The Applicant is Far Pointe Cellar. 42 43 AGENDA ITEM # 7 ZA04-035 SPECIFIC USE PERMIT FOR FAR POINTE WINE BAR & Planning and Zoning Commission Meeting Minutes on June 3, 2004 1 I BISTRO: 2 Senior Planner Dennis Killough presented this item to the Commission for a specific use permit to 3 allow a tavern, club, and other comparable establishment under which the on-premise consumption 4 of alcohol is permitted. The property is located at 721 E. Southlake Boulevard, Southlake, Texas. 5 The current zoning is C-2 Local Retail Commercial District. The proposed zoning is S-P-1 Detailed 6 Site Plan District. The Owner/Applicant is Greg Wilemon. 7 8 Greg Wilemon, Owner, opened for questions on these items from the Commission. 9 10 The following change is needed to the regulations and should be made a stipulation of any 11 recommendation for approval: 12 13 Under "Permitted Uses" change "use #27" to "Taverns, clubs, and other comparable 14 establishments under which the on-premises consumption of alcoholic beverages is permitted 15 subject to issuance of a specific use permit as required in Section 45 of this ordinance. The 16 mere reference to this provision within the zoning ordinance does not indicate or imply that 17 the sale or consumption of alcoholic beverages has been or will be permitted under the 18 alcoholic beverage laws of the State of Texas. It is only intended to define a location for this 19 type of use if its existence should be permitted by state law. This use shall be permitted only 20 with the approval of specific use permits under the provisions of Section 45 for both the 21 "taverns, clubs and other similar establishments" use and "sale of alcoholic beverages." 22 23 Chairman Stansell opened the joint public hearing. 24 25 John Drews, Drews Realty, Landlord, clarified lease questions. 26 27 Chairman Stansell closed the joint public hearing and called for discussion from the 28 Commissioners. 29 30 Greg Wilemon responded to TABC issue regarding placing limitations on the specific use permit. 31 32 Motion was made to approve ZA04-034 subject to and incorporating the staff comments of staff 33 report. 34 35 Motion: Edmondson 36 Second: Williams 37 Ayes: Williams, Springer, Edmondson, Vaughan, Stansell 38 Nays: None 39 Approved: 5-0 40 Motion carried 41 42 Motion was made to approve ZA04-035 subject to sunset date for this use matching that of the 43 alcohol permit. The property is located southwest of the intersection of State Highway 114 and Dove Road, 15 Southlake, Texas. The current zoning is AG Agricultural District. The requested zoning is S-P-1 16 Detailed Site Plan District. SPIN Neighborhood # 11. The Owner is Shallow North L.P. The 17 Applicant is Blake Architects. 18 19 Craig Rothmeier, Chief Administrative Officer for Deep South, presented this item to the 20 Commission. 21 22 Skip Blake, Blake Architects, continued with the presentation and reviewed the variance requests. 23 24 Brian Shamburger, traffic engineer with Kimley Horne, talked about traffic concerns and the access 25 onto Shady Oaks. 26 27 Under the "S-P-1 Detailed Site Plan District zoning the applicant proposes "O-1" Office District uses 28 and development regulations with the following exceptions: 29 30 • Heigh t - The building or structure shall not exceed four (4) stories, nor shall it 31 exceed fifty (50) feet with the exception of the central lobby atrium, which shall not 32 exceed seventy (70) feet in height. In the "0-1 " district, no building or structure 33 shall exceed two and one-half (2 stories, nor shall it exceed thirty-five (35) feet. 34 35 Setbacks - The building shall have a setback of 100' from the west property line. 36 No non-single family residential building may encroach in the area above a line 37 having a slope of 4:1 from any single-family residential property. The north portion 38 of the proposed building would be required a setback of approximately 200 feet. 39 The south portion of the proposed building would be required a setback of 40 approximately 250 feet. 41 42 • Articulation - No building facade shall extend greater than one hundred sixty-four 43 feet without having an off-set, either vertically or horizontally. Articulation is required after 132 feet 3 of length. 4 5 • Masonry - The building fagade shall consist of architectural concrete panels and 6 glass curtain walls with a reflectance of less than 10%. 7 8 • Parking - The required number of off-street parking shall be 251 spaces. The 9 required number of parking based on 92,430 square feet of general office is 313 10 spaces. 11 12 • Accessory Use - A multi-level parking structure shall be permitted as an accessory 13 use. A multi-level parking structure is permitted with approval of a Specific Use 14 Permit for properties with "0-l" zoning. 15 16 The following variances are being requested: 17 18 • Driveway Prohibited: Commercial, multi-family and service driveways shall not be 19 permitted on collector or local streets unless the tract or lot has no other public 20 access. The applicant is requesting a drive on Shady Oaks Drive. 21 22 • Driveway Stacking: The minimum driveway stacking depth is 100 feet for this site. 23 The applicant is requesting a stacking depth of approximately 11 feet for the 24 southern drive on State Highway 114. 25 26 Craig Rothmeier answered additional questions. 27 28 Skip Blake answered additional questions regarding the architecture. 29 30 Chairman Stansell opened the public hearing 31 32 Noyce McGarity, 2050 N.
