Chris Tribble, Director of Community Services presented this item. Commissioner Fairchild asked Staff if they had any thought about people using the park as a cut through or short cut. Chris Tribble stated that the way the road will be set up there will be multiple stop signs along the route and the speed limit of 7mph will be posted. Chairman Hudson asked about speed bumps. Chris Tribble stated no. Commissioner Springer asked about the artificial turf field and its use. Christ Tribble stated it would be used for lighted practice space for all sports. Also, it will cut down on maintenance cost and water. Commissioner Springer asked if Miracle Field can be used for both handicap and non - handicap. Chris Tribble stated it has a multi - purpose use. Chris Tribble stated that the decision was made based on current use. Commissioner Williamson asked where the new six tennis courts will be located. Chris Tribble showed the Commission where they will be located. Commissioner Williamson asked about practice space for the youth organizations. Chris Tribble stated that several of the fields can be used for games as well as practice and multiple younger teams can occupy the same field. Commissioner Parrish asked how old the log cabin was. Chris Tribble stated that the lodge is old enough that it cannot be moved due to structural issues. The portable buildings will be removed. Chairman Hudson opened and closed the public hearing. Agenda Item No. 10 - ZAl2 -054, Site Plan for Alliance Office Systems on property described as Lot 1, Block A, Briarwood Estates Phase 1, an addition to the City of Southlake, Tarrant County, Texas and located at 469 Cherry Lane, Southlake, Texas. Current Zoning: "0-1" Office District. SPIN # 4. Lorrie Fletcher, Planner I, presented this item. Commission Springer asked if the duplexes were individually owned or rental properties. Lorrie Fletcher stated that she was unable to answer that. Jim Dewey with JDJR Engineers located at 2500 Texas Drive, Irving, TX came forward. Mr. Dewey explained that Alliance Office Systems is currently located on Commerce Street. They sell and repair /maintain office copier and printer systems. Mr. Dewey addressed each variance. Commissioner Springer asked Mr. Dewey to clarify the request for the 30 -ft setback versus the required 40 -ft. setback. Mr. Dewey stated that by having the 30 -ft. setback, it would allow the parking to be located in the rear of the property, less trees to be removed and more landscaping buffer for the front. Don Harris, the owner of Alliance Office Systems located at 271 E Southlake Blvd, Suite 150, Southlake, TX came forward. There is a cluster of trees that will be affected by moving the building back. Commissioner Williamson asked the applicant why they prefer to face State Highway 114 versus Cherry Lane. Don Harris believes it would be a better fit for Cherry Lane to face State Highway 114. Commissioner Springer expressed concern that the traffic would have to go through the neighborhood to get to their office due to one way traffic on State Highway 114. Commissioner Williamson asked if Alliance was to face Cherry Lane, wouldn't it affect that large clump of trees. Mr. Dewey stated that due to the grade, those trees cannot be saved. Facing State Highway 114 is a better fit for the landscaping, parking and the neighborhood. Chairman Hudson asked if they thought of adding an additional entry onto the building facing Cherry Lane to make it more residential. Mr. Harris and Mr. Dewey stated yes. Commissioner Fairchild agreed with Chairman Hudson. Commissioner Springer asked about the sewer system. Mr. Harris stated that the hotel Victory Lane will be building a sewer line that Alliance will tie into. Commissioner Fairchild and Chairman Hudson both addressed the front entry door. Chairman Hudson opened and closed the public hearing. Commissioner Parrish stated that he would like the business to look like a house due to its surroundings. Chairman Hudson agrees with the variance for the 30 -ft. front setback and likes the additional buffer with the parking to the side and out of sight from the residential neighbors. Commissioner Smith agreed. Commissioner Fairchild asked for a caliper increase on the replacement of trees. Dennis Killough stated the landscape ordinance regarding tree replacement and coverage and asked the Commission to include it in the motion. Made a motion to approve ZAl2 -054 subject to Staff Report #3, dated July 5, 2012; granting the variance for 34% existing tree canopy, noting that any canopy tree cover will require 50% at 4 -inch caliper and none less than 2 -inch caliper; granting the variance for 30 -foot front yard setback; accepting the funds for future sidewalk construction be placed in escrow; subject to the addition of door and walkway on west elevation for a more residential look facing Cherry Lane; and, noting the applicant will connect to sewer once it becomes available through the development of the adjacent property to the east. Current Zoning is "C -3" General Commercial District. SPIN # 8. Lorrie Fletcher, Planner I, presented this item. Jim Haleran with Design Duncan Miller Ullmann at 1203 Dragon, Dallas, TX and Juan Florez Project manager came forward. Chairman Hudson asked what kind of pizza oven it is. Mr. Florez stated it was a wood fire commercial pizza oven. There will be a prep area and a table for the dough. Commissioner Williamson asked what the previous plan was and why the change. Mr. Florez stated it was on the original plan. The owner decided to remove it during the original site plan submittal. He has now since changed his mind. Commissioner Williamson asked if the pizza oven was going to be visible to those on the patio. Mr. Florez stated yes. The area will be enclosed with glass but it will give the patrons a chance to watch the pizza made. Commissioner Parrish asked if the applicant lost a door to the patio area. Mr. Florez stated yes, but there are 2 more doors that access the patio. Commissioner Fairchild verified with Staff that the Fire Marshall has approved this plan. Dennis Killough stated yes. Chairman Hudson opened and closed the public hearing. Made a motion to approve ZAl2 -073 subject to Site Plan Review Summary #1 dated August 17, 2010 and granting the variance request for 71 parking spaces instead of the required 72 parking spaces. Lorrie Fletcher, Planner I, presented this item. Dennis Killough added that this item is still under review from the City Attorney. Any motion recommended needs to include that language. City Attorney clarified the changes to Ordinance No. 480 -KKKK. Regarding a non- conforming lot when later property is taken; if you come in and there is a partial or total destruction of the structure and determine whether a building permit is issued we just add back the amount of the lot that was taken by imminent domain and determine whether or not impervious cover applies. Chairman Hudson opened and closed the public hearing. Made a motion to approve Ordinance No. 480 -KKKK subject to any changes that the City Attorney may recommend before it goes to Council with respect to any language that the City Attorney may recommend.
