EXECUTIVE SESSION: If a need arises to seek the advice from the City Attorney as to the posted
subject matter of this Board of Adjustment meeting, the issues or matters will be discussed in executive
session.
1. Pursuant to Section 551.071, Texas Government Code, the Board may meet in executive session to
consult with the City Attorney regarding matters authorized by Section 551.071, including matters
posted on this agenda.

2. Approval of the minutes of the December 10, 2009 regular Board of Adjustment meeting.

4. Consider: ZBA-586, Special Exception Use Permit per Ordinance No. 480, Section 44.12 (1) for a
family quarters and a Variance to Ordinance No. 480, Section 11.5 (c), requiring a side
yard setback of twenty (20) feet. The applicant is proposing to construct a family
quarters with approximately 1,625 square feet of gross livable floor space in an
addition to the principal structure and requesting a side yard setback of approximately
eleven (11) feet. The property is located at 615 Brewer Road, being described as Lot 3,
Block 1, Brewer Addition, an addition to the City of Southlake, Tarrant County, Texas
and being approximately 1.43 acres. The current zoning is "SF1-B" Single Family
Residential District. Applicants: R and B Contracting. SPIN Neighborhood # 11.

34 Agenda Item No. 3 - Administrative Comments: Richard Schell, Planner II, announced that
35 the next Zoning Board of Adjustment meeting is scheduled for January 28, 2010.

37 Agenda Item No. 4 - ZBA-586, Special Exception Use for a family quarters and Variance to
38 side yard setback. Special Exception Use Permit per Ordinance No. 480, Section 44.12 (1) for
39 a family quarters and a Variance to Ordinance No. 480, Section 11.5 (c) requiring a side yard
40 setback of twenty (20) feet. The applicant is proposing to construct a family quarters with
41 approximately 1,625 square feet of gross livable floor space in an addition to the principal
42 structure and requesting a side yard setback of eleven (11) feet. The total floor space of the
43 addition including the garage will be approximately 2,181 square feet.

45 The property is located at 615 Brewer Road, being described as Lot 3, Block 1, Brewer Addition,
46 an addition to the City of Southlake, Tarrant County, Texas and being approximately 1.43 acres.

5o Richard Schell, Planner II reported fourteen (14) notices went out within two hundred (200) feet
51 with no responses.

53 The applicant, Russell Roberts with R and B Construction, 5604 Hawkshaw, Fort Worth, Texas,
54 once sworn in presented items and answered questions for the Board.

56 Chairman Parrish acknowledged the homeowner wanted to speak regarding the difference of
57 the setback from ten feet to the eleven feet which was approved on June 25, 2009 the ZBA
58 meeting, Case # 576.

60 Jason Zimmerman once sworn in stated the previous design was completely changed from a
61 separate accessory building and living quarters to an attached addition for the living quarters
62 and garage. The new design only needs an eleven foot setback instead of the previous ten foot
63 setback.

65 Chairman Parrish opened the public hearing for ZBA Case # 586 and seeing no response
66 closed the public hearing at 7:01 p.m and opened discussion for the Board.

68 Motion was made to approve the ZBA Case # 586 including the Special Exception Use for the
69 family quarters and the Variance to the side yard setback, with the stipulation that the attic
70 remains unfinished until someone (Homeowner/Applicant) decides to come back to the Board.
