Call to Order. 2. Approval of Minutes of the January 26, 2006 Regular Board of Adjustment Meeting. 3. Administrative Comments. 4. Consider: Case ZBA-478, Variance to Ordinance No. 480, Section 33.14, requiring a minimum lot size of one acre for the use of an on-premise septic tank and subsurface drainage field. The applicant is requesting to have a private septic system on a tract of land that will be less than one acre in size. Location: 1223 Woodsey Court, being legally described as Tract 1B4L3, situated in the H. Decker Survey, Abstract No. 438, and being approximately 0.46 acres. Mr. Bryner reported that (10) ten notices were sent (2) two responses in favor were received. The applicant Mr. Jerry Gilliland and Mrs. Patricia Gilliland, 680 E. Dove Street, Southlake, Texas, presented the item to the Board and answered questions. Vice-Chairman Lambert opened and closed the public hearing at 6:48:54 p.m. Greg Standerfer made a motion that case no. ZBA-480 be approved with specific instructions as follows: if the accessory structure is visible from the street, additional screening is to be planted by the applicant to grow and screen the structure in accordance with direction from the Chief Building Official during permitting process. Vice-Chairman Lambert opened the public hearing at 7:02:15 p.m. Mr. Victor Esquela, spoke in opposition at 7:04:08 p.m. Vice-Chairman Lambert closed the public hearing at 7:12:14 p.m. Vice-Chairman Lambert reopened the public hearing at 7:22:56 p.m. The applicant's representative, Brad Martin responded to the fence issue. Vice-Chairman Lambert closed the public hearing at 7:23:55 p.m. Greg Standerfer made a motion that case no. ZBA-481 to be approved as submitted. ZBA-481 to be approved with a (30) thirty foot setback.
