Item 6E Department of Planning & Development Services S T A F F R E P O R T March 28, 2012 CASE NO:ZA12-022 PROJECT:Southlake Crossing Animal Clinic REQUEST: Dr. Mark Cox, owner of Southlake Crossing Animal Clinic, is requesting approval of a specific use permit to allow “kennels” at his current location. Zoning Ordinance 480, as kennel amended, defines as a commercial establishment in which dogs, cats, or domesticated animals are housed, boarded, groomed, bred, trained, or sold all for a fee or compensation. Grooming and boarding have been an ancillary service to clients since the applicant opened his practice in Southlake in 1991. Last year, grooming accounted for about 8% of revenue and boarding accounted for about 4.3%. The purpose of this request is to enable the grooming and boarding portion of the clinic to operate independently within the existing building. Grooming and boarding can function as ancillary uses in a veterinarian clinic but if they are to function as independent primary uses, they must be approved by specific use permit. The applicant also plans to increase visibility by adding signage to the existing monument sign (remaining within sign ordinance parameters). There are no existing or proposed outdoor pens or dog runs. The applicant is not proposing any structural changes to the interior or exterior of the building. ACTION NEEDED:1. ALLEN NO. 18 ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE. WHEREAS , a Specific Use Permit for a kennel has been requested by a person or corporation having a proprietary interest in the property zoned as “C-3” General Commercial District; and, WHEREAS , in accordance with the requirements of Sections 45.1(15) of the City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS , the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. Allen No. 18 Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 4649, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit “A”, and Case No. Attachment F ZA12-022 Page 1 as depicted on the approved Site Exhibit attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
