REGULAR AGENDA: Planning and Zoning Commission Meeting Minutes — August 9, 2012 Page 1 of 13 Agenda Item No. 14 - ZAl2 -071, Site Plan for Carroll ISD Administration Building on property described as Lot 1, Block 1, Carroll ISD Addition No. 3, an addition to the City of Southlake, Tarrant County, Texas and located at 1101 E. Dove Rd., Southlake, Texas. Current Zoning: CS Community Service District. SPIN Neighborhood # 2. PUBLIC HEARING Derek Citty with CISD, 3051 Dove Road, Grapevine, TX, came forward. Commissioner Parrish asked what Mr. Citty's time frame was. Dr. Citty stated December 1St Commissioner Springer asked what the loading dock is for. Dr. Citty answered that the existing gym will become a warehouse. Commissioner Springer asked if the trees can be relocated rather than thrown away. Dr. Citty stated that he would look at the cost effectiveness and the survivable ratio of those trees. Commissioner Fairchild asked if Dr. Citty would be willing to increase the caliber of the replacement trees along with the amount of trees. Dr. Citty stated that could be possible, but would need to look into it further. Commissioner Smith asked if the area across the street was residential and if the loading dock was visible to those residents. Dr. Citty stated yes a small bit, but the trees will break up the view. Commissioner Smith continued to ask what would be stored in the warehouse and how much traffic will there be. Also, what size truck will be making the deliveries? Dr. Citty stated on a typical day 4 to 6 deliveries daily will be made, grounds staff will be located in the back shielded by the building. The dock can handle an 18 wheeler. Commissioner Fairchild asked about why CISD did not go to SPIN. Dr. Citty stated that he believed there is very little impact residentially. Commissioner Springer asked about the canopies on the site plan and the vestibule. Dr. Citty stated that the canopy will serve as a drop area for special needs students during bad weather. Regarding the vestibule stated it was a buffer to keep the temperature regulated at the entrance. Planning and Zoning Commission Meeting Minutes —August 9 2012 Page 2of13 Commissioner Williamson asked if the building will be used for other student assignments and activities. Dr. Citty stated that the building will be primarily used for administrative offices and professional learning. Commissioner Parrish opened the public hearing and read aloud the Public Comment Forms. Ted Apodaca with Delta 8 Properties, 508 Liberty Ct, Colleyville, TX, came forward. Mr. Apodaca stated that Delta Properties owns the 10 acres on the west side and would like to know what operations will be conducted out of the service yard, what the hours of operation would be and what kind of traffic. Dr. Citty stated it will be a small warehouse with service trucks, and storage. Most traffic will be internal only with minimal impact. The hours of operation are generally 8:30 am to 5:00 pm. Kent Stewart with the Bethel Methodist Church, 2421 Spring Valley Dr. Bedford, TX came forward. Mr. Stewart wanted to know what kind of barrier will be erected along the western boarder that would be esthetic and functional for both noise and site. Dr. Citty stated that currently there is no plan to improve on the western side. Carolyn Apodaca, 508 Liberty Ct, Colleyville, TX, came forward. Would like to see the western border would be screened and would also like to see the service area redirected toward the northern border. Dr. Citty stated that all noisy activity will be in center of the property other than vehicular noise. Commissioner Smith clarified with Dr. Citty that no SPIN meeting took place which did not give the surrounding residence a chance to voice their opinion before tonight. Commissioner Parrish asked when this facility was last used as a school and when was it built. Dr. Citty stated that it was vacated at the end of the school year for 2010/2011. The library has been used for board meetings. The building was built in 1960. Commissioner Parrish also clarified that this is the site of the old Dragon Stadium. Dr. Citty stated yes. Commissioner Williamson asked Dr. Citty to clarify what type of maintenance will be taking place at the facility. Dr. Citty it would be regular maintenance and grounds crews. Planning and Zoning Commission Meeting Minutes —August 9 2012 Page 3of13 Ryan Smith, 1532 Main St, Southlake, TX, came forward. Mr. Smith voiced his opinion that CISD should have had a SPIN meeting and continued to state that SPIN is a very important part of this City's process. Also, when a homeowner removes a tree they have to replace it caliber for caliber. CISD should be held to the same standards. Dr. Citty stated that CISD will meet the letter of the ordinance. Commissioner Williamson asked if an 18 wheeler can navigate through a round -a -bout. Cheryl Taylor, Civil Engineer, stated that truck aprons were installed for that reason. The purpose of the bricks is to give larger vehicles extra room to get through the round - a- bouts. Commissioner Parrish closed the public hearing. Commissioner Fairchild and Williamson reminded Dr. Citty that this meeting would have gone smoother if a SPIN meeting had been conducted. Also, Commissioner Williamson continued to state that he did not believe it was CISD's responsibility to build a screening wall on the border. Commissioner Parrish continued to state that the use of the facility will not change drastically and should not have a large impact on the neighborhood. Made a motion to approved ZAl2 -071 subject to Site Plan Review Summary #2 dated August 2, 2012 with the condition that the applicant meet and/or exceed all current tree preservation ordinances. PUBLIC HEARING Commissioner Forman clarified that the future land designation as "mixed use ". Konstantine Bakintas with Baird, Hampton & Brown, Inc., 4550 SH 360, Suite 180, Grapevine, TX, came forward. Mr. Bakintas explained the variance requests that are accompanying the request for zoning change and site plan. Commissioner Parrish asked if they plan to keep the drive onto Nolen Dr., if and when Village Center Dr. is built. Mr. Bakintas stated yes. Commissioner Parrish opened and closed the public hearing. Commissioner Fairchild asked Staff to address the variance request since the road is not built yet. Dennis Killough stated that they will be dedicating their portion of the right -of -way that cuts through their property. Also, approval of the plan and the preliminary plat will establish part of the alignment of Village Center Dr. The applicant is proposing % of that alignment which has defined the center line through the length of their property. The Thoroughfare Plan identifies the need for this connection. The Subdivision Ordinance allows the City to require dedication of that thoroughfare. Commissioner Parrish stated that the dedication at this point and time because the way this property is set and because of the way Village Center Drive is proposed to go forward right there at the intersection of Village Center Drive and Nolen Drive we will have some issues. We do not have full dedication up to the center line. Dennis Killough stated that is a consideration that needs to be made as part of this application. It will establish a location for Village Center Drive by what they are proposing. When the property to the north develops, as part of their plan and plat consideration, the City will require dedication of the portion within their property boundary. PUBLIC HEARING Commissioner Parrish clarified with Staff that there is no sidewalk across the property to the west on the corner of Silicon and Exchange. Matt Jones stated that there is not a sidewalk across the front, but there is a sidewalk on the east side of Silicon. Don Shriver, 1319 Montgomery Lane, Southlake, TX, came forward. Commissioner Fairchild asked the applicant if the parking lot to the west is a separate parcel. Planning and Zoning Commission Meeting Minutes — August 9 2012 Page 6 of 13 Mr. Shriver stated yes. At one point this property was re- platted and this area was the original property line. The owner added additional parking. Commissioner Fairchild asked if there was a cross access easement. Mr. Shriver stated yes. Commissioner Fairchild asked if Mr. Shriver would be willing to add additional landscaping to the east of the property. Mr. Shriver explained is current landscape concept plan. Commissioner Parrish asked about the parts. Mr. Shriver stated that there is no processing or chemicals on property. Parts are new and used. Commissioner Parrish opened and closed the public hearing. Commissioner Springer and Smith stated that they would like to see sidewalks and Commissioner Parrish agreed especially along Exchange. Dennis Killough stated that recently Public Works has a proposed item in our 2013 budget and has been in negotiations with the City of Grapevine on making that connection along Nolen Drive. This is information Staff did not have when this item went before ZBA. Commissioner Forman asked about sidewalk requirements and how that would affect the property owner to the west. Dennis Killough stated that future development determines sidewalks along with CIP projects and budget. Mr. Shriver stated that until the City puts in their side of the sidewalk, the sidewalk I install would look like an unfinished project. This discussion came up at ZBA. Commissioner Smith asked when the change was done to require sidewalks. Dennis Killough stated 2007 or 2008. Commissioner Parrish asked if there was an escrow option. Dennis Killough stated yes. Commissioner Parrish asked the applicant if he would be interested in an escrow for future sidewalks. Mr. Shriver stated he would prefer an agreement versus escrow and only if and when Planning and Zoning Commission Meeting Minutes — August 9 2012 Page 7 of 13 the City builds their sidewalks. City Attorney stated that an escrow would actually be cheaper than an agreement and the enforcement of that agreement. Commissioner Smith agreed. PUBLIC HEARING David Keener, with G & A Consultants of 111 Hillside Dr., Lewisville, TX, came forward. Mr. Keener presented additional slides showing elevations and explained the facility use. Commissioner Springer asked if Mr. Keener if he owned the other 2 lots and what his future plans were for them. At this time, he does not have any future plans for them. Keith Kithsiri, with G & A Consultants of 111 Hillside Dr., Lewisville, TX came forward. Mr. Kithsiri explained that this facility is a great business but more importantly it is about the residents who will live there and providing them with compassionate care. Commissioner Fairchild asked Staff about the masonry requirements regarding percentage. Dennis Killough stated it is questionable regarding percentage due to the zoning and use. If applied the percentage would be outside of the 20 %. Commissioner Fairchild wondered if the hardi plank on the gable could be stone. Mr. Keener stated that the entire rear portion of the building is stone. Commissioner Springer asked what the upper area was. Mr. Keener stated that the facility is one story with high vaulted ceilings. Commissioner Parrish opened the public hearing. Nancy Jackson, 1240 Post Oak, Southlake, TX, came forward. Mrs. Jackson expressed her support for this project. Commissioner Parrish closed the public hearing. PUBLIC HEARING Jeff Kennemer with Hines Southlake Land Lp, 717 Texas St, Suite 1500, Houston, TX, came forward and gave a presentation explaining each change and /or correction to the development. Commissioner Parrish asked if the CC &R will permit parking in the driveways. Mr. Kennemer stated that there is nothing in the CC &R that would prevent anyone from parking in the driveway. Commissioner Springer asked Staff to clarify the language of the height. Dennis Killough summarized the measured height; 1) highest adjacent grade next to the building, 2) a pitch roof, is measured to the average height of the pitch roof which is the mid -point between the peak and the plate or eave line of the structure, 3) a parapet roof is measured from highest adjacent grade to the type of parapet, 4) on a mansard type roof it is measured from the highest adjacent grade to the deck line. If you have a substantial change of grade between, allowing the foundation of the property, there is a provision on how to address that in the ordinance. Carillon wrote their definition in the regulation which became difficult to administer. City would like to stick with the definition of our zoning ordinances to how it is applied to buildings rather than how it was written under their specific code. Commissioner Parrish opened and closed the public hearing. The Commission went through the 8 changes and /or corrections individually. Commissioner Springer was uncomfortable with the front facade allowing 1 -ft. Commissioner Springer is concerned that builders will choose the 1 -ft. facade to Planning and Zoning Commission Meeting Minutes — August 9 2012 Page 10 of 13 increase square footage of the footprint and each facade would look exactly the same. Commissioner Parrish and Commissioner Williamson shared in Commissioner Springer's concerns and asked for a percentage regarding the front facade. This would allow for some different facades. Paige Shipp with Hines Southlake Land Lp, 717 Texas St., Ste. 1500, Houston, TX, came forward. Mrs. Shipp is the manager for this project and her suggestion is to state a percentage. Made a motion to approve ZAl2 -066 subject to the Site Plan Review Summary #2 dated August 1, 2012 with the exception of item #3 of the proposed regulations: Instead of allowing the 2 paragraph to be changed on page 75 from the facade zone to a minimum of 25% of any detached product that be set back at least 1 -ft. from the front facade of the building to the filing. The front facade zone of a minimum 20% of any detached product of the setback shall be at least 2.5 -ft. from the front facade of the building. PUBLIC HEARING Commissioner Williamson recused himself due to a conflict of interest. Jeff Medici with CHOC, LLC, 2123 Cheyenne Park Ln., Southlake, TX, came forward and gave a separate presentation showing the development. Mr. Medici addressed issues that came up at SPIN regarding the line of sight and excessive noise after hours. Commissioner Smith asked for an example of Light Industrial use. Dennis Killough stated warehouse, storage facility and manufacturing with a site plan approval. Commissioner Fairchild asked about mechanical equipment on the roof. Mr. Medici stated that all mechanical equipment will be shielded from view. Commissioner Smith asked about the placement of trash and dumpsters. The Commissioners discussed the surrounding businesses and zoning. Commissioner Parrish asked what was between the conference room area and the racetrack. Mr. Medici stated it would be a courtyard. Commissioner Fairchild asked about the separation of the restaurant and the kitchen. Commissioner Parrish shared Commissioner Fairchild's concerns. Mr. Medici stated that the staff would travel through the reception area. There is also a small section just outside under an awning. Commissioner Fairchild stated that the west elevation specifically the tower looked too institutional for Southlake. A suggestion would be balconies that overlook the courtyard and pool. Mr. Medici stated that would be possible. Commissioner Parrish opened the public hearing and read aloud the Public Comment Forms. Lauren Stone, 2606 Day Ct, Southlake, TX; Randy and Jennifer Robbin, 1710 Bur Oak Dr. Southlake, TX; David Keener, 575 Southview Trail, Southlake, TX; Tim Stone, 2606 Day Ct, Southlake, TX; All cards stated that they are in support of this development but do not wish to speak. Ryan Smith, 1532 Main St, Southlake, TX, came forward. Mr. Smith stated that he was in support of this development. Jim Makens, 3231 Harwood, Bedford, TX, came forward. Mr. Makens represents the property owner adjacent to the property and is in favor of the development and would like to have curb access to the property connecting the two. John Reynal, 204 Westwood Dr. Southlake, TX, came forward. Mr. Reynal stated that he owned 575 and 577 Cherry Lane that is located behind the development. Mr. Reynal is concerned about the impact it will have on his rental property and is opposed to this development. John Van Til, 2623 Peninsula Dr., Grapevine, TX, came forward. Mr. Van Til is in opposition of the development. Mr. Van Til owns the duplex next to Mr. Reynal and agrees with him. Commissioner Parrish closed the public hearing. Mr. Medici came forward to address Mr. Reynal and Mr. Van Til's concerns. Commissioner Parrish asked about the cross access easement that was mentioned by Mr. Makens. Mr. Medici stated that it is not a possibility due to the channel. All the Commissioners expressed that they liked the development but showed concern for the west side elevations. Made a motion to approve ZAl2 -067 subject to the Concept Site Plan Review Summary #2 dated August 3, 2012 with a note that this will be a full service hotel; Restaurant with lounge, 24/7 room service, at least 5,000 sq. ft. of meeting space, swimming pool, fitness center, business center, guest service and shuttle service to Town Square and DFW Airport. Also, the dumpster needs to be located contiguous to commercial zoning instead of residential zoning and the variance request to reduce the stacking depth of the North Kimball Drive from the required 150 -ft. down to 17.6 -ft. and the driveway on SH 114 from 150 -ft. to 34.2 -ft.
