Price, P.E., Director of Public Works Subject: Approve Amendment No. 1 to the TxDOT Advance Funding Agreement for a Transportation Enhancement Project for FM1709 sidewalks Action Requested: Approve Amendment No. 1 to the TxDOT Advance Funding Agreement for a Transportation Enhancement Project for FM1709 sidewalks Background Information: The City Council approved a resolution for the TxDOT Local Project Advance Funding Agreement (LPAFA) for the FM1709 Sidewalks on January 4, 2011. This amendment will expand the scope of allowable enhancements along Southlake Boulevard to include landscaping, irrigation, ramps and other future amenities. The amendment also revises the limits to Pearson Lane on the west city limit line to SH114 along the east city limit line. No additional payment is required from the city to TxDOT for this amendment to the agreement. Financial Considerations: There is no additional payment required to TxDOT to amend the agreement. Strategic Link: The FM1709 Sidewalk project links to the City's strategy map relative to the focus areas of Mobility, Infrastructure, and Quality Development. The specific corporate objectives that are met by this construction project include: providing travel convenience throughout the city and region, collaborating with select partners to implement service solutions, and investing to provide and maintain high quality public assets. Citizen Input/ Board Review: N/A Legal Review: This is a standard TxDOT agreement. This agreement has been reviewed by the City Attorney. Alternatives: The City Council may approve or deny the agreement. WITNESSETH WHEREAS, the State and the Local Government executed a contract on February 14, of 2011 to effectuate their agreement to construct missing sidewalk segments along Southlake's ma'or east - west thoroughfare to provide a continuous walkable corridor, FM 1709 (Southlake Boulevard) for a distance of 6.1 miles within the City limits. Improvements included landscaping with irrigation, fencin curb and gutters, rams and street furniture; and, WHEREAS, it has become necessary to amend that contract; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties, the State and the Local Government do agree as follows: AGREEMENT 1. Description of Amended Items Attachment B of the original contract is deleted in its entirety and replaced with Attachment B -1, which is attached to this amendment. Article 4, Scope of Work and Use of Project, of the original contract is deleted in its entirety and replaced with the following: 4. Scope of Work and Use of Project The scope of work for the Project, which is as shown in Attachment B -1 of the Project Location Map, described in the nomination form and as approved by the Texas Transportation Commission, consists of: the construction of missing sidewalk segments along FM 1709 (Southlake Boulevard) from Pearson Lane to SH 114 to provide a continuous walkable corridor. The sidewalk improvements will include landscaping with irrigation, fencing, curb and gutters, ramps, and street furniture creating a safer and more pedestrian friendly environment. Changes may also require an amendment to the contract and the approval of FHWA, the Administration, or the TTC. Any changes undertaken without written approval and contract amendment may jeopardize not only the federal funding for the changes, but the federal funding of the entire project. All other provisions of the original contract are unchanged and remain in full force and effect. 2. Signatory Warranty Each signatory warrants that the signatory has necessary authority to execute this agreement on behalf of the entity represented. THIS AGREEMENT IS EXECUTED by the State and the Local Government in duplicate.
