2001-09-27 ZBA meeting REGULAR BOARD OF ADJUSTMENT MEETING September 27, 2001 LOCATION: 1400 Main Street, Southlake, Texas City Council Chambers of Town Hall EXECUTIVE SESSION: If a need arises to seek the advice from the City Attorney as to the posted subject matter of this Board of Adjustment meeting, the issues or matters will be discussed in executive session. 1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive session to consult with the City Attorney regarding matters authorized by Section 551.071, including items posted on this agenda. 2. MEMBERS ABSENT: John Reynal, Susan Johnson, Alternate #1, & F.C. Levrier, Alternate #2 STAFF PRESENT: Ben Bryner, Planner; Mardenna Gullinese, Secretary. Agenda Item #1 Call to Order: The Zoning Board of Appeals meeting for September 27, 2001 was called to order at 6:30 p.m. by Chairman Mike Sandlin. Agenda Item #2 Approval of the Minutes: The minutes of the August 16, 2001 meeting were deemed approved by the Chair as presented. Motion: Miltenberger Second: Smart Ayes: Miltenberger, Smart, & Troy Nays: 0 Abstain: Sandlin Vote: 3-0-1 to approve Agenda Item #3 Administrative Comments. There were no Administrative Comments. Agenda Item #4 ZBA Case #377 Special Exception Use Case ZBA-377, Special Exception Use permit per Ordinance No. 480, Section 44.12 (1) for a family/servants quarters. Location: 909 Suffolk Court, being legally described as Lot 5R, Block 3, Coventry Manor Phase II, being approximately 1.74 acres. Current Zoning: "R-PUD" Residential Planned Unit Development District. Owner/Applicant: Lynn M. Dixon. Public Hearing Mr. Ben Bryner, Planner, reported that fourteen (14) notices were sent to property owners within 200 feet, and there was two (2) responses (one (1) in favor, & one (1) opposed) Homeowner Lynn M. Dixon was present requesting a Special Exemption Use permit. There was no other person wishing to speak in favor of, or in opposition to, the request. Public Hearing Closed. Zoning Board of Adjustment Meeting page 2 September 27, 2001 The findings were stated by Mike Sandlin. A motion subject to the findings was made to approve ZBA Case #377 as presented. Motion: Troy Second: Miltenberger Ayes: Smart, Miltenberger, Troy, & Sandlin Vote: 4 - 0 to approve Agenda item # 5 Meeting Adiourned. A motion was made to adjourn the meeting.
