Chairman Faglie asked the applicant if the solar arrays would be visible from the neighbors or the street. Mr. Willix stated no and there are no neighbors to the rear of the property either. Commissioner Hudson asked what would be running off the system. Mr. Willix stated that most items when applicable would be running off the system. Commissioner Hudson asked about the noise issues coming from the pool. Mr. Littles stated that the noise is coming from the pool equipment and is currently being worked on. Also, Mr. Littles continued to say that he has an open communication with his neighbors regarding the problem. Chairman Faglie opened the public hearing. No one came forward and the public hearing was closed. PUBLIC HEARING Skip Blake, Blake Architect, 1202 S White Chapel Blvd, Southlake, Texas. Mr. Blake reminded the board the reason for tabling these items previously was due to obtaining approval from TXDOT. The applicant received approval from TXDOT. The proposed use is the best fit for this property. Commissioner Hudson asked about the 30 -ft. setback shown on the site plan. Mr. Blake stated that the 30 -ft. setback reflects the corner portion of the lot facing Southlake Boulevard. Commissioner Parrish asked if the buildings would be built all at once. Mr. Blake stated that the buildings would be built based on tenant use. Commissioner Williamson verified that there would be an 8 -ft masonry fence between the offices and the neighborhood. Mr. Blake stated it would be a stone masonry fence. Commissioner Parrish asked Dennis Killough if the 30 -ft. setback variance could be specific to that one corner. Dennis Killough stated that it could be made part of the motion. Chairman Faglie opened the public hearing and read aloud the Public Comment Forms that were filled out. The following people do not wish to speak but are opposed to CP11 -001 and ZA11 -037: Julie Stubb, 158 Jellico Cir.; Roxanne & Byan Morgan, 140 Jellico Cir.; Linda Yates, 135 Jellico Cir.; Pat Nash, 134 Jellico Cir.; EJ Nash, 134 Jellico Cir.; Jull Howard, 171 Jellico Cir.; Gerald & Deborah Douglass, 156 Jellico Cir.; Sandy Devin, 166 Jellico Cir.; Jim Devin, 166 Jellico Cir.; Monique Schill, 162 Jellico Cir.; and Rob Schill, 162 Jellico Cir. The following residence came forward to speak and are opposed to CP11 -001 and ZA11- 037: Sharon Nash, 115 Vermilion Ct.; Marc Summey, 146 Jellico Cir.; Reed Yates, 135 Jellico Cir.; Phyllis Cardenas, 103 Vermilion Ct.; Joe Cardenas, 103 Vermilion Ct.; and Jarod Jenson, 107 Vermilion Ct. All comments reflected the increased traffic within the neighborhood and possible increase of theft and mischief. Also, the 2020, 2025 and 2030 Plan was mentioned regarding the current zoning and the future zoning plan not changing. Each plan designates this property as residential. Mr. Nash questioned who owns the property. It was stated that the Church owns the property. Mr. Nash continued to ask about what happens if the zoning change is granted and the property sells, what happens to the zoning? Chairman Faglie explained to Mr. Nash that the zoning would remain changed. Planning and Zoning Commission Meeting Minutes - November 03, 2011 Page 3 of 8 Mr. Devin stated that there is no construction plans only proposed site plans. The construction plans can change as long as they meet the minimum requirements of the zoning and allowable uses. Chairman Faglie closed the public hearing. Chairman Faglie asked Dennis about the 2030 Plan and its recommendation of this property. Dennis stated that the 2030 Plan recommends the zoning remain SF -1A with low density residential use. Commissioner Hamel stated that the 2030 Plan is significant and should be taken into account. Commissioner Williamson stated that Southlake Boulevard is a commercial road and should have commercial use face it, not residential. However, he is very sympathetic to the community. Chairman Faglie agreed with Commissioner Williamson. The land is still vacant but Chairman Faglie does not see it being used residentially. Commissioner Parrish stated that this is a very difficult piece of property. It will only get harder as land develops more and more. Commissioner Hamel stressed that the 2030 Plan recommends the property as residential. Is there an assumption of the market ability? Commissioner Hudson stated that he believes this property can be developed residentially. PUBLIC HEARING Paul Spain, 2200 Estes Park Dr., Southlake, Texas. Mr. Spain presented a 46.5 acre plan for the future subdivision and the division of lots with common areas, natural walkways and ponds. The portion of the pond facing Carroll Avenue will be open to the public for recreational use. Currently there is white stone brick throughout the property from the previous owner, Mr. Prade. The stone brick will remain and be considered historical landmarks. Within the property is also a bridge over the existing pond. The applicant further stated that they are working with Parks and Recreation for right -of -way dedications and trail systems. Commissioner Williamson asked if the applicant knew what builders they were going to use. Mr. Spain stated that they were not sure at this time. Commissioner Hamel asked about the dedications to the City. Mr. Spain stated that 2 acres will be dedicated and owned by the City. The remainder of the lots will be owned by the HOA. However, all lots including City property will be maintained by the HOA. Commissioner Hamel asked about the irrigation. Mr. Spain stated that not all of the lots will be sprinkled. Commissioner Parrish asked about the flood plains. Mr. Spain stated that all Tots will be built out of the flood plain. A drainage study was submitted to the City for review. Commissioner Hudson mentioned the response letter received from Vision Southwest and the concerns they had regarding Zena Rucker round - about. Mr. Spain stated that some area has been planned for dedication for that right -of -way. Chairman Faglie opened the public hearing. Mr. Stanley, 1319 Forest Hills Court, Southlake came forward. Mr. Stanley stated that he liked the concept but was concerned about Carroll Avenue and access to the subdivision. Mark Kotter, 406 Edgemont Dr., Southlake came forward. Mr. Kotter is in opposition of the development due to traffic increase and excessive noise. Chairman Faglie read aloud the letter presented by Zena Rucker. Mrs. Rucker has specific requests for a masonry wall dividing the property and specific land tree mitigation plans. Planning and Zoning Commission Meeting Minutes — November 03, 2011 Page 5 of 8 However, Mrs. Rucker is in support of the development. Zena Rucker, 620 S. Carroll Ave., Southlake came forward. Mrs. Rucker expressed concerns about the development so close to her property and would like her privacy maintained. Also, traffic around her property will increase and would like to make sure traffic concerns are addressed. David McDonald, 1305 Forest Hills Ct., Southlake and Zulfiqar Ali, 300 Lakeside Ct., Southlake came forward. Both are in favor of the development but has concerns regarding the traffic on Carroll St. Chairman Faglie closed the public hearing. Mr. Spain came forward to address the comments. Carroll Ave. is the better entrance for the subdivision. The Carroll right -of -way will be built shortly but is not aware of the timeline. The masonry wall for Zena Rucker is not a problem and can do that on the onset of construction. Regarding the tree preservation area, trees will be replaced and there will be 4 per lot required. A landscape buffer was added along the Zena Rucker Parkway. Chairman Faglie reopened the public hearing and Mr. McDonald came forward. Mr. McDonald stated that currently Carroll St. cannot handle the added traffic that this subdivision will bring. Chairman Faglie closed the public hearing. Chairman Faglie and Commissioner Williamson openly discussed the Carroll St. entrance to the subdivision. Commissioner Parrish stated that once the traffic signal is installed, it will help maintain traffic. Chairman Faglie added that there are two separate entrances to the subdivision. Carroll St. is only the main entrance with the most features. Commissioner Parrish stated that the overall plan is good and particularly is happy about the historical preservation. Commissioner Hamel and Commissioner Hudson agreed with all comments already stated. Motion to approve ZA11 -061, a zoning change in the development plan for Winding Creek, and the applicant's willingness to put an 8 -ft. board on board fence along the west property boundary on the onset of development of the project and subject to the development plan review summary #2 dated December 1, 2011. Daniel Cortez stated that only the L shaped corner is affected. Home Goods currently does not have a loading dock. Mr. Finestead would like to occupy two spaces for one store and change the facade out front utilizing one entrance and closing off the other front entrance using it for wall space and display. Ms. Katino added that a loading dock would be added to the rear portion of the building for loading and unloading of goods. The dock will be enclosed for the safety of the workers during inclement weather as well as possible theft. Chairman Faglie asked about the different colors to the effuse. Mr. Finestead stated that the idea is to separate the entrances. Commissioner Parrish asked about the separate doors. Mr. Finestead stated that the other doors will not be used at all. Commissioner Hudson asked about what is sold at Home Goods. Ms. Katino stated that Home Goods sells furniture and accessories. The locations are all over the United States. Commissioner Williamson and Commissioner Parrish questioned the 2 set of doors. What will the doors look like if they will not be in use? Commissioner Williamson expressed his concern and how the doors would look from the outside. Commissioner Parrish suggested that it be used as a display window and change the look of the door completely. Ms. Katino stated that she is worried that the store would lose floor space. Chairman Faglie stopped the meeting for a 5 minute break. Ms. Katino stated that from the outside, you will not be able to tell that there are doors there. It will appear to be a window. Commissioner Hudson would like for it to appear more aesthetic. The other commissioners agree. Something more reassuring will need to be presented to City Council. Ms. Katino and Mr. Finestead agreed. Chairman Faglie opened the public hearing. No one came forward. The public hearing was closed. Motion to approve ZA11 -064, for Home Goods project noting the applicants wiliness when they go before City Council to have more detailed information on the visual aspect of the entry feature and the secondary glass area and the potential for that area to have a knee wall and display behind that glass; also subject to Staff Report dated December 02, 2011 and Site Plan Review Summary #2, dated November 28, 2011.
