MEMBERS ABSENT: Art Sorenson, Vice Chairperson; William (Bill) Kemp, Alternate #1 STAFF PRESENT: Stefanie Sarakatis, Zoning Assistant; Jean Bryson, Secretary, Charles Bloomberg, Plans Examiner. Agenda Item #2 Approval of the Minutes. With no objections the minutes of April 10, 1997 were deemed approved by the Chair as presented. Agenda Item #3 Administrative Comments. Ms.Stefanie Sarakatis. Zoning Assistant, reported one (1) case to consider on May 15 before the special meeting with the City Attorney. Agenda Item #4 ZBA Case #270 Variance ZBA Case #270 a request for a variance to Ordinance No. 480, § 34.2(e), maximum height requirement of fourteen (14) feet for accessory structures. The applicant is requesting an addition to an existing barn not to exceed nineteen (19) feet. The location is 1111 S. Stefanie Sarakatis, Zoning Assistant, reported that nineteen (19) notices were sent to property owners within 200 feet and there were three (3) response in favor and none opposed to the request Public Hearing. Mr. Gary Hargett was present and said he needed the existing barn extended for a covered area for the new foals and that the request is the same height request that was made in 1994. The findings were stated by Mr. Joyce. Pursuant to the finds set forth in this case, a motion was made to Grant ZBA Case # 270 a variance to Ordinance No. 480, § 34.2 as requested. Motion: Troy Second: Smart Ayes: Smart, Troy Cienki, Joyce Nays: none Vote: 4 - 0 to grant as requested Agenda Item #5 ZBA Case # 271 Variance ZBA Case #271 a request for a variance to Ordinance No. 480, § 26.5(a), maximum height requirement of two and one-half (2 '/a) stories or thirty-five (35) feet. The applicant is requesting a height of three (3) stories or thirty-five (35) feet. The location is 2860 Market Loop, being Lot 5, Block B, Commerce Business Park, being approximately 2.061 acres situated in the Thomas Easter Survey, Abstract No. 474. The current zoning is 1-1" Light Industrial District. The owner is Randy L. Pack and the applicant is BBJ&E limited. Mr. James Eklund, representing the Eklund's, Inc. (elevator enclosure and components manufacturing) said the need for the variance is for 900 Sq. Ft. 3rd floor for an elevator to land. Mr. Eklund said the 3rd floor is for a meeting room, display area and a rest room and the height not to exceed thirty-five (35) feet. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. Zoning Board of Adjustment Meeting Page 3 April 24, 1997 Agenda Item #5 continued. The findings were stated by Mr. Joyce. Pursuant to the findings set forth in this case, a motion to grant a Variance to ZBA Case # 271 a variance to Ordinance No. 480, § 26.5 (a) as requested.
