This exhibit shows Parcel 235 — the 0.155 acre of right of way being acquired by the
city for the water main and future sidewalk. The blue area is Parcel 35 which has
been acquired by Tarrant County through condemnation proceedings as TxDOT row
for the FM1938 project. Tarrant county's share of the FM1938 project includes the
acquisition and payment for the required TxDOT ROW. They are also acquiring the
city ROW at the same time. It was determined prior to the condemnation hearing
for Parcel 235 that the roadway easement to the south, shown on the exhibit has
Gifford Court, had previously been abandoned and deeded back to the property
owner. The actual pavement for Gifford Court, or Dream Maker Lane, is within the
private property of the owner to the south of the private drive.
Due to this determination, Parcel 235 now includes the land to the south, as shown
on the next slide. Initial and final offer letters have been sent to the property owner
by Tarrant County. In the case of a condemnation proceeding such as this one,
Tarrant County has pursued the condemnation of the TxDOT ROW and the city will
be responsible for condemnation of the city parcel.
