She said they discussed issues such as lighting, the lighting 43 on the ATM, the hours of operation, parking, and stacking depth onto F. M. 1709. She said the 44 applicant agreed to the hours of 8:00 to 5:00 on the two back buildings with no weekends. He said the will meet and exceed the lighting 7 requirements. He reminded the Commission this is a very detailed Concept Plan. 8 9 Commissioner Muller asked Mr. LeVrier if he will change the zoning request to "S-P-1". Mr. 10 LeVrier said no; they meet all ordinance requirements. 11 12 Mr. LeVrier said they are not proposing any pole lights. 13 14 Chairman King called for a break at 7:33 p.m. 15 Chairman King called the meeting back to order at 7:50 p.m. 16 17 (Planning and Zoning Commission meeting, 03-22-01, tape 1, section #1659) 18 19 Commissioner Muller said again that she wants "S-P-1" zoning. 20 21 Mr. LeVrier asked the Commission to trust the City's ordinances. 22 23 Commissioner Muller said "S-P-1" is part of the ordinance. 24 25 Vice-Chairman Boutte reminded everyone this is the last legislative action by the city; the rest is 26 administrative. 27 28 Commissioner Terrell asked if they can tie this plan to a future Master Plan (i.e.: Trail Master Plan). 29 Director Payne said no; not the way it is configured. 30 31 Jeff Birmingham (Trammell Crow - represented Bank One) said he is unsure of what "S-P-1" zoning 32 means and said they will agree to put in the trail. 33 34 After discussing it with Mr. Birmingham, Mr. LeVrier asked for "S-P-1" zoning with "O-1" uses. 35 36 Commissioner Jones asked if that is satisfactory to Mr. LeVrier; does he feel like he is 37 compromising the project. Mr. LeVrier said no. 38 39 Dennis Minder, 223 Eastwood Drive, Southlake, Texas, said he would like shorter light poles (4' or 40 6') and wants the dumpster to be screened. 41 42 Chairman King closed the Public Hearing. 43 44 (Planning and Zoning Commission meeting, 03-22-01, tape 1, section #2900) Planning and Zoning Commission Meeting Minutes on March 22, 2001 3 1 2 Commissioner Muller discussed "S-P-1" with "0-1" uses on the property to require the 8' trail as 3 proposed on Master Trail Plan. Also, including building size limits and lightening restrictions as the 4 developer had agreed to at the neighborhood SPIN meeting. 5 6 Motion was made to approve ZA00-126 subject to Concept Plan Review Summary No. 2, dated 7 March 16, 2001, accepting the applicant's agreement to change the zoning to "S-P-2" Generalized 8 Site Plan District with "O-1" Office District uses, limiting the maximum building size of the back 9 two buildings to 4,200 square feet, requiring the applicant to build an 8 trail, and limiting the 10 height of the light poles to 8 foot and to shield the lighting on the ATM but to comply with State 11 requirements for lighting of the ATM area. 12 13 Motion: Muller 14 Second: Stansell 15 Ayes: Boutte, Muller, Horne, Stansell, Terrell, King 16 Nays: Jones 17 Approved: 6-1 18 Motion carried. 19 20 (Planning and Zoning Commission meeting, 03-22-01, tape 1, section #3039) 21 22 Commissioner Jones said his vote against ZA00-126 is due to his belief that we overstepped our 23 authority with limiting the lighting poles. The "O-1" zoning is clearly written for a purpose, taking 24 in consideration of surrounding neighborhoods. If we do not accept the zoning definition as its 25 written, we're admitting that it's so flawed we have to "strong-arm" changes. I just don't think we 26 should usurp the definition of zoning that Council has approved. If we don't like it, we should make 27 a recommendation to Council and not "penalize" the developer or "compromise" him into 28 submission. 29 30 AGENDA ITEM #5, ZA01-017, REZONING AND CONCEPT PLAN FOR CLARIDEN SCHOOL: 31 Senior Planner Ken Baker presented this item to the Commission for a Rezoning and Concept Plan 32 for Clariden School on property legally described as a portion of Tracts 1 and IA, situated in the W. 33 Mills Survey, Abstract No. 877; being 23.050 acres. The property is located on the west side of 34 North White Chapel Boulevard approximately 1,400' south of Bob Jones Road. The Current Zoning 35 is "AG" Agricultural District. The Requested Zoning is "CS" Community Service District. The Land 36 Use Category is Low Density Residential. The Owner and Applicant is The Clariden School. Three 37 written notices were sent to property owners within the 200' notification area, and no responses were 38 received. 17 responses were received from outside the 200' notification area with 16 being in favor 39 and one being opposed. A petition in favor was received with 746 signatures. A petition opposed was 40 received with 126 signatures. 41 42 Phil Oman gave the initial presentation of this item to the Commission. All the addition of 17 traffic from the new homes planned, the school (Private) and the public school (planned) will 18 prevent emergency vehicles (fire, police, ambulance) from navigating White Chapel Road 19 quickly for fires, medical crises, etc., among homeowners north of the proposed site of the 20 private school. 3. With only one direct access road 25 will the City Council and the school take the responsibility for homes that burn or medical 26 problems that occur because fire engines and ambulances can't make fast responses due to 27 traffic on North White Chapel. Make North White Chapel a four lane road before you put in a 28 school. The homes of the people with the school are elsewhere and they are not interested in 29 their potential neighbors. He said he is not in favor of this request. 9 10 Commissioner Muller questioned if the school would pay for the drainage and road improvements 11 to North White Chapel Boulevard. Mr. Oman said the school is prepared to participate in the 12 improvements. 13 14 Paul Spain said they will build the left-hand turn lane. 15 16 Commissioner Stansell asked if the applicant will change the request to "S-P-1" zoning. Mr. Oman 17 said no, he doesn't think so. 18 19 Commissioner Stansell stated he has lighting concerns. Mr. Spain said they will put a restriction on 20 the school lighting. 21 22 Commissioner Horne said it is a hard decision. It is based on what Southlake has been as opposed 23 to what Southlake is. He has to weigh the education of 600 children in a great school against the 24 safety of the road. There are two hairpin turns on this road. 25 26 Commissioner Jones said children are dropped off and picked up at various times, and he doesn't 27 think their safety is compromised because the times are spread out throughout the day. 28 29 Commissioner Terrell said there needs to be some bending on the school's side. He wants "S-P-1" 30 zoning. 31 32 Commissioner Muller asked if the school has looked for land in other places. Mr. Oman said they 33 have looked for five years. 34 35 Commissioner Jones said it comes down to the education of these children. We need to give the 36 parents a choice of public versus private. The school has been given this gift and asked what else 37 they are going to do. He said the roads will be improved; it is not a matter of will they be improved, 38 it is a matter of when will they be improved. 39 40 John Richardson, 4837 Homestead, Southlake, Texas, said it is a question of flooding versus 41 drainage. He said the lake fills up and does not have anywhere else to go but across White Chapel. 42 43 Mr. Spain suggested allowing the school to place barriers or arms on North White Chapel that would 44 come down when the road is flooded.
