EXECUTIVE SESSION: If a need arises to seek the advice from the City Attorney as to the
posted subject matter of this Board of Adjustment meeting, the issues or matters will be discussed in
executive session.
1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive session
to consult with the City Attorney regarding matters authorized by Section 551.071, including
matters posted on this agenda.
2. Reconvene: Action necessary on items discussed in executive session.

2. Approval of Minutes of the July 27, 2006 Regular Board of Adjustment Meeting.
3. Administrative Comments.
4. Senate Bill 286 - Open Government Training.
5. Consider: Case ZBA-489, Variance to Ordinance No. 480, Section 34.1 (f) requiring a
private swimming pool to not be closer than five (5) feet to another structure.
The applicant is requesting to have a swimming pool that will be
approximately zero (0) feet from a proposed arbor structure. Location: 612
Honeysuckle Hollow, being legally described as Lot 16, Southlake Woods
Phase III, and being approximately 0.46 acres. Current Zoning: "SF-20A"
Single Family Residential District. Applicant: Ryan Mikolasik.

MEMBERS ABSENT: Danny Mayer.
STAFF PRESENT: Ben Bryner, Senior Planner; and Dianna Brawner, ZBA Secretary.
Agenda Item # 1 Call to Order: Chairman Miltenberger called the meeting to order at
6:30:52 p.m.
Agenda Item # 2 Approval of the Minutes:
The minutes of the July 27, 2006 Regular Zoning Board of Adjustment meeting were
deemed approved at 6:31:53 p.m. by Chairman Miltenberger as presented.

Ayes: Bramley, Jain, Smart, Miltenberger, Standerfer, Waldman, Cornish, McSweeney
Nays: None
Abstain: None
Vote: 8-0 to Approve
Agenda Item # 3 Administrative Comments:
Mr. Bryner, Senior Planner, announced the next meeting will be on September 14, 2006.
Ms Brawner, ZBA Secretary, administered the Oath of Office to the newly appointed Board
members.
Agenda Item # 4 Senate Bill 286-Open Government Training:
Mr. Bryner distributed materials to all Board members present at the meeting.
Agenda Item #5 ZBA Case 9489, Variance to swimming pool setback.
Case ZBA-489, Variance to Ordinance No. 480, Section 34.1 (f) requiring a private
swimming pool to not be closer than five (5) feet to another structure. The applicant is
requesting to have a swimming pool that will be approximately zero (0) feet from a
proposed arbor structure.
The property is located at 612 Honeysuckle Hollow, being legally described as Lot 16,
Southlake Woods Phase III, Emerald Estates, and being approximately .46 acres.

Mr. Bryner reported that thirteen (13) notices were sent within 200 feet and six (6)
responses within the Southlake Woods subdivision, Fred L. Williams, 950 Deer Hollow
Blvd., Southlake, Texas in favor, and Ramachandran Sivasankar, 1917 White Oak Clearing,
Southlake, Texas opposed, Victor Vescovo, 1801 Native Dancer Place, Southlake, Texas in
favor, Howard Harris, 1735 Weeping Willow Way, Southlake, Texas in favor, Theresa
Barnes, 1900 Shooting Star Lane, Southlake, Texas in favor, Steve & Melissa Fields, 801
Longhorn Hollow, Southlake, Texas in favor.
The applicants Ryan Mikolasik, 612 Honeysuckle Hollow, Southlake, Texas presented
items to the Board and answered questions.
Chairman Miltenberger opened and closed the public hearing at 7:10:45 p.m.
Greg Standerfer made a motion to approve ZBA case # 489 Variance to the swimming pool
set backs as submitted with the following stipulations: 1) allowing an arbor structure as an
open aired structure without a solid roof except for the restroom and the storage room 2) no
full height walls with the exceptions of the area surrounding the bath and the South side of
the arbor structure.

Vote: 5-0-0 to Approve
