The requested action for this item is to adopt Ordinance one thousand twenty four,
1 st Reading, to abandon an unused water line easement in the T.M. Hood Survey,
Abstract seven hundred and six.

The request of the developer placedinto action the need for the City Council to
enact an ordinance. Chapter3, Section 3.11 subsection (a)(7) of the Southlake
Charter states that the council shall legislate by ordinance. In addition to other acts
required by law or by specific provision of this Charter to be done by ordinance,
those acts of the Council shall be by ordinance which: Convey,lease or authorize
the conveyance or lease of any lands of the City;

The easement to be abandoned consists of 36.3 Acres within the Shady Oaks
Phase 1A subdivision and two tracts of land to the west owned by Terra/Shady
Oaks LP. The easement is recorded in the Tarrant County Records Volume 4217
(fourthousand two hundred and seventeen), Page 173 (one hundred seventy
three). The documents were recorded on May 26, 1966 under Instrument No.
39931 granting the City of Southlake a 36.3 acres of water line easement with no
defined location of a water line. The record states that upon the construction of
such water line, the owner would then assign a 10 ft. wide strip of land centered
about the pipe line granting the City of Southlake an easement and rightof way
along the alignment. This water pipe line was never built and the City has no
purpose for this easement. This easement is within the platted subdivision of Shady
Oaks Phase 1A.
Updating the public records regarding this easement will simplify future negotiations
of property sales by both the land owners and the City of Southlake.

The Shady Oaks Phase 1A subdivision is located south of the T intersection of
Shady Oaks Drive and W Highland Street.

The recommendation for this item is to approve Ordinance1024, 1 st Reading, to
abandon an unused water line easement in the T.M. Hood Survey, Abstract 706.
