2. Approval of Minutes of the December 11, 2003 Regular Board of Adjustment meeting.
3. Administrative Comments.
4. Consider: Case ZBA-425, Variance to Ordinance No. 480, Section 9.5(f) requiring a minimum
lot area of four hundred thirty-five thousand six hundred (435,600) square feet for
property with "AG" Agricultural District zoning. The applicant is requesting to
have a minimum lot area of four hundred twenty-five thousand nine hundred thirty
(425,930) square feet after right-of-way dedication.

Agenda Item #1 Call to Order: Chairman Miltenberger called the meeting to order at
6:23 p.m.
Agenda Item #2 Approval of the Minutes:
The minutes of the December 11, 2003 Regular Zoning Board of Adjustment meeting
were deemed approved by Chairman Miltenberger as presented.
Motion: Stacey
Second: Faglie
Ayes: Morin, Stacey, Smart, Faglie, Lambert
Nays: None
Abstain: Reynal, Miltenberger
Vote: 5-0-2 to Approve
Agenda Item #3 Administrative Comments:
Ben Bryner announced the next meeting for the Zoning Board of Adjustment was
scheduled for March 25, 2004.
Chairman Miltenberger read the meeting format outline.
Agenda Item #4 ZBA Case # 425, Variance to Ordinance No. 480, Section 9.5(f):
Variance to Ordinance No. 480, Section 9.5(f) requiring a minimum lot area of four
hundred thirty-five thousand six hundred (435,600) square feet for property with "AG"
Agricultural District zoning. The applicant is requesting to have a minimum lot area of
four hundred twenty-five thousand nine hundred thirty (425,930) square feet after right-
of-way dedication.
The location is at 500 W. Bob Jones Rd, being legally described as Tracts 5 and 6,
situated in the R.D. Price Survey, Abstract No. 992, and being approximately 10.007
acres.
Ben Bryner, planner, reported that Seven (7) notices were sent to property owners within
200 feet and one (1) response was received in favor.
Stuart Burge, Owner, opened for questions from the Board.
Chairman Miltenberger opened the public hearing at 6:33:14 p.m.
No one from the audience came forward to speak.
Chairman Miltenberger closed the public hearing at 6:33:28 p.m.
Rick Stacey stated he would like to see these types of applications kept at a staff level
and said he intended to send a request to City Council to approve that authority.
A motion was made to approve the Variance to Ordinance No. 480, Section 9.5 (f) for
ZBA Case #425 to allow a minimum lot area of four hundred twenty-five thousand nine
hundred thirty (425,930) square feet after right-of-way dedication in an "AG"
Agricultural Zoning District.
Motion: Stacey
Second: Smart
Ayes: Stacey, Reynal, Smart, Faglie, Miltenberger
Nays: None
Vote: 5-0 to Approve
