REQUESTED ACTION Approve Resolution 12 -040, Authorize City Attorney to bring condemnation action for the purpose of obtaining a permanent sanitary sewer easement located within the Larkin H Chivers Survey, Abstract No. 300 at 555 E. State Highway 114 The requested action for this item is to approve Resolution 12 -040 Authorizing the City Attorney to bring condemnation action for the purpose of obtaining a permanent sanitary sewer easement. The property is located in the Larkin H Chivers Survey, Abstract No. 300 at 555 E state highway 114 and the location of Mike's Garden Center. FA • Required for the construction of a 12 -inch Sanitary Sewer to serve the Southlake Medical District Addition • 0.150 acre (6,537 SF) Permanent Sanitary Sewer Easement • 0.520 acre (22,651 SF) Temporary Construction Easement The City is currently acquiring permanent sanitary sewer easements and temporary construction easements for the construction of approximately 670 linear feet of 12" sanitary sewer line along the frontage road of E. State Highway 114. One of the easements that is needed is located at 555 E. State Highway 114 which is owned by William Michael Cook. The property is the location of Mike's Garden Center which retails landscaping products. Staff has met with the property owner on several occasions, but has not been able to come to an agreement on the property acquisition. As a result, Resolution 12- 040 is being enacted in order to authorize the City Attorney to bring condemnation action. The permanent sanitary sewer easement is necessary in order to construct a 12" Sanitary sewer line to serve the Southlake Medical District Addition west of this property. The Forest Park Medical Center at Southlake is currently under construction within this addition. The permanent sanitary sewer easement being requested is 15' wide and runs parallel to the eastbound frontage road of state highway 114 and will encompass 0.15 acres. The easement will traverse through the parking lot of Mike's Garden Center. The temporary construction easement is 50 feet wide along the same alignment and will encompass 0.52 acres. 3 Easement; and • Temporary Construction Easement • $77,918.00 The City of Southlake through a 380 Agreement with Southlake Land Holdings, LP agreed to purchase the easement for the 12" sanitary sewer line along the eastbound frontage road of SH 114. The amount of $77,918 dollars includes the purchase of the permanent easement and the temporary construction easement. The values have been obtained by an appraisal which was completed in March 2012. • Permanent Sanitary Sewer Location Map The 15 ft. sanitary sewer easement acquisition is part of the infrastructure improvements that are being constructed with the Southlake Regional Medical Center Addition. The improvements include a 12" water line and 12" sanitary sewer line along the eastbound frontage road of SH 114. The Location map also shows the locations of the off -site easements needed for the 12" sanitary sewer line which will connect to the existing sanitary sewer main near Dove Creek. 5 Financial Considerations Improvements The funding for the permanent sanitary sewer easement acquisition will be included in the budget request for the Capital Improvements Projects Utility Fund.
