95 zero lot line homes, increased traffic congestion and increased wear and tear on the streets.

105 the applicant's willingness to require trees to be planted along the southern boundary and also to
106 place deed restrictions on the landscaping to prevent the removal of these trees in the buffer yard.

109 concerns stating the applicant's willingness to increase the buffer yards to decrease the overall size
110 of the homes.

113 noting the applicant's willingness to reduce the number of lots on the south side of the property
114 currently ten (10) lots down to nine (9) lots, specifically the western side of the southern end

116 draw lot lines to save the large Blackjack Oak tree as presented to the Planning & Zoning
117 Commission; also recognizing that the applicant will make deed restrictions to the rear buffer-yard
118 requiring the lots on the southern boundary have at least three (3) six inch (6") caliber hardwood
119 trees planted in the buffer-yard; also noting the applicant's willingness to have a fifteen (15) foot

255 North Park; specifically granting the variance to the lighting ordinance No. 693 the lighting type,
256 Intensity of Illumination on the subject property, Intensity of Illumination (vertical & horizontal) at the
257 residential property line, and Luminance at the residential property lines and that the variance be
258 limited specifically to the sport field lighting; also granting a variance to the driveway ordinance No.
259 634 for a sixty-two (62) foot curb cut width instead of the forty (40) foot limit as stated in the
260 ordinance; also including the fencing plan as presented by staff to the Planning & Zoning
261 Commission noting the variance to the height requirement of eight (8) feet to allow for a six (6) foot
262 height requirement; also recommending a review of the park hours; also noting the applicant's
263 willingness to present information to City Council regarding the access to the Oak Pointe subdivision
264 and the operation and maintenance cost associated with that access; and subject to Review
265 Summary No. 2, dated February 12, 2010.
