Twenty one written notices 24 went to property owners within the 200' notification area, and two responses were received being 25 opposed. 26 27 Discussion was made between the Commissioners and Dennis Killough confirming the revision 28 showing Parkwood Drive ending at a cul-de-sac. 29 30 John Levitt, Civil Works Group, 600 South Main, Ste. 300, Rome, Texas: presented this item to the 31 Commission. 32 33 Commissioner Jones commented on the buffer zone and asked for clarification from the Applicant. 34 35 Chairman King opened the Public Hearing. 36 37 (Planning and Zoning Commission meeting, 05-17-01, CD 1, 6:55:29) 38 39 Tony Ezell, 514 Northwood Trail, Southlake, Texas: commented about the revision discussed and 40 was relieved to hear that the petition set before the City Council had been approved regarding 41 Parkwood Drive. Also, he asked that the buffer zone be a minimum of 250' between the back of his 42 property line and the development. He stated his concern for property values and maintaining the 43 quality of life. He asked that the homes built closest to his property line be one-story. 44 Vice-Chairman Boutte stated that the original Site Plan, which was approved in 1998, was not open Planning and Zoning Commission Meeting Minutes on May 17, 2001 2 I for revision. The Commission would be unable to set any restrictions as far as buffer zones and 2 structure height. 3 4 Bruce Payne added that this was a Plat Showing, which means a formalization of the boundaries 5 only. He also clarified why the surrounding property owners were given notice for this public 6 hearing... quoting ordinance requirements. 7 8 Chairman King invited the audience to step forward to speak if they wished to speak, however, there 9 was nothing the Commission would be able to do to revise this particular Site Plan. 10 11 Ughetta Miller, 502 Northwood Trail, Southlake, Texas: stated her concern for the trees in the green 12 belt behind her property. 13 14 Dennis Killough assured Ms. Miller that the trees were protected under the Tree Preservation 15 Ordinance. 16 17 Vice-Chairman Boutte requested copies of the Site Plan be made for those who would like to have 18 one. 19 20 Kay Murphy, 508 Northwood Trail, Southlake, Texas: asked Dennis Killough to clarify the line 21 where the building ends and where the parking lot would be located. 22 23 Chairman King read the Registration Sign-In card from Karen Bronson, 506 Northwood Trail, 24 Southlake, Texas, who was in opposition but did not wish to speak. 25 26 Anne Marie Foster, 510 Northwood Trail, Southlake, Texas: questioned the design of the building. 27 28 Dennis Killough invited anyone who wished to see the Site Plan to come by the Planning 29 Department and the file would be pulled for viewing. 30 31 Chairman King closed the Public Hearing. 32 33 (Planning and Zoning Commission meeting, 05-17-01, CD 1, 7:18:41) 34 35 Motion was made to approve ZA01-004 subject to Plat Review Summary No. 2, dated April 26, 36 2001. Hood Survey Abstract No. 706 and being 1.00 4 acre. The location of this property is on the east side of Suffolk Court, approximately 700' north of 5 Turnberry Ln. The current zoning is "AG" Agricultural. Requested Zoning: "R-PUD" Residential 6 Planned Unit Development. SPIN Neighborhood # 11. The Owner of the property is Lynn M. 7 Dixon. Ten written notices were sent to property owners within the 200' notification area, and three 8 responses were received with two in favor and two undecided. 9 10 Lynn Dixon, 909 Suffolk Court, Southlake, Texas: presented this item to the Commission. 11 12 Vice-Chairman Boutte stated his concern for the Applicant's future use of this land and asked that 13 the Applicant be aware of all the restrictions that coincide with this request. 14 15 Mr. Dixon responded by saying that he has been working on this for three years and in his dealings 16 with the Commission, City Council, and City Staff, this plan was the ultimate resolution. 17 18 Commissioner Horne commented about the limitations of this request and that the Applicant could 19 probably accommodate his needs by other means. 20 21 Mr. Dixon stated that his concern was for future approval of the Plat. Planning and Zoning Commission Meeting Minutes on May 17, 2001 6 1 2 Wendy Van, Charleston Homes (General Contractor): presented this item to the Commission and 3 requested no variances. 4 5 Ms. Van made a correction to the Agenda as to the address of the property ...it should read 1475 6 Randol Mill instead of 1476 Randol Mill. 7 8 David McCastro, President of Secure Source (Security Consulting Service): addressed the 9 Commission by stating the nature of his business and the growth potential. 10 11 Chairman King opened the Public Hearing. 12 13 (Planning and Zoning Commission meeting, 05-17-01, CD 1, 8:19:27) 14 15 Terry O'Malley, 1565 Randol Mill, Roanoke, Texas: stated his address is also known as 1480 Brown 16 Lane. He said he was concerned about future thoroughfare plans and the possibility of zoning 17 turning into commercial. 18 19 Commissioner Jones asked Mr. O'Malley if it wasn't better to have this property renovated into 20 something nice rather than having it in the dilapidated condition it is currently in. 21 22 Mr. O'Malley stated his concern is that this business will bring commercial zoning to the area. He 23 said he is leery of the promise to make this area nice. He is also concerned with the mess of 24 removing the concrete slabs. 25 26 Ms. Van explained the process that will be used to remove the concrete slabs. 27 28 Commissioner Horne asked how long it would take to remove the slabs. 29 30 Ms. Van said she is guessing about two weeks. 31 32 Commissioner Muller asked if there had been a SPIN meeting regarding this request. 33 34 Ms. Van answered there had been a SPIN meeting as well as sending proper notification, passing 35 out flyers, and posting signs. 36 37 Mr. O'Malley claimed he was not notified and the first he knew of it was when his neighbor, Mr. 38 Spivey, told him of this hearing. 39 40 Bill Spivey, 1520 Randol Mill, Southlake, Texas: addressed the Commission with the history of the 41 property as the prior owner. He asked that the city be strict with their guidelines for the new 42 business. He also talked about the parking. He would also like to see a more detailed landscape plan. 43 44 Ms. Van addressed Mr. Spivey's concern with the location of the parking and assured him that they Planning and Zoning Commission Meeting Minutes on May 17, 2001 7 I were going to put the parking where they had discussed. 2 3 Chairman King closed the Public Hearing. 4 5 (Planning and Zoning Commission meeting, 05-17-01, CD 1, 9:07:25) 6 7 Chairman King called for a break at 9:07:27 p.m. 8 9 Chairman King called the meeting back to order at 9:22:40 p.m. 10 11 Commissioner Muller asked for verification of the location of the Master Trail Plan. She also asked 12 if the soil or concrete slabs had been tested for pollutants due to the nature of the business that 13 previously occupied this property. She then asked about the SPIN meeting that was held. She also 14 pointed out that the zoning change from "CS" Community Service to "O-l" Office Commercial did 15 not comply with the Land Use Plan. 16 17 Chairman King stated that this location has already been spot zoned and felt that this project would 18 be an enhancement to the neighborhood. 19 20 Vice Chairman Boutte commented that at the SPIN meeting the neighborhood residents were happy 21 that this property was going to be cleaned up and that they did not have a problem with this business 22 coming in. 23 24 Commissioner Horne asked that if this property was zoned as "O-1" would it open up the 25 neighborhood to future commercialized zoning. 26 27 Vice Chairman Boutte responded that he felt this piece of property was unique. 28 29 Commissioner Jones commented that it should weigh heavy that most of the residents in the area 30 were not opposed to this project. 31 32 Commissioner Muller commented that the "O-1" zoning is more intense than the "CS". 33 34 Commissioner Stansell asked the staff if ten years down the road this building was tore down could 35 new office buildings be constructed without needing a zoning change or plan review. 36 37 Dennis Killough and Bruce Payne discussed the issue and responded by stating that an application 38 for a new Site Plan would have to be submitted, however, if the footprint of the building did not 39 change, a zoning change would not be necessary. It was also discussed that the "S-P-1" zoning 40 would put limitations on the renovation of this building. 41 42 Commissioner Stansell made a motion to approve this item.
