This property is on 88 the west side Southlake with frontage to Randol Mill and completely surrounded by the 89 remainder of the original Westwyck Hills. This was contracted in 6 separate parcels in 2005. 90 Enclosed the property and instigated the development in 2006. During that time Westwyck Hills 91 Development worked closely with the Fanning family and reached an agreement to purchase 92 the remainder of the land. The plan is for three lots to match the existing lots in Westwyck Hills. 93 Other than the increased front yard setbacks, the increased minimum side yard setbacks and 94 the greater tree protection requirements, there are no differences in zoning or covenant 95 restrictions. The drainage and erosion control will not be increased and will continue along 96 following the existing Westwyck Hills. The southern two lots are low level detention walls for 97 storm drainage that will be designed per the City requirements that the rate of flow is not 98 increased. There is a small detention pond that will capture the water and release the water, 99 with a pre- conditioned rate of flow. 100 101 Commissioner Springer asked if some of the water will drain to the street. 102 103 Mr. Matthews stated that some will drain to the street but mostly to the detention pond. Daniel Cortez, Planner I presented the case. 144 145 Carol Palazzo, 416 Stockton Dr., Southlake came forward. 146 147 Commissioner Springer asked the reason that the Palazzo's are keeping the slab after 148 demolition. 149 150 Mrs. Palazzo stated that it was for economic reasons and to preserve existing trees. 151 152 Commissioner Parrish verified that access to the property would be through Triple C. 153 154 Mrs. Palazzo agreed. 155 Planning and Zoning Commission Meeting Minutes — October 20, 2011 Page 3 of 8 156 Commissioner Hudson addressed an issue of animals on the property based on 157 correspondence received regarding this case. 158 159 Mrs. Palazzo stated that they will have horses on the property, but currently there are no 160 animals on the property. 161 162 Chairman Faglie stated that the applicant had been cited due to the removal of so many trees. 163 164 Mrs. Palazzo responded that she had originally hired a tree trimming service to thin the site and 165 was unaware at the time of the existing tree ordinance. Mrs. Palazzo further stated that she 166 planned on replacing all the trees that were removed. 167 168 Chairman Faglie opened the public hearing. 169 170 Laura Means, 1421 Bay Meadows, Southlake. Mrs. Means stated that the Palazzo's property 171 backs up to their property. Mrs. Means has concerns regarding the smell of the horses and is 172 concerned that her dogs will bark continuously and then be fined by the HOA. 173 174 Loren Sloane, 1417 Bay Meadow, Southlake. Mr. Sloane questioned the roof height of the barn 175 structure and asked for clarification on SF -2 Zoning. 176 177 Mrs. Palazzo stated that the height would be 24 -ft. 178 179 Chairman Faglie clarified that the barn structure is not being considered at this meeting. The 180 Palazzo's will be going before the Zoning Board of Adjustment on October 27, 2011. 181 182 Dennis Killough stated that SF -2 Zoning requires a minimum lot size of 2 acres per lot. 183 Therefore only one single family residence per 2 acre lot size. 184 185 Thomas Phelps, 1860 Hunters Creek, Southlake. Mr. Phelps resides to the south of the 186 boundary line and questions the survey. From his survey there is a 30 -ft strip of land that is 187 unclaimed and the 2 tracts are not connected. 188 189 Tracey Adams, 1409 Bay Meadows, Southlake. Mrs. Adams expressed her concerns regarding 190 the horses and the smell. She is also concerned about her dogs barking and receiving a fine. 191 192 Mrs. Palazzo addressed the fencing issues. Daniel Cortez, Planner I presented the 230 case. 231 232 Debra Perryman, Silver Oak Commercial, 2805 Market Loop, Suite 100, Southlake and Joe 233 Cary, Mercury Radio Arts, 1133 Avenue of the Americas, New York, New York. 234 235 Debra Perryman stated that they have met with staff regarding site improvements and the 236 recommended zoning to accommodate the uses. 237 238 Commissioner Springer asked where the generator and dumpster will be re- located and clarified 239 that the primary reason for moving them is to get them out of the secured fencing. 240 241 Ms. Perryman stated not at this time. It makes sense to have it close to the property. There is 242 some excess parking that can be used to accommodate that use. The applicant is aware of the 243 requirements for screening, size and location and will work with staff. 244 245 Commissioner Forman asked for an explanation of the specific primary uses and the frequency 246 of these uses that have been identified. 247 248 Ms. Perryman stated that the primary uses are the programming on a daily basis, mainly 249 Monday thru Thursday for the radio and television. The other uses would be more seasonal or 250 occasional. Also, they would like to make sure the property is available to the community and 251 other organizations to use the facility. The current occupancy for the auditorium is 1,725 people. 252 They would like to work with potential training, conferences and learning centers. On a daily 253 basis, there will be anywhere from 30 to 100 people for staff and under 200 for live audience. 254 during regular business hours. 255 256 Mr. Cary stated that the radio show is generally broadcasted in the morning and television is 257 done live between 4pm and 6pm. During regular business, regular staff would be present for 258 everyday operations of any normal business. The live events where the full occupancy would be 259 in use would not be regularly scheduled. That would be more of special occasions and be Planning and Zoning Commission Meeting Minutes - October 20, 2011 Page 5 of 8 260 dictated by the community and the uses. 261 262 Chairman Faglie asked if the seating occupancy will be decreased. 263 264 Ms. Perryman stated that the applicant is not asking for a reduction. The applicant would like full 265 use of the facility as it is for special events. 266 267 Commissioner Hudson asked for the reason that the applicant listed specific uses in the S -P -1 268 Zoning and included the 0 -1 Zoning uses as well. 269 270 Ms. Perryman stated that we made the inclusion of 0 -1 Zoning based on discussion with city 271 staff. The primary use of the building is radio, television, internet and broadcasting which is a 272 specific use in 0 -1 Zoning. In order to maintain the CS Zoning the 0 -1 Zoning needed to be 273 added. 274 275 Commissioner Williamson asked if during a large event where traffic would be a concern, will 276 there be traffic oversight. 277 278 Ms. Perryman stated that if an event that would generate that much traffic, the applicant, would 279 coordinate with all parties to address any traffic issues. 280 281 Chairman Faglie asked about time limits on the events. 282 283 Ms. Perryman stated that has not been addressed yet. However, during regular business days, 284 the company staff is done by 7p.m. and out by 9 p.m. During a special event the hours of 285 operation would be addressed at that time. 286 287 Commissioner Springer asked about the size of the proposed accessory structure. 288 289 Ms. Perryman stated that the size has not been addressed. However, it was added on to the 290 request to make sure it was an approved use. Due to the business, sets will need to be 291 changed out as well as seasonal items and there may not be enough room in the building to 292 accommodate such props. The applicant is aware of the ordinance regarding height and size of 293 accessory buildings. If needed, the applicant will come back to staff to address such issues in 294 the future. 295 296 Commissioner Parrish asked Dennis Killough about the fencing plan presented and if that is 297 something that will need to come back before the Board. Also, what are the fence requirements 298 for this use? 299 300 Dennis Killough stated no. The applicant addressed the fence in case the need arises to expand 301 it to the noted boundary. Fence requirements allow cedar, wrought iron, and masonry with a 302 maximum height of 8 —ft. The applicant's intent is to have wrought iron. 303 304 Chairman Faglie opened the public hearing. Chairman Faglie mentioned that Frank Bliss was 305 not present, 1256 Main St, Ste 240, but approved the request. 306 307 Pattie Minder, 223 Eastwood Dr., Southlake. Ms. Minder addressed issues of lighting, fencing, 308 satellite dishes, antennas, security, large events and hours of operation directly with Joe Cary. 309 Ms. Minder stated that Mr. Cary addressed all issues. Ms. Minder requested that the parking lot 310 lights after the business day has been concluded with the exception of a special event, be 311 turned off at 9 p.m. Also, the current fence that goes around the property at this time is an eye Planning and Zoning Commission Meeting Minutes - October 20, 2011 Page 6 of 8 312 sore. The neighborhood is asking that the applicant to please put in an 8 -ft masonry wall to 313 separate Woodland Heights. Ms. Minder further stated that she is in support of the zoning 314 change and the use that is presented. 315 316 Commissioner Springer asked how many feet of fence is Ms. Minder referring to? 317 318 Ms. Minder stated that the longest portion of the fence is along the southern and eastern line. 319 Another masonry wall will be going in along Woodland Height onto Village Center Dr. This will 320 allow some added security for our subdivision. 321 322 Chairman Faglie read aloud the e-mails that came in regarding ZA11 -057. Thomas and Rosie 323 Moore, 1024 Alamo Dr., approve; Russell Leavens PE, 2501 Gravel Dr., Ste D, approve; Cliff 324 Chapman, 211 Eastwood Dr., approve; Mike and Laura Heath, 211 Westwood Dr., approve; Ed 325 and Frankie Raney, 209 Westwood Dr., approve; Scott Landrum PE, 175 Westwood Dr., 326 approve. 327 328 Ms. Perryman addressed the parking lot lights. Typically the lights are on a photo cell and are 329 checking to see if there are any timers on them. The applicant needs to check to see which 330 lights need to stay on due to security for the project. However, the lights closest to the 331 residential properties can be turned off or lowered to accommodate the neighborhood. With 332 regard to the perimeter fence, the information that has been provided to us is that Village Center 333 Dr. will continue along the southern and eastern boundary. The applicant is waiting on this to be 334 completed before any plans can be made. This would be about 1200 -ft of fencing and have 335 already started the bid process. 336 337 Commissioner Hudson asked if the applicant would have any objections to removing the 0-1 338 office uses. Would the 9 site specific uses that you have listed encompass the occupancy of this 339 property? If the 0-1 is removed from the request, could you still fully occupy this space with the 340 uses you have requested? 341 342 Ms. Perryman stated that they would need to review that. The specific reason the uses were 343 listed is so that there would be no misunderstanding as to the use of the property. Just as an 344 example, the advertising agency use listed; even though the applicant does not have an 345 advertising unit they may have a component that would advertise. 346 347 Commissioner Hudson stated that as a recommending Board, the site specific uses should be 348 listed but the 0-1 Zoning could be dropped. 349 350 Chairman Faglie agreed and closed the public hearing. 351 352 Commissioner Williamson stated that he agreed with the applicant regarding the lights in the 353 parking lot. Mr. Wilkinson stated that is was contacted by Northgate 373 to review plans for this project. At that time I was shown the area of where the retaining walls 374 and retention ponds would be located. The ponds are located fronting Southlake Blvd. with large 375 retaining walls.
