REGULAR BOARD OF ADJUSTMENT MEETING February 14, 2002

EXECUTIVE SESSION:
If a need arises to seek the advice from the City Attorney as to the posted subject matter of
this Board of Adjustment meeting, the issues or matters will be discussed in executive
session.
1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in
executive session to consult with the City Attorney regarding matters authorized
by Section 551.071, including items posted on this agenda.
2. Reconvene: Action necessary on items discussed in executive session.

2. Approval of Minutes of the January 10, 2002 Regular Board of Adjustment
Meeting.
3. Administrative Comments.
4. Consider: Case ZBA-383, Variance to Ordinance No. 480-179, Section VIII
requiring specific distances for minimum setbacks. The applicant is
requesting a variance to allow construction of a residential home to
encroach up to a maximum ten (10) percent of the required setbacks.

5. Consider: Case ZBA-385, Special Exception Use permit per Ordinance No. 480,
Section 44.12 (3) permitting the construction of accessory buildings or
structures of a size or aggregate size greater than that permitted under
the accessory building requirements of the zoning district in which the
property lies. The applicant is requesting to have accessory buildings
with a total area of approximately one thousand two hundred eighty
(1,280) square feet.

Agenda Item #1 Call to Order: The Zoning Board of Appeals meeting for February 14,
2002 was called to order at 6:34 p.m. by Chairman Mike Sandlin.
Agenda Item #2 Approval of the Minutes:
The minutes of the January 10, 2002 meeting were deemed approved by the Chair as presented.

Ayes: Reynal, Miltenberger, Smart, & Sandlin
Nays: 0
Abstain: 0
Vote: 4-0-0 to approve
Agenda Item #3 Administrative Comments
Ben Bryner, Planner, stated that the next scheduled meeting of the Zoning Board of Adjustments
would be February 28, 2002.
Agenda Item #4 ZBA Case #383 Variance
Case ZBA-383, Variance to Ordinance No. 480-179, Section VIII requiring specific
distances for minimum setbacks. The applicant is requesting a variance to allow
construction of a residential home to encroach up to a maximum ten (10) percent of the
required setbacks. The address of the proposed new construction is 417 Marshall Rd.,
being legally described as Lot 21, Block 2, Kirkwood Hollow, and being approximately
0.51 acres.
This case has been withdrawn by the Applicant.
Agenda Item # 5 ZBA Case #385 Special Exception Use
Case ZBA-385, Special Exception Use permit per Ordinance No. 480, Section 44.12 (3)
permitting the construction of accessory buildings or structures of a size or aggregate size
greater than that permitted under the accessory building requirements of the zoning
district in which the property lies. The applicant is requesting to have accessory
buildings with a total area of approximately one thousand two hundred eighty (1,280)
square feet.

Location is 2079 N. Carroll Avenue, being legally described as Lot 8, Francis Throop No.
1511 Addition, and being approximately 1.12 acres. Owner/Applicants are Larry &
Linda Haynes.
Ben Bryner, planner reported that seven (7) notices were sent out, with zero (0) responses
in favor of the request.
Public Hearing
Larry Haynes, homeowner, was present to request a variance.
There was no other person wishing to speak in favor of, or opposition to, the request.
Public Hearing Closed
The findings were stated by Mike Sandlin.
A motion subject to the findings was made to approve ZBA Case 9385 as presented.

Nays: none
Vote: 5-0-0 to approve.
