2007-02-15 ZBA meeting REGULAR BOARD OF ADJUSTMENT MEETING February 15, 2007 LOCATION: 1400 Main Street, Southlake, Texas City Council Chambers of Town Hall EXECUTIVE SESSION: If a need arises to seek the advice from the City Attorney as to the posted subject matter of this Board of Adjustment meeting, the issues or matters will be discussed in executive session. 1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive session to consult with the City Attorney regarding matters authorized by Section 551.071, including matters posted on this agenda. 2. Administrative Comments. 4. Consider: Case ZBA-508, Variance to Ordinance No. 480, Section 34.1 (f), requiring a private swimming pool to not be closer than five (5) feet to another structure. The applicant is requesting to have a swimming pool that will be approximately zero (0) feet from another structure. Locartion: 2118 Miracle Pointe Drive, being legally described as Lot 5, Block 2, Miracle Pointe, and being approximately 0.73 acres. Current zoning: "SF-20A" Single Family Residential District. MEMBERS ABSENT: Chairman Lewis Miltenberger; STAFF PRESENT: Ben Bryner, Planner II; Dianna Brawner, ZBA Secretary. Agenda Item # 1 Call to Order: Vice-Chairman Standerfer called the meeting to order at 6:30:07 p.m. Agenda Item # 2 Approval of the Minutes: The minutes of the January 11, 2007 Regular Zoning Board of Adjustment meeting were deemed approved at 6:30:45 p.m. by Vice-Chairman Standerfer as presented. Motion: Waldman Second: Jain Ayes: McSweeney, Cornish, Waldman, Standerfer, Smart, Jain, Bramley Nays: None Abstain: None Vote: 7-0-0 to Approve Agenda Item # 3 Administrative Comments: Mr. Bryner, Planner II, announced the next meeting will be on March 15, 2007. Agenda Item #4 ZBA Case #508, Variance to swimming pool setback. Case ZBA #508, Variance to Ordinance No. 480, Section 34.1 (f), requiring a private swimming pool to not be closer than five (5) feet to another structure. The applicant is requesting to have a swimming pool that will be approximately zero (0) feet from another structure. The property is located at 2118 Miracle Pointe Drive, being legally described as Lot 5, Block 2, Miracle Point, and being approximately 0.73 acres. Mr. Bryner reported that twenty (20) notices were sent within 200 feet and within the subdivision with zero (0) responses received. The applicant J.F. Denis, 2741 Spring Hill Drive, Grapevine, Texas once sworn in, presented items to the Board and answered questions. Vice-Chairman Standerfer opened and closed the public hearing at 6:42:21 p.m. Michael Waldman made a motion to approve ZBA case # 508 as presented. Motion: Waldman Second: Smart Ayes: Cornish, Waldman, Standerfer, Smart Nays: Jain Abstain: None Vote: 4-1-0 to Approve Agenda Item #5 Meeting to Adjourn A motion was made to adjourn the meeting.
