EXECUTIVE
SUMMARY: AOS Investments Group is requesting approval of a Site Plan for the purpose of
constructing a 5,950 square foot single story office building located at 469
Cherry Lane. SPIN Neighborhood District # 4.
REQUEST
DETAILS: AOS Investments Group is requesting approval of a Site Plan for the
construction of a 5,950 square foot single story office building which is intended
to house the Alliance Office Systems administrative, sales and service support
offices.
The following variances have been requested:
The Tree Conservation Plan submitted does not meet tree preservation
requirements. The plan shows existing tree cover to be approximately 10% of
the lot area which requires preservation of a minimum of 70% of the existing
tree cover according to Section 7.2, Table 2 of the Tree Preservation Ordinance
No. 585, as amended. The applicant requests a variance to allow
preservation of approximately 34% of the existing tree cover.
Setbacks /Yards: Any applicable structures abutting a local street (i.e.,
residential street and cul -de -sac as defined in the Thoroughfare Plan) shall
provide minimum front and side yards equivalent to the front and side yards
required for the single family residential property within 400,' but not less than
the front and side yards otherwise required in the underlying zoning district.
There is property having SF -1A zoning within 400 feet of this site which
requires a minimum front yard setback of 40 feet for the subject property.
The applicant proposes a front yard setback of 30 feet.
A minimum 5 foot sidewalk is required along Cherry Lane per Section 33.19 of
the Zoning Ordinance No 480, as amended. The applicant is requesting
approval to allow the funds for the construction of the sidewalk to be put
in escrow, to await construction of adjoining curb and gutter street
(and /or sidewalks within the area). The estimated cost is $1,326 ($3 x
110.5 linear feet @ 4 feet in width).

Under the Southlake 2030 Consolidated Land Use Plan the subject
property is designated as Mixed Use.
TREE PRESERVATION: The applicant is proposing to preserve thirteen (13) of the thirty -five (35)
existing trees on the site.
P &Z ACTION: August 23, 2012; Approved (7 -0) subject to Staff Report #3, dated July
5, 2012; granting the variance for 34% existing tree canopy, noting that
any canopy tree cover will require 50% at 4 -inch caliper and none less
than 2 -inch caliper; granting the variance for 30 -foot front yard setback;
accepting the funds for future sidewalk construction be placed in
escrow; subject to the addition of door and walkway on west elevation
for a more residential look facing Cherry Lane; and, noting the applicant
will connect to sewer once it becomes available through the
development of the adjacent property to the east.

The above referenced site plan submittal complies with all zoning and development code
ordinances /requirements with 3 exceptions.
The three requested variances are listed below.
Front Building Setback— 30 feet. The front building line for zoning district SF -1A is
40 feet. The building line shown on the recorded subdivision plat is 25 feet. We are
proposing a front setback of 30 feet for the following reasons:
a. We have located the parking spaces for the business on the side of the
building instead of the more frequent design with the parking spaces in front
of the building. This design was utilized to have the minimum impact on the
residential properties across the street.
b. The property slopes down significantly from the front to the back [west to
east] and the farther the building is located from the street the more fill is
required to be placed under the building.
Percentage of existing tree canopy preserved — 34 percent. The tree preservation
ordinance requires for a lot with an existing tree canopy coverage percentage of
10.4 percent, 70 percent of that coverage must be preserved. We are requesting
this variance for the following reasons:
a. There is over 12 feet of fall from the roadway to the rear of the lot, and any
development scheme of this lot will result in a significant grade change for
most of the existing trees.
b. Most of the existing trees are located so that compl iance with the 70 percent
requirement would make this lot undevelopable.
c. Twelve trees totaling 92 caliper inches are shown to be preserved, and a total
of 44 new trees are proposed to be planted.

3. The public sidewalk along Cherry Lane will not be constructed with this
development. The development ordinances require that a public sidewalk be
constructed within the street right -of -way for the entire frontage of the property.
We are proposing to put the cost for the concrete sidewalk into an escrow fund at
the city in lieu of constructing the sidewalk. The reasons /justifications for this
request are as follows:
a. Cherry Lane is an unimproved street section meaning that there is no curb
and gutter. There is an existing bar ditch along Cherry Lane which makes
construction of the sidewalk very difficult.
b. There are no other sidewalks along Cherry Lane.
c. The funds would be placed in an escrow account, so at the time the street is
improved with curb and gutter, the sidewalk could be constructed along this
tract at no cost to the city.

• The property is located at 469 Cherry Lane; it is approximately 1.0 acre.
Development Details
• The applicant is proposing the construction of a 5,950 square foot one -story office
building. The proposed building will look residential and blend into the neighboring
homes. Alliance Office Systems will have approximately twenty (20) employees; only six
(6) of them full -time.

QUESTIONS i CONCERNS
• What made you pick this location?
o We have been looking for over a year. We had property picked out located off
Nolen that we lost. Grapevine was an option but had sewer issue. Our business
is here in Southlake, we want to keep our Southlake address. There are limited
locations here.
• When will you start building?
o We plan to start as soon as we gain approval.
• Who owns the other two acres?
o Dr. Simone?
• What is the city doing to address water issues for new development? This is the second
year for strict water restrictions. Is the city taking development into consideration?
o Yes. There are plans for future improvements regarding infrastructure and
resources that are a part of the Southlake 2030 Comprehensive Master Plan.

• Yes, but we want our entrance to face State Highway 114 for exposure.
• We also configured our parking lot in a way that it would not be in view of the
residents across the street.

3. The Tree Conservation Plan submitted does not appear to meet tree preservation requirements
(See Landscape Administrator's comments). The plan shows existing tree cover to be
preserved as 34.31 %; required tree cover to be preserved is 70 %. Variance has been
requested.
4. Setbacks / Yards: Any applicable structures abutting a local street (i.e., residential street and cul-
de -sac as defined in the Thoroughfare Plan) shall provide minimum front and side yards
equivalent to the front and side yards required for the single family residential property within 400,'
but not less than the front and side yards otherwise required in the underlying zoning district. SF-
1A Zoning District front yard setback is 40 feet; the site plan shows a front yard setback of
30 feet. Variance has been requested.

Informational Comments:
Provide sidewalks and /or trails in compliance with the Subdivision Ordinance No. 483, as
amended and the Master Pathways Plan. A five foot sidewalk is required along Cherry Lane.
The proposed request for escrowing funds as stated on the submitted site plan will require
City Council approval.
The Development Review Committee (DRC) has determined this re- submittal is sufficient for
formal submittal to the Planning and Zoning Commission subject to completing the changes noted
above. The applicant should be aware that a formal submittal for the next scheduled Planning and
Zoning Commission meeting must be received at the City by 5:00 p.m. on July 23, 2012. A total
of 27 revised copies of each plan folded to 6" X 9" and a single 11" X 17" reduction of each plan
must be submitted. If not received before the deadline, the item will be moved to a later P &Z
agenda. If any significant changes, other than those noted above are made to the submittal, the
plan could be withheld from processing until a later meeting or remanded back to the
Development Review Committee for review.
No review of proposed signs is intended with this site plan. A separate building permit is required
prior to construction of any signs.
All mechanical equipment must be screened of view right -of -ways and residential properties in
accordance with the Zoning Ordinance No. 480, as amended.
All lighting must comply with the Lighting Ordinance No. 693, as amended.
All development must comply with the Drainage Ordinance No. 605 and the Erosion and Sediment
Control Ordinance No. 946, as amended.
It appears that this property lies within the 65 LDN D /FW Regional Airport Overlay Zone and will
require construction standards that meet requirements of the Airport Compatible Land Use Zoning
Ordinance No. 479.
The applicant should be aware that prior to issuance of a building permit a Plat must be
processed and filed in the County Plat Records, a fully corrected site plan, landscape plan,
irrigation plan, and building plans, must be submitted for approval and all required fees must be
paid. This may include but not be limited to the following fees: Park Fee, Perimeter Street Fee,
Water & Sewer Impact and Tap Fees, and related Permit Fees.

TREE CONSERVATION COMMENTS:
The proposed development's tree preservation must comply with the Existing Tree Cover
Preservation Requirements as outlined in Table 2.0 of the Tree Preservation Ordinance
585D.
Except as provided by subsection 7.2.b., a Tree Conservation Analysis or Tree Conservation
Plan shall be approved if it will preserve existing tree cover in accordance with the
percentage requirements established by Table 2.0. If the property has previously received a
tree permit related to development, the percentage of existing tree cover at the time the first
such permit was issued shall be used to calculate the minimum existing tree cover that must
be preserved under this section.

Tree Conservation Plan must be preserved and protected during all phases and construction
of the development. Alteration or removal of any of the existing trees shown to be preserved
on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance
and the zoning as approved by the Southlake City Council. Please ensure that the layout of
all structures, easements, utilities, structures grading, and any other structure proposed to
be constructed do not conflict with existing trees intended to be preserved.

GENERAL COMMENTS:

GENERAL COMMENTS:

FIRE LANE COMMENTS:
Fire apparatus access needs to be provided to within 150 feet of all exterior portions of the
perimeter of buildings on a "hose -lay' basis. Fire apparatus access, if necessary, needs to be all
weather surface (asphalt or concrete) 24 feet wide and able to support fire apparatus. Fire lane
will extend completely around the building.
Fire apparatus access needs to be designed and maintained to support the imposed loads of fire
apparatus (minimum of 75,000 Ibs GVW).
