroll Avenue came forward. Mr. Citty stated that the
district supports this plan and endorses the 2N plan.
Chairman Hudson opened the public hearing.
Howard Carr of 6800 Westcreek Circle, Fort Worth came forward. Mr. Carr is not in
support of this project going through his property. Mr. Carr believes that the City has
had ample time to plan for the growth of homes and commercial. This was supposed to
be my retirement home and investment property. Many developers have approached
me to purchase portions of my property. However, once they spoke to city staff and
learned of the future road through my property, they walked away. That leaves my
family with property that cannot be used or sold.
Dennis Killough stated that the reason for bringing this forth, is the realignment at the
intersection of Kimball Avenue as well as some of the other issues that have been
raised further back west where the existing portion of South Village Center Drive exist
and through the Gateway Church property. Part of this realignment does currently affect
where this thoroughfare is represented on Mr. Carr's property and then likewise further
extends to the South Nolen Drive. That portion once you get along the eastern portion
of Mr. Carr's property along his south boundary. That is still in the location as presently
represented on our thoroughfare plan. The City is not proposing any change with that.
Commissioner Smith clarified that there is nothing that the Commission can vote on

today that would stop a portion of this road going through Mr. Carr's property.
Dennis Killough stated that it is in the Commission's ability to recommend anything
different that you would like to see which will move forward to City Council at this point.
Staffs current recommendation being presented to the Commission is represented by
the yellow line on the plans. If the Commission goes by Staffs recommendation then
that will be what is sent forward to City Council.
Chairman Hudson stated that the yellow alignment is much better from a thoroughfare
plan especially adjacent from the school and how it intersects with Kimball Avenue.
Chairman Hudson closed the public hearing.
Commissioner Springer stated that the yellow line is a better alignment. In the future this
could improve his property.
Motion to approve Ordinance No. 1056 Mobility and Master Thoroughfare Plan
Amendment subject to Staff Report dated December 27, 2012 and Staffs
recommendation of 1S /2N alternative alignment as it provides a continuous path,
minimizing negative impacts on future development potential in the area and
providing for a safe distance from adjacent school facilities.
