2012-04-26 1 CI O S OUTH LAKE TEXAS 1 REGULAR ZONING BOARD OF ADJUSTMENT MEETING: April 26, 2012 2 3 Location: Southlake Council Chambers 4 1400 Main Street, Southlake, Texas 5 6 Members Present:; Chair Kate Smith, Vice -Chair Shawn McCaskill, Board Members Chad 7 Patton, Phyllis Lambert, Dustin Andrews and Alternates Daniel Kubiak, Paul Venesky. 8 9 Members Absent: Board Member Lisa Amend 10 11 Staff Present: Dennis Killough, Deputy Director of Planning & Development Services and 12 Stacey Buller, Board Secretary. 13 14 REGULAR SESSION: 15 16 Agenda Item No. 1 — Call to Order: Chair Smith called the April 26, 2012 Zoning Board of 17 Adjustment meeting to order at 6:30 p.m. 18 19 Agenda Item No. 2 — Approval of the Minutes: Chair Smith opened the discussion of the 20 minutes of the Zoning Board of Adjustment meeting held on January 12, 2012. 21 22 A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on 23 January 12, 2012, as presented. 24 25 Motion: Lambert 26 Second: Patton 27 Ayes: Smith, McCaskill, Lambert, Andrews, Kubiak, Venesky 28 Nays: None 29 Abstain: Patton 30 Vote: 6-0-1 31 32 Motion: Carried 33 34 Agenda Item No. 3 — Administrative Comments: Dennis Killough, Deputy Director of 35 Planning & Development Services reminded Board Members Venesky and Patton of the 36 expiration of their term on the board and invited them to reinstate. Killough stated that there has 37 been no submittal for the next scheduled meeting on May 24, 2012. 38 39 Agenda Item No. 4 — ZBA -623, Variance to rear yard setback: Variance to Ordinance No. 40 480, Section 14.5(d), requiring a rear yard setback of thirty -five (35) feet for lots fronting on a 41 cul -de -sac for property located at 902 Shadywood St., Southlake, Texas, and described as Lot 42 4, Block 4, Chimney Hill, Phase 11, an addition to the City of Southlake, Tarrant County, Texas. 43 The current zoning is SF -20A — Single Family Residential District. 44 45 Dennis Killough, Deputy Director of Planning & Development, reported fifty -five (55) notices 46 were mailed out within two hundred (200) feet with two (2) responses having been received, 47 Robert and Elizabeth Huss, 1413 Northridge Dr., Southlake, Texas, In Favor Of; Ernest and 48 Linda Kish, 907 Chimney Hill Trail, Southlake, Texas, Opposed To. Zoning Board of Adjustment Meeting - April 26, 2012 Page 1 of 2 49 50 Trevor Matheson, 902 Shadywood St., Southlake, Texas, once sworn in, requested that a 51 variance be allowed to the rear setback. Mr. Matheson requested the variance to build an 52 addition to the principal structure to be used as a pool house seventeen (17) feet from the 53 property line. He stated that the shape of the lot is irregular and that the addition would not 54 match the surrounding structures and would have a non - functional floor plan if built to the 55 standards required. He also noted that other neighbors have buildings that encroach on the 56 building line. Mr. Matheson stated that the addition meets all other building requirements. The 57 Board questioned the square footage and approval of the HOA of the neighborhood.
