meeting reconvened).

CITY STAFF PRESENT: Curtis Hawk, City Manager; Shana Yelverton, Assistant City
Manager; Tracy Southers, Public Information Officer; E. Allen Taylor, Jr., Betsy Elam, City
Attorney; and, Sandra L. LeGrand, City Secretary.
INVOCATION: Mayor Pro Tem W. Ralph Evans.
The Special City Council meeting was called to order at 5:15 p.m. by Mayor Rick Stacy.
Agenda Item #2 -A, Executive Session
Mayor Rick Stacy advised the audience that Council would be going into executive session
pursuant to Chapter 551 of the Texas Government Code, Section 551.071, 551.072 of the Open
Meetings Act, to seek the advice of the City Attorney with respect to pending or contemplated
litigations, and to discuss the purchase, exchange, lease or sale of real property.
Council adjourned into executive session at 5:15 p.m.
Council returned to open session at 5:45 p.m.
Agenda Item #2 -B, Action Necessary /Executive Session
No action was necessary as the result of the executive session.
Council adjourned for recess at 5:45 p.m.
Council reconvened into open session at 10:20 p.m.
Mayor Rick Stacy called the meeting back to order at 10:20 p.m.

Agenda Item #3 -A, #3 -B, #3 -C, #3 -D, #3 -E, #3 -F Approval of Joint Resolution and
Agreement with Town to Westlake to change municipal boundaries and apportion
extraterritorial jurisdiction.
No action was taken on agenda items #3 -A through #3 -F as noted above.
Agenda Item #3 -G, Consider entering into one or more agreements with Town of Westlake
Curtis Hawk, City Manager, explained to Council and the audience that earlier on this day the
Town of Westlake took action to release an area of the Town of Westlake where Solana is
situated. Betsy Elam, City Attorney, was present to answer questions of Council. Hawk noted
the maps in the packets as exhibit "A" shows the area in question that is before consideration
tonight.
Motion was made to approve Resolution No. 97 -30, a Joint Resolution and Agreement, which is
the release and acceptance of extraterritorial jurisdiction. A copy of the resolution is hereby
attached to the minutes of this meeting.

Mayor Rick Stacy read the resolution into the record, which has
been signed by the Town of Westlake prior to Southlake's
acceptance.
Agenda Item, #3 -H, Any action necessary pertaining to overlapping ETJ between the City
of Southlake and Town of Westlake and any change of boundaries as appropriate.
Curtis Hawk, City Manager, presented Resolution No. 97 -36, a resolution of the City of
Southlake, Texas initiating annexation proceedings and directing the City Secretary to schedule
public hearings and provide for notice in accordance with law and direct staff that a service plan
for the property be prepared. A copy of the resolution is hereby attached as exhibit
"B" to the minutes of the meeting.
Motion was made to approve Resolution No. 97 -36, proceeding with annexation of the Solana
property.

RELEASE AND ACCEPTANCE OF EXTRATERRITORIAL JURISDICTION

AND DENTON §
WHEREAS, the City of Southlake, Texas, is a home rule city tying and being situated in
Denton and Tarrant Counties, State of Texas; and
WHEREAS, the Town of Westlake, Texas, is a Type -A general law city lying and being
situated in Denton and Tarrant Counties, State of Texas; and
WHEREAS, the Town of Westlake has unconditionally and irrevocably disannexed the land
and released its extraterritorial jurisdiction as more particularly described on Exhibit "A "and Exhibit
"B" attached hereto and made a part hereof (the "Disannexed Land "); and
WHEREAS, the City of Southlake and the To of Westlake desire to adjust their
extraterritorial jurisdiction boundary lines to unconditionally and irrevocably release the Disannexed
Land and to include certain other extraterritorial jurisdiction described in Exhibit "C" attached hereto
(the "ETJ Land ") from the extraterritorial jurisdiction of the Town of Westlake and to include the
Disannexed Land and the ETJ Land within the extraterritorial jurisdiction of the City of Southlake;
and
WHEREAS, the City of Southlake and the Town of Westlake have the authority to pass and
approve this Joint Resolution and Agreement pursuant to Section 42.023 of the Texas Local
Government Code; and
WHEREAS, notice of the proposed adoption of this Joint Resolution and Agreement has
been duly posted in accordance with the Texas Open Meetings Act, Chapter 551 of the Texas
Government Code.
NOW, THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE
CITY COUNCIL OF THE CITY OF SOUTHLAKE AND THE BOARD OF ALDERMEN
OF THE TOWN OF WESTLAKE:
SECTION'.
That the City of Southlake and the To Nn of Westlake do hereby covenant and agree to
protect, preserve, and defend the hereinafter described realignment of their respective extraterritorial
jurisdictions.

SECTION 2.
That the Town of Westlake does here)/ unconditionally and irrevocably relinquish and
release to the City of Southlake any and all of tae extraterritorial jurisdictional rights the To of
Westlake has or may have in and to the Disannexed Land and the ETJ Land.
SECTION 3.
That the City of Southlake does hereby include and accept the Disannexed Land and the ETJ
Land into the extraterritorial jurisdiction of the City of Southlake and does hereby agree to assume
the rights and obligations appurtenant to the Disannexed Land and the ETJ Land.
SECTION 4.
That this Joint Resolution and Agreement shall become unconditionally and irrevocably
effective and binding upon the Town of Westlake upon the effective date hereinafter set forth, and
that this Joint Resolution and Agreement may not be altered or amended by the Town of Westlake
without the prior written consent of the City of Southlake and each and all of the owners of the
Disannexed Land.
SECTION 5.
This Joint Resolution and Agreement shall have no effect on the Trophy Club Municipal
Utility District No. 1.
SECTION 6.
That this Joint Resolution and Agreement shall become effective and binding upon the City
of Southlake when approved by the City Council of the City of Southlake and shall become effective
and binding upon the Town of Westlake when approved by the Board of Aldermen of the Town of
Westlake.
This JOINT RESOLUTION AND AGREEMENT is unconditionally and irrevocably PASSED
AND APPROVED by the Board of Aldermen o the Town of Westlake, Texas, this 8th day of May,
1997, and is effective at 9 . j ff V .M. on such date.

�Reing all that property, commonly known as Solana and more particularly described as Parcels

Being all that 251.757 acrc tract of land situated in the J.B. Martin Survey, Abstract No. 1134,
the T.W. Mann Survey, Abstract No. 1107, the U.P. Martin Survey, Abstract 1015, the W.
Medlin Survey, Abstract No. 1958, and the C.M. Throop Survey, Abstract No. 1510, Tarrant

Tarrant County, Texas, a 1/2 inch iron rod in the northeasterly right -of -way of State Highway
Nu. 114 (a 220 foot wide right -of -way);
THENCE, along the said northeasterly right -of -way or State Highway No. 114 N 36° 32' 00" W,
continuing along a projection of said R.O.W. to a point for a corner in the centerline of County
Road #3088 (Sam School Road), said point being in the common boundary line between
Westlake and Southlake and described in the City of Westlake Ordinance #81;
THENCE South with the projected center line of County Road #3088 (Sam School Road)
(Peytonville Road) to a point for a corner in the southwest R.O.W. line of S.H. 114;

Westlake /Southlake Park, Additicm No. 1 to the Town of Westlake as recorded in Volume 388-
214, Pages 78 and 79, County Records, Tarrant County, Texas;
THENCE N 88° 29' 50" W along the south line of said T.B.M. tract 907.75 feet to a point for
a comer, said corner being the N.E. corner of a tract by deed to I.B.M V. 7824 P. 2033 DRICT;
THENCE S 00° 17' 58" W along the cast line of said 1.13.M. tract a distance of 197.59 feet to
an iron pin in its S.E. corner;
THENCE S 86° 22' 05" W a distance of 518.25 feet to the S.W. corner of said I.B.M. tract;
THENCE N 19° 09' 01" W along the cast R.O.W. of Sam School Road a distance of 393.02 feet
to an iron pin being the S.W. comer of a tract by deed to I.B.M. V. 7376 P. 1779 DRICT and
being in the east K.U.W. of Sarn School Road (County Road ;13088);
THENCF, S RR° 45' 45" W approximately 51 feet crossing Sam School Road (County Road No.
3088) to a point in the westerly right -of -way of Sam School Road;
THENCE S 19° 09' 01" F, approximately 500 feet along the westerly right - of-way of Sam
School Road to a galvanized iron pipe by a corner of a fence in the west line of Sam School
Road;

THENCE in a southeasterly direction crossing County Road #3088 (Sam School Road) to a point
for a corner, said point being the southwest corner of Lot 7 and thc northwest corner of Lot 6
of the RP. Estes Sulxiivision as recorded in Vol. 1957, P. 324, DRTCT;
THENCE easterly along the common south line of Lot 7 and north line of Lot 6 by deed a
distance of 1349 feet to a point for a corner in thc east line of the T. Mann Survey, said line also
being the city limits of the City of Southlake;
