AGENDA: 1. Call to Order. 2. Approval of Minutes of the April 30, 1998 Regular Board of Adjustment Meeting. 3. Administrative Comments. 4. Consider: Case ZBA-289 (tabled from April 30, 1998), Special Exception Use permit per Ordinance No. 480, Section 44.12 (7) for two (2) portable buildings to be used as temporary facilities for children attending the school. Also to be considered are requests for waivers of permanent foundation, eighty percent (80%) masonry, and additional hard surfaced parking requirements. Location: Carroll Middle School, 1101 E. Dove Street, being legally described as Tract 2 and 2C of the J. Chivers Survey, Abstract No. 348, and being approximately 29.02 acres. Current zoning is "CS" Community Service District Owners/Applicants: Carroll Independent School District. Public Hearing. 5. Consider: Case ZBA-291, Variance to Ordinance No. 480 Section 34.2(e) for the construction of an accessory building greater than one story or fourteen (14) feet in height. The applicant is requesting a height not to exceed nineteen (19) feet. As part of the Variance, the applicant is also requesting to build the accessory building of a size greater than the 600 square feet permitted in the "SF-20A" Single Family Residential District, to allow for an accessory building not to exceed 1152 square feet. Location: 1902 Amesbury Court, being legally described as Lot 36, Block 1, Country Walk Addition, and being approximately 0.480 acres situated in the S. H. Thompson Survey, Abstract No. 1504. MEMBERS ABSENT: Ron Troy STAFF PRESENT: Tim Woloshyn, Zoning Assistant; Jean Bryson, Secretary, Skip Vandergrifft, City Plans Examiner. Agenda Item #2 Approval of the Minutes. With no objections the minutes of April 30, 1998 meeting were deemed approved by the Chair as presented. Agenda Item #3 Administrative Comments. Mr.Tim Woloshyn, Zoning Assistant, reported the next meeting would be June 11, 1998. Agenda Item #4 ZBA Case #289 Special Exception ZBA Case # 289 a request for a Special Exception Use Permit per Ordinance No. 480, Section 44.12 (7) for two (2) portable buildings to be used as temporary facilities for children attending the school. Tim Woloshyn, Zoning Assistant, reported that twenty-six (26) notices were sent to property owners within 200 feet and there were seven (7) response six (6) in favor and one (1) opposed to the request Public Hearing. Brent Cline, Project Management, Carroll Independent School District was present and said that four temporary class rooms were needed for six to eight months. Mr. Cline also said additional parking would not be needed. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The location of the proposed activities and improvements are clearly defined on the concept plan or plot plan submitted with the application, and that the special exception is wholly compatible with the use and permitted development of adjacent properties either as filed or subject to such limitations and requirements as the Board deems to be necessary to protect adjacent property. Pursuant to the findings set forth in this case, a motion was made to Grant a Special Exception ZBA Case # 289 as presented with the portable building to be moved by January 31, 1999. Motion: Sorenson Second: Cienki Ayes: Kemp, Smart, Cienki, Sorenson, Joyce Nays: None Vote: 5 - 0 to grant Agenda Item #5 ZBA Case #291 Variance ZBA Case # 291 a request for a Variance to Ordinance No. 480 Section 34.2(e) for the construction of an accessory building greater than one story or fourteen (14) feet in height. David Barksdale, owner/applicant was present and said his intent was to build a detached garage in the rear yard of his single-family house. The City issued a building permit to begin construction. At this point materials were purchased and preparation for the foundation commenced. Soon after, a neighbor made an inquiry to Code Enforcement about the location of the garage. The garage's location meets the ordinance requirements. Upon further scrunity the height and square footage violation to the ordinance were discovered and construction was halted. Skip Vandergrifft, City Plans Examiner, was present and verified the issuing of the permit. Searching the records Mr.Vandergrifft said he found the height and square footage violation and called Mr. Barksdale with his findings. Mr.Vandergrifft suggested Mr.Barksdale see Karen Gandy to request a Variance. There was no other person wishing to speak either in favor or in opposition of the request. Public Hearing Closed. The findings were stated by Mr. Sorenson. The requirements of Section 34.2(e) have been met by the applicant, that the reason set forth in the application justify the granting of the variance. The variance is the minimum variance that will make possible the reasonable us of the land, building or structure and that the granting of the variance will be in harmony with the general purpose and intent of the zoning ordinance and will not be injurious to the neighborhood or otherwise detrimental the public welfare. Pursuant to the findings set forth in this case, a motion was made to Grant ZBA Case # 291 a variance to Ordinance No. 480 Section 34.2(e) as requested. Motion: Sorenson Second: Smart Ayes: Kemp, Smart, Cienki, Sorenson, Joyce Nays: None Vote: 5-0 to grant Zoning Board of Adjustment Meeting Page 4 May 14, 1998 Agenda Item #6 Meeting Adjourned.
