24 Plan for Haltom Creek Estates on property legally described as Tracts 3AIG3, 3A1G, 3AIG5,
25 3A1G1, 3A1G2, 3A1G4, 3AIF1, 5B3, 5B, 5B2A, 5B2, 4E, and 4, Frances Throop Survey Abstract
26 No. 1511; being 95.9 acres. The property is located on the east side of North Carroll Avenue and
27 the west side of Sunshine Lane, approximately 500' south of East Dove Road. The Current Zonings
28 are "AG" Agricultural District and "SF-IA" Single Family Residential District. The Requested
29 Zoning is "R-PUD" Residential Planned Unit Development. The Land Use Categories are Low
30 Density Residential and 100-Year Flood Plain. The Owners of the property are James C. Haltom,

35 opposed. Two petitions of opposition were also received.

37 David McMahan (Four Peaks Development) presented this item to the Commission and reviewed
38 the requested variances. He stated that during his meeting with SPIN - traffic, drainage, and the
39 size of the lots were their main issues. He continued to address these issues.

41 The Commission and Applicant discussed the price of homes and the size of lots and their relation
42 to other subdivisions in Southlake.

4 Chairman King called for comments from SPIN representative.

6 Kim Pannell (SPIN Liaison) 1418 Whispering Dell Court, Southlake, Texas, discussed the main
7 concern of the residents of Whispering Dell Estates being the potential for drainage problems. She
8 presented pictures of her property taken after a recent rainfall showing the flooding. Also, there is
9 an issue with a trail being placed back along her property, which pretty much puts a public park in
10 her backyard. More of the shared concerns are with the traffic along Carroll Road in the mornings.
11 There are three public schools that would be affected: the Intermediate, Johnson Elementary, Carroll
12 Middle School, and one private school, Highland Meadow Montessori. This also leads to another
13 problem, which is the overcrowding of these public schools.

15 Commissioner Terrell commented that although there may eventually be a public trail placed along
16 the back of Kim Pannell's property, it isn't going to be a public park. The surrounding property will
17 be maintained and owned by the property association and is not going to be open to the public.
18
19 Chris Carpenter stated the developers appeared before the park board and the recommendation as
20 it stands thusfar from the park board is for them to maintain a 20' dedication as shown on their plan
21 and the 8' maintenance of the trail. The easement runs from one end of the property to the other.
22 They will request that the developers build an 8' trail to the area that is shown on the concept plan.
23
24 Wayne Moffet, 1414 Whispering Dell Court, Southlake, Texas, stated that his main issue was the
25 possibility of half acre lots being built adjacent to the one and one and a half acre lots.
26
27 Chairman King called Nancy Moffet to speak. She was not present but wanted her opposition to be
28 registered.
29
30 K.L. Stosberg, 1204 Blythe Lane, Southlake, Texas, said that after attending the SPIN #5 meeting,
31 it is his assumption that most of the residents that will be impacted by this development would not
32 oppose if the developers would stick with the spirit of the Master Plan in keeping the lots at one or
33 more acres. He also commented on the drainage problem stating that the land was drowning in 6"
34 of water. He also understood that the homeowner's association would take care of the trail
35 maintenance.

37 Terry Mullaney, 1515 N. Carroll Ave., Southlake, Texas, strongly stated his opposition to this
38 development and the profit motive of the developer. He agreed that the spirit of the Master Plan
39 would be compromised. He also stated that the traffic situation and school overcrowding are key
40 issues for consideration. He felt that Product Type A is completely inconsistent with the existing
41 character of the neighborhood. He strongly asked the Commission to reject this request.

43 Don Rose, 1209 Ashmore Ct., Southlake, Texas, spoke in opposition to the proposed development.
44 He stated that he moved to Southlake for the quality of life he wanted. He agreed that the high

1 density this development suggests is totally inconsistent with the environment and the surrounding
2 neighborhood. He requested that the board and the council members preserve the quality of life that
3 he, and many other residents, moved to Southlake to obtain.

5 Rosemary Hutchins, 1412 Whispering Dell Court, Southlake, Texas, began her comments by passing
6 out pictures of her property after a normal rainfall. Her pictures showed significant flooding
7 problems. She stated her concern with the '/2 acre lots, which are proposed, and the increase of
8 flooding this development would cause.

10 Jolin McCleskey, 1416 Whispering Dell Court, Southlake, Texas, highly disagreed with the building
11 of`/2 acre lots. She stated that the spirit of the Master Plan was to keep one house per one acre. She
12 understood that the land should be developed, however, requested that they stick with the one house
13 per one-acre plan. She also commented on the already heavy traffic problem on Carroll Avenue and
14 is concerned about the increase. The drainage issue is also a key concern. She asked if this proposal
15 would require a super majority vote by the Council.

17 Dennis Killough stated that with the opposition being in excess of 20% it will require a super
18 majority vote from the City Council but it does not have an effect on what the Commission does
19 tonight.

21 Bruce Payne commented on the Land Use Plan and whether or not the proposal is following that
22 plan. He explains what "Low Density" on the Land Use Plan really means and what the applicant
23 is applying for falls under the guidelines of the plan. A very important point to understand is that
24 the Land Use Plan does not call for one-acre lots. The Land Use Plan calls for a density of one
25 residential dwelling unit per acre. This can be allocated in any number of ways. The city zoning code
26 provides for a type of residential development called a planned unit development, which promotes
27 clustering or smaller lots for the gaining in return an area that remains as open space whether it be
28 passive or other type of open space. The applicant is applying to change the zoning to Residential
29 PUD so he can have an area that will have smaller than one-acre lots but in return for that the city
30 would gain a passive open space area of approximately 15 acres, which is a substantially greater
31 amount of open space than what the PUD requirements actually state. It is not accurate to say that
32 the applicants request goes against what the Land Use Plan calls for...the Land Use Plan looks at
33 an overall density of the development within its prescribed boundaries.

35 Kay Zimmerman, 1420 Whispering Dell Court, Southlake, Texas, stated her shared concerns for the
36 drainage problem, the overwhelming traffic on Carroll Avenue, and that the trail was unacceptable.
37 She said that she has horses on her property and the trail poses a liability issue for her because of
38 the children that would be tempted to pet the horses. She requested a sound buffer of mature trees
39 be placed between her house and Product Type B.

41 Cara White, 4475 Homestead Drive, Southlake, Texas, clarified the Park Board decision to place
42 the park in an area that was not considered "flood plain." With all of the concern from the residents,
43 she requested that the location of the park be re-addressed. She asked Mr. Payne about the Land Use
44 Plan and wanted clarification on what the "intent" was of the Master Plan.

2 Bruce Payne re-iterated the definition of "Low Density" and explained in more detail about the
3 usability of the property located in the flood plain.

5 Cara White responded by saying that the developer is benefited by this plan since it is unlikely that
6 he would build in the flood plain area. She also commented on the proposed trail and encouraged
7 the residents who oppose to have the trail taken out of the plan.

15 David McMahan respectfully requested to table for 30 days (5-17-01) to allow an opportunity to see
16 what they can do to bring this property in to the Land Use Plan and see about correcting some of the
17 circumstances that have been brought to their attention.

19 Wayne Moffet opposed the request to table and would like to continue forward.

21 Commissioner Jones stated that considering all of the concerns heard tonight, they owe the
22 developer the time to meet with the neighbors.

24 Commissioner Horne believed it should be tabled only to May 3, 2001, instead of May 17, 2001.

26 Chairman King said it was most practical to table to May 3, 2001. He also apologized to anyone who
27 wished to speak but would be unable to attend the next meeting.

29 The following people filled out a Sign-In Card opposing ZA01-027 but did not speak:

31 Rhonda Chambers, 1810 Hunters Creek, Southlake, Texas, who wrote: Three years ago we all
32 fought hard to protect the land and the rural atmosphere. At that time City Council and
33 many Southlake citizens all agreed we should keep all the land left North of 114 to a Low
34 Density, which means one house on a minimum one acre lot - No fancy loop holes and no
35 `fuzzy math. "It's simple and straightforward: each house has to sit on at least one acre of
36 land... not counting streets. The roads North of 114 are already in need of attention and
37 repairs. Many neighborhoods still do not have sewer lines. The schools are constantly
38 expanding and building new buildings. We don't need 100 new homes, 200+ new cars -
39 traffic is bad enough. And, we certainly can't put 250+ kids in already strained schools. I
40 spent Monday at the SPIN meeting restating all that we had said three years ago to City
41 Council and have spent many hours on the phone and going door to door to have neighbors
42 sign a petition or encouraging them to voice their opinions. I'm a full time mother and
43 volunteer - I don't have time to baby-sit this board or City Council every time a developer
44 waves money here in S.L.;

9 Kelly McKinney, no address given, who wrote: Six years ago we moved to the Hunters Ridge
10 neighborhood. At the time we were "newcomers " in a very established neighborhood. We
11 chose this area as a compromise between my husband and myself. He wanted acreage and
12 I wanted a neighborhood. This was an ideal situation. Approximately three years ago, we
13 came to the council under the leadership of Mr. Haltom. He was fighting to keep this area
14 zoned for one-acre lots. At the time, everything north of Highway 114 was to be kept one-
15 acre residential lots. I understand some of the very property he was fighting to keep he is
16 now planning on selling to develop into medium density subdivisions. My family and I are
17 very upset about this. We have come to appreciate our "country " neighborhood and feel
18 with this one area going into a primarily `farming area " it will disrupt the flow of the land
19 and change the dynamics that make this area so special to us. I ask that you carefully
20 consider what is best for the residents of this area and all of Southlake. Do we really want
21 the whole of Southlake to be a "country club " atmosphere? I believe that goes against the
22 idea that Southlake was founded on so many years ago. While I love the progress of our
23 town, I think we need to be careful to preserve the flavor of the original Southlake;

28 has two children attending private school. He felt that schools of this quality need to be kept in

32 a problem. He hoped the Commission would vote in favor of this proposition.
