Price, P.E., Director of Public Works Subject: Ordinance No. 1025, 2nd Reading, Approve an ordinance establishing the Speed Limit on Southlake Boulevard (FM 1709) Action Requested: Ordinance No. 1025, 2 nd Reading, Approve an ordinance establishing the Speed Limit on Southlake Boulevard (FM 1709). Background Information: TxDOT has requested that the City Council approve an ordinance to establish the speed limit on Southlake Boulevard (FM 1709) from the west city limits to the east city limits. Southlake Boulevard is a state highway and TxDOT periodically reviews the speed limits in their network, conducts speed studies and, if appropriate, requests the City to approve a revised ordinance. The proposed speed limit will remain 45 MPH along Southlake Blvd. through the city at this this time under this ordinance. TxDOT proposed that the speed limit in the area between Carroll Avenue and Village Center Drive be reduced to 40 MPH. The median in front of Town Center was increased in width in order to accommodate an enhanced landscaping area. The increase in width required a reduction from the standard 12 foot wide drive lanes to 11 foot wide lanes which resulted in TxDOT requesting a reduction of the speed limit to 40 MPH. Due to ongoing construction of the deceleration lanes at several locations and other upcoming projects which will affect travel within the corridor, City Council has respectfully requested that TxDOT perform another speed study later in the year to determine if a speed reduction between Village Center and Carroll Avenue remains appropriate once all of the construction has been completed. City Council approved the 1 St reading of this ordinance on February 21, 2012. Financial Considerations: None. Citizen Input/ Board Review: None Legal Review: The ordinance has been reviewed by the City Attorney's office. Alternatives: The City Council may approve Ordinance No. 1025 or deny it. Jo 39 g > \ \ ] o201jm¥ N ƒ @ $ < 2» most'\ ° 5 C \ m<o ,— § j \ ORDINANCE 1025 SPEED ZONE ORDINANCE FM 1709 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF THE TRANSPORTAITON CODE, CHAPTER 545, SECTION 545.356, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF SOUTHLAKE, AS SET OUT IN THE ORDINANCE AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $500.00 FOR VIOLATION OF THIS ORDINANCE. WHEREAS, the Texas Transportation Code, Chapter 545 Paragraph 545.356, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1 Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of the Texas Transportation Code, Chapter 545, Paragraph 545.356, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: Control- Section: 1603 -03 Highway.
