EXECUTIVE SESSION:
If a need arises to seek the advice from the City Attorney as to the posted subject matter of this Board of
Adjustment meeting, the issues or matters will be discussed in executive session.
1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive
session to consult with the City Attorney regarding matters authorized by Section 551.071,
including items posted on this agenda.
2. Reconvene: Action necessary on items discussed in executive session.

2. Approval of Minutes of the June 28, 2001 Regular Board of Adjustment Meeting.
3. Administrative Comments.
4. Consider: Case ZBA-376, Variance to Ordinance No. 480, Section 34.2(a) requiring all
accessory buildings having a permanent foundation to be erected no closer than
ten (10) feet to a property line located in the rear yard. The applicant is
requesting to allow a proposed detached garage approximately eight and one half
(8 ''/z) feet from the property line.
Special Exception Use Permit per Ordinance No. 480, Section 44.12 (3) for
construction of accessory buildings or structures of a size or aggregate size
greater than that permitted under the accessory building requirements of the
zoning district in which the property lies. The applicant is requesting to allow
construction of a detached garage of approximately one thousand four hundred
(1,400) square feet.

Agenda Item #1 Call to Order: The Zoning Board of Appeals meeting for August 16,
2001 was called to order at 7:00 p.m. by Vice-Chairman Lewis Miltenberger.
Agenda Item #2 Approval of the Minutes:
The minutes of the July 12`" meeting were deemed approved by the Chair as presented.

Nays: 0
Abstain: Johnson

Agenda Item #3 Administrative Comments.
There were no Administrative Comments
Agenda Item #4 ZBA Case #376 Variance & Special Exception Use
Case ZBA-376, Variance to Ordinance No. 480, Section 34.2(a) requiring all accessory buildings

Public Hearing
Mr. Ben Bryner, Planner, reported that nine (9) notices were sent to property owners within 200
feet, and there was three (3) responses (three (3) in favor, zero (0) opposed)
Homeowner James Nimphius was present requesting a Special Exception Use Permit, and a
Variance Permit.

Two neighbors, Howard Sanders of 1000 Lakewood Dr. & Morris Stewart of 775 Wildwood Ln.,
both spoke in favor of the request.
There was no other person wishing to speak in favor, of or in opposition to, the request.
Public Hearing Closed.
The findings were stated by Lewis Miltenberger.
A motion subject to the findings was made to approve ZBA Case #376 as presented.

Ayes: Johnson, Smart, LeVrier, Reynal , and Miltenberger
Vote: 5 - 0 to approve
