Mr. Kennemer stated that the reason for the easement change from 10 -ft. to 5- ft. is for an added water feature. Chairman clarified that with the water feature in place there will still be a 5 -ft. easement. Commissioner Parrish asked the water features will be used recreationally. Mr. Kennemer stated no. The pools will be used for water features only. Commissioner Springer asked where the pool equipment will be stored. Mr. Kennemer stated that it will need to be to one side or the other. PUBLIC HEARING Chairman Hudson clarified that the east facade is not visible. Daniel Cortez stated that they would be screening the north, south and east. Commissioner Forman asked what the enclosure was between the 2 buildings adjacent on the east side. Daniel Cortez stated that it was the mechanical equipment. Commissioner Forman asked if it was masonry. Daniel Cortez stated yes. Jim Dewey Jr. with JDJR Engineers, at 2500 Texas Drive, Suite 100, Irving 75062 came forward. Bonefish is proposing outside dining on the north side. There is an existing multi- tenant sign out there and on the back side of that sign there is a fireplace. Bonefish plans to use that as a feature. We are asking for a variance for a screening wall. At this location there is not a dumpster. The only dumpster is shared across the parking lot. This screening wall will allow Bonefish to store trash until there is a convenient time to run the trash to the dumpster. Bonefish would prefer to build a metal matte black architectural privacy fence but is willing to build it out of masonry. Chairman Hudson stated that 7 -ft. fence is acceptable but the screening needs to be masonry. This is a premier site of Southlake. Commissioner Williamson asked if the door shown in the screening area was the kitchen. Mr. Dewey stated yes. Commissioner Williamson asked if it was possible to move the door more north. The door is very visible from the walkway even with the screening. Planning and Zoning Commission Meeting Minutes —June 7, 2012 Page 5 of 10 Mr. Dewey stated that he would have to talk to Bonefish about that. At this time the layout of the restaurant has already been configured though. However, the kitchen door can be part of the screening. Commissioner Forman agreed with Chairman Hudson regarding the screening wall being masonry to help with site and smell. Commissioner Springer agreed as well. Commissioner Forman clarified the hours of operation. Mr. Dewey stated that they serve lunch and dinner and close at 11p. Commissioner Parrish asked about some screening landscape along the south end. Mr. Dewey suggested putting in a gate instead. Commissioner Springer agreed. Mr. Dewey is agreeable to all suggestions regarding screening the area instead of relocating the kitchen door. Commissioner Fairchild questioned on whether or not the use could be moved inside or to fully enclose the area. Mr. Dewey is unable to agree to that without talking to Bonefish. Chairman Hudson suggested overlapping the screening wall. Commissioner Springer agreed that a gate would be appropriate and to enclose the area. Chairman Hudson opened the public hearing. Jay Behrens of 3100 Merrimac Court, Southlake, 76092 came forward. Mr. Behrens expressed his concerns about the area to be enclosed. Even if it is enclosed it will still have an odor. Any food that hits the ground especially dairy products will be absorbed by the concrete. The area will need to be watered down regularly. However, watering the area on a regular basis will cause the water to run across sidewalks and the parking lot. Bonefish will need a rolling bin for the trash bags in order to keep the trash off the ground and for transportation to the dumpster without spillage and littering. Chairman Hudson closed the public hearing. Chairman Hudson asked if a drain would be plausible. Mr. Dewey came forward and stated that they will have rolling bins for the purpose of keeping the bags contained and for transport. Also, if a drain is needed he will look into Planning and Zoning Commission Meeting Minutes -June 7, 2012 Page 6 of 10 it. Commissioner Williamson stressed his concern regarding a trash holding station between buildings. Commissioner Fairchild agrees. Commissioner Parrish stated that moving the kitchen north would give Bonefish more room. Commissioner Springer stated that the area can be fully enclosed adding square footage to Bonefish. Chairman Hudson stated that they could fully enclose but without a roof cover. Mr. Dewey asked the Commission to approve Bonefish with a "subject to" statement that would allow Bonefish to move forward and comply to the Commissions suggestions. Made a motion to approve ZAl2 -045, Site Plan for Bonefish Grill Restaurant, subject to the walls of the trash enclosure is attached to the main building with gates or doors for access, variance denied; the screening wall will be 8 -ft. in height and masonry, and note of the applicant's willingness to address some of the concerns regarding fully enclosing the trash area and place landscaping along the south side of the trash enclosure and subject to the revised Site Plan Summary #2 dated June 7, 2012. SPIN Neighborhood # 11. Planning and Zoning Commission Meeting Minutes —June 7, 2012 Page 7 of 10 PUBLIC HEARING Commissioner Parrish asked if the applicant has been to SPIN. Richard Schell stated that they are currently scheduled for Monday, June 11 Commissioner Parrish stated that based on the pictures, it looks like they have already started the work. Richard Schell stated that they were issued a Stop Work Order. David Musil, 2701 W Southlake Blvd, Southlake 76092 came forward. Mr. Musil stated that their contractor started the work without a permit. The contractor was under the impression that they would get a permit the same day they applied. Because of that error, the landscaping has been disturbed and the area around the church is open. Commissioner Springer asked Mr. Musil if they were at full capacity in regards to parking. Mr. Musil stated yes. Due to the overflow, parishioners are having to park in the grass. The reason we are placing it on the perimeter of the driveway is because the center island is where Phase 2 will be and that is where the sanctuary will be. It is also cheaper to do it there because of the existing drive. If we were to extend it further south we have to put in a fire lane which would double the cost of the project. Commissioner Fairchild asked Staff why the fire lane was not required. Dennis Killough stated it is not needed and the church is adequately covered by the existing fire lane. Commissioner Forman asked which side they parked on in the back. Mr. Musil stated on both sides next to the building. Commissioner Springer asked how they were doing in regards to occupancy in the building. Mr. Musil stated that they were within the limits. In about 2 years we will start the plans for Phase 2. Commissioner Springer asked about the existing drainage. Mr. Musil stated that in the back, water flow currently crosses over into Watermere's pond. Commissioner Springer asked about connecting Watermere and Lakeside for shared access. Planning and Zoning Commission Meeting Minutes —June 7, 2012 Page 8 of 10 Mr. Musil stated not at this time. Commissioner Parrish asked who the contractor was. Mr. Musil stated Pennington. Commissioner Fairchild recused himself from and left the chambers for the duration of this discussion. Commissioner Parrish asked about adding an island between the proposed new spots and the existing spot. Mr. Musil stated that can be added to the east side. Commissioner Springer asked how many handicap spots are there and are they used frequently. Mr. Musil stated that there are four handicap spaces. Two usually remain vacant. Chairman Hudson opened and closed the public hearing. Commissioner Springer expressed his concern regarding the landscape that will be torn out and would have preferred the parking be set up on the rear portion of the property. Commissioner Parrish expressed his concern that the applicant did not go before SPIN first. Made a motion to approve ZAl2 -049, Site Plan for Lakeside Presbyterian Church, subject to the applicant's willingness to place a landscaped island at the beginning of the new parking spaces versus the old spaces on the west side of the property and subject to Site Plan Review Summary #1 dated June 1, 2012.
