WORK SESSION: The work session was called to order by Mayor Wambsganss at 5:35
p.m.
Mayor Wambsganss introduced the following Texas Department of Transportation
(TxDOT) representatives: Steve Simmons, Deputy Executive Director, and Maribel
Chavez, Fort Worth District Engineer, who presented former Mayor Gary Fickes with the
prestigious Road Hand Award for his many contributions to transportation issues.
The Mayor called for a short recess for a reception in honor of Mr. Fickes at 5:45 p.m.
and called the meeting back to order at 6:05 p.m. City Council reviewed the agenda items
with city staff and applicants. Agenda items 9A and 9B were added to the consent
agenda. The work session ended at 6:19 p.m.

Agenda Item No. 2A. Executive Session: Mayor Wambsganss announced that the City
Council would be going into Executive Session pursuant to the Texas Government Code,
Section 551.071, consultation with city attorney; Section 551.072, deliberation regarding
real property; Section 551.073, deliberation regarding prospective gift; Section 551.074,
deliberation regarding personnel matters; Section 551.076, deliberation regarding security
devices; Section 551.087, deliberation regarding economic development negotiations;
Section 418.183(f) Texas Disaster Act; and Section 418.106(d) & (e), local meetings to
discuss emergency management plans regarding pipeline safety. City Council adjourned
for Executive Session at 6:30 p.m. Executive Session began at 6:41 p.m. and ended at
7:06 p.m.
Councilmember Stephen left for a prior commitment at 6:50 p.m. and returned later in
the meeting.
Agenda Item No. 2B. Reconvene: Mayor Wambsganss reconvened the regular meeting at
7:11 p.m.
Agenda Item No.3. Invocation: The invocation was given by Norma Quinn of White's
Chapel United Methodist Church. Mayor Wambsganss led the audience in the Pledge of
Allegiance.
Agenda Item No. 4A. Mavor's Report: Mayor Wambsganss announced upcoming
meetings and events. Councilmember Morris and Assistant to the City Manager Eaglen
recognized "S.P.I.N. into Spring" sponsors and participants.
Agenda Item No. 4B. City Manager's Report: City Manager Campbell thanked the Brook
Mays Music Company for the temporary use of the player piano in the grand foyer of
Town Hall during Early Voting.
Agenda Item No. 4C. SPIN Reoort: A written report was provided to Council.
Agenda Item No. 4D. Library Board Reoort: A written report was provided to Council.
Agenda Item No. 4E. Park and Recreation Board Report: Elaine Cox updated Council on
recent and upcoming activities.
Agenda Item No. 4F. Local Business Report: None.
CONSENT AGENDA: Consent agenda items are considered to be routine by the City
Council and are enacted with one motion. The Mayor read the items into the record.

2. Are these conditions required to be fulfilled prior to zoning
change or what happens if they are not met ?
3. Who is the Southlake Official that is responsible for your
conditions being implemented ?
4. Should Feedstore BBQ get it's zoning /site plan approved,
and decide to continue adding things (such as the new blue
dumpster in rear parking lot), what person in Southlake will
have compliance enforcement authority ?
At 520 S. White Chapel Blvd., stored in the rear yard of this
residential zoned property there is :
1. a white temporary bldg.
2. (2) appx. 12 x 8 x 8 storage containers
3. a Feedstore BBQ concession trailer
4. a flat bed trailer
All of which should be ordinance violations, however,
according to Mr. Garland Wilson's March 17, 2004 letter on the
matter, " In summary, no code violations were noted."
According to Bruce Payne's interpretation of Southlake's
zoning ordinance as it relates to Mr. Lafaver's properties there
is nothing wrong here.
In summary, the entire situation with Mr. Lafaver's
properties has been fostered by Bruce Payne's double standard
interpretations. Mr. Payne has knowingly misrepresented facts
to Mr. Paul Ward so as to assist Mr. Lafaver's adding (2)
outside refrigerated units in July 2003. Mr. Payne has
interfered with Code Enforcement by his double standard
interpretations. This entire situation is nothing more than
"good ole boy" favors. The residents of Southlake never need
to forget the experiences of "good ole boy" favors of the past,
such as,
1. A former Mayor trying to get a "gas station" approved at NW
corner of S. White Chapel & Continental for a friend
2. A former P & Z Chairman sending people to sell neighbors
on the merits of apartments that were a part of a project
3. Southlake's real estate agent selling taxpayers land for
$3.75 per ft. that had major drainage problems while that
same broker was selling land next door to a "good ole boy"
for $1.50 per ft.
Those that make mistakes and don't learn the lesson are
destined to repeat those mistakes. It certainly should concern
this whole community that Southlake's Planning Director has
the authority to operate by a discriminatory zoning ordinance
interpretation. Hopefully, whatever conditions you deem most
fair will be implemented without compromise & you will require
a clean -up of the salvage yard that is emerging at 520 S. White
Chapel and we all can get on with more constructive business.

Mr. Hargett:
In response to your letter dated February 17, 2004 I have again reviewed the property at
530 S. White Chapel Blvd with staff I will respond according to the numbering on your
letter.
1. Patio dining area at North West corner of building was part of the original
feed store building.
2. Roof top refrigeration equipment is screened from view of public right -of-
way.
3. Accessory use location across property line is not a violation due to same
property owner.
4. Same case as item 3 above.
5. Required parking is provided on site. No violation is noted.
1. Storage of catering trailer is in compliance with section 34.2 of the Zoning
Ordinance. It is located behind the main building.
2. Same condition as item 1 in this section and property line issue of item 3
above.
In summary, no code violations were noted. Please be advised that any interpretation of
the Zoning Ordinance is subject to appeal to the Administrative Official. That official is
Bruce Payne, Planning Director.

of building
2. appx. 25 X 8 X 8 outside refrigerated unit with (2) roof top
condensing units - added mid July 2003 that sits in rear
building set -back. Electrical only was permitted.
3. appx. 12 X 8 X 8 ft. outside container that is electrically
wired & vented that is used in BBQ business and is located @
agricultural property that adjoins to the west in easement
4. Screened refuse container that is used for BBQ business,
also, located on agricultural property
5. Vehicles are parked within 10-15 ft. of street

As I interpret the zoning ordinances of Southlake, these are
all violations. The City Secretary has referred me to you as the
department head of Code Enforcement. Would you please
review these matters and explain which are not violations &
why'& which have been granted Southlake permission. Your
