THE STATE OF TEXAS § COUNTY OF TARRANT § Reference is made to Section 5.028 of the Texas Property Code permitting a person with personal knowledge of facts relevant to the correction of a recorded original instrument to prepare and file a correction instrument to correct a non - material change that results from a clerical error. Reference is made to that certain Plat Revision (the "Plat ") for Chelsea Park, City of Southlake, Tarrant County, Texas, recorded March 2, 2012, instrument number D212052819, Plat Records, Tarrant County, Texas. The owner who signed the Plat is SilverOak Land Development Co., LLC. The engineer listed on the Plat is Hamilton Duffy, P.C. This correction instrument is made by representatives of Hamilton Duffy, P.C., who have personal knowledge of the facts contained herein. Along the street frontage boundaries of Lots within the subdivision there are easements labeled 5' Street Maintenance and Utility Easement. The zoning and plans for the subdivision that were presented to and approved by the City of Southlake contemplated that such easements would also be used for pedestrian access (i.e. sidewalks). All Lots within the subdivision that have been improved with homes have been constructed with sidewalks for pedestrian access with the 5' Street Maintenance and Utility Easement. The labeling of the easements as 5' Street Maintenance and Utility Easements was an inadvertent clerical error. The easements should have been labeled 5' Street Maintenance, Utility Easement, and Pedestrian Access Easement. Accordingly, the Plat is hereby corrected to reflect as follows: the easements labeled as 5' Street Maintenance and Utility Easement are corrected to read 5' Street Maintenance, Utility, and Pedestrian Access Easement. Page 1 of 2 In accordance with Section 5.028(d)(2) of the Texas Property Code, a copy of this correction instrument will be sent to all parties, successors and assigns affected by this correction instrument.
