Ca making at all Ievais- • �In the organizatl 1 � O l O Approving the Ordinance to appoint a Judge links to the City's Strategy map relative to the focus area of Performance Management and Service Delivery and specifically to the corporate objective of Collaborate with select business partners to implement service solutions. 3 Background • Council Review: Executive Session W I June 6, 2012 • Current Judge: Carol Montgomery — Appointed July, 2001 City Council discussed the appointment, employment, evaluation and duties of the Municipal Court Judge Carol Montgomery in Executive Session at the June 6, 2012 City Council meeting. Judge Montgomery has served as the City of Southlake's Judge since July, 2001. As a result of that discussion, City Council decided to re- appoint Carol Montgomery as Southlake's Municipal Court Judge and provide her with a 5% pay increase to her annual salary. 12 Charter Requirements Section 5.02: • Council appointed • Licensed attorney in good standing 1 'I • 2 or more years experience in Texas • Two year term Per Section 5.02 of the Southlake City Charter, the City Council shall by ordinance appoint one or more judges of the Municipal Court. This structure requires City Council approve and adopt a new ordinance in order to make any compensation, benefit or other changes to the Judge's agreement. City Council has directed staff to modify the ordinance to appoint the Judge and authorize the Mayor to execute an agreement with the Judge. This would allow the agreement to be taken to City Council for approval as a separate agenda item and allow City Council to adopt any changes to the agreement in the future without requiring a new ordinance. The agreement, approved by City Council, would establish the compensation, benefits and essential functions of the Judge. Ordinance No. 1037, included in the packet, authorizes the appointment of Carol Montgomery to Municipal Court Judge for the City of Southlake through July 7, 2014. It also authorizes the Mayor to execute an agreement to establish the compensation, benefits and essential functions of the Municipal Court Judge. If the Ordinance passes on the first reading, the agreement will be on the August 7, 2012 City Council agenda for approval. 7 Financial Considerations The agreement will be on a future City Council Agenda for consideration. Current Annual Salary: $42,000 + limited benefits $44,100 + limited benefits Proposed Annual Salary: (5% increase) Compensation, benefits and essential functions will be included in the Judge's Agreement. The agreement will be presented to City Council for approval at a future City Council meeting. However, the current agreement provides for an annual salary of $42,000 with limited benefits. Based upon direction from City Council, the agreement presented will include a 5% pay increase which equates to an annual salary of $44,100 with no change in benefits. 0 Staff Recommendation Approve the 1St Reading of Ordinance 1037, Appointing the Judge of the Municipal Court of Record and authorizing the Mayor to execute an agreement with the Municipal Judge. Staff recommends City Council approve the 1St reading of Ordinance No. 1037, Appointing the Judge of the Municipal Court of Record and authorizing the Mayor to execute an agreement with the Municipal Judge.
