Motion was made to approve the minutes of the November 7, 1996, Regular Planning and Zoning 20 Commission Meeting, as amended. 21 22 Motion: Potter 23 Second: Schroetke 24 Ayes: Schroetke, Tate, Potter, Edmondson, Murphy, Creighton 25 Nays: None 26 Abstain: Wright 27 Approved: 6 -0 -1 28 Motion carried. 29 30 (Planning and Zoning Meeting, 11- 21 -96, tape 1, section #36) 31 32 AGENDA ITEM #3, ADMINISTRATIVE COMMENTS: 33 There were no administrative comments. 34 35 (Planning and Zoning Meeting, 11- 21 -96, tape 1, section #38) 36 37 AGENDA ITEM #4. 1996 MASTER THOROUGHFARE PLAN UPDATE: 38 Planner Tom Elgin informed the public that the City Charter mandates the Master Thoroughfare Plan to be updated every four (4) years. The major difference between this plan and the current thoroughfare plan is the incorporation of the Trails System Master Plan, adopted in August of 1995. Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 1 of 16 The trails plan calls for additional wider outside lanes for bicycles along thoroughfares and /or off - road trails parallel to one side of the thoroughfares. The other significant differences are the 3 proposed lanes on certain thoroughfares. The items that the Master Thoroughfare Plan does not 4 cover are: State and Federal roads, street repair and maintenance, timing /funding of street expansions 5 and extensions, and criteria for traffic controls and signage. 6 7 Mr. Elgin continued to say that the thoroughfares with proposed increases in the number of lanes are: 8 Brumlow (from 4 lanes to 5) and Kimball Avenue between F.M. 1709 and State Highway 114 (from 9 4 lanes to 6). The thoroughfares with proposed reductions in the number of lanes are: E. Bob Jones 10 (4 lanes to 2), White Chapel north of Dove (from 4 lanes to 2), Kimball north of Dove (from 4 lanes 11 to 2), Highland east of Carroll (from 4 lanes to 2), Highland west of Shady Oaks (from 4 lanes to 2), 12 Peytonville from intersection of Peytonville & Southridge Lakes (from 4 lanes to 2), Peytonville 13 south of high school (from 4 lanes to 2), Johnson Road (from 4 lanes to 2), Pearson south of F.M. 14 1709 (from 4 lanes to 2), Union Church (from 5 lanes to 2), and Southridge Lakes (from 4 lanes to 15 2). The roadways that are on the proposed plan but were not previously in the plan are: T.W. King 16 north of Bob Jones (from local street to 2 lane), White Chapel north of Bob Jones (from local street 17 to 2 lane), and Byron Nelson Parkway (4 lanes). The roadways that were previously in the plan but 18 are not on the proposed plan are: Ridgecrest (deleted entirely) and Walnut Drive (south and east of 19 East Bob Jones). 20 21 Community Development Director Greg Last stated that the Vice President of Lee Engineering, Inc., Larry Hoffman, P.E., is present to answer any technical questions regarding the Master Thoroughfare Plan. Vice - Chairman Potter asked Mr. Hoffman what traffic count calls for a five (5) lane road. Mr. 24 Hoffman stated that once the average daily traffic equals about 8,400 -8,500 vehicles per day, a five 25 (5) lane road is called for to maintain adequate service on the road. 26 27 Chairman Wright opened the public hearing. 28 29 Richard McMichael, President of Southview Homeowners Association, 350 Binkley Court, 30 Southlake, Texas, spoke to the Commission regarding Carroll Ave. between State Highway 114 and 31 Southlake Boulevard. He would like to see it addressed on the Master Thoroughfare Plan as a 32 divided four lane road instead of a five lane arterial. He feels there should be a softer transition 33 between his neighborhood and the new Southlake Town Center going in across the street. He 34 understands that a four -lane divided would be cheaper to construct. 35 36 Dale Clark, President of Coventry Manor Homeowners Association, addressed the issue of 37 Turnberry Lane and Coventry Drive which extend through Coventry Manor. He stated that they are 38 getting a tremendous amount of through traffic. Many people use this road as a faster route to get 39 their children to school. 40 41 Chris Miltonberger, 1401 Exeter Court, Southlake, Texas, stated that Coventry Drive and Turnberry 42 Lane are large, wide open streets which allow traffic to travel very fast down them. He is very concerned about the speed and quantity of the traffic coming through this subdivision. He asked the Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 2 of 16 Commission to delete that portion of the street from the thoroughfare plan since it is already built. He stated that the houses were not built with enough setback for this volume of traffic. 3 4 Sandy Eddleman, 922 Turnberry Lane, Southlake, Texas, stated that she sold her house in Coppell 5 because her street was going to be turned into a thoroughfare. She did research through the City of 6 Southlake before she purchased her current home and found out that Highland Street was supposed 7 to continue on straight west to Peytonville Ave., not curve northward through Coventry Manor. She 8 asked the Commission to remove it from the Master Thoroughfare Plan in order to alleviate the 9 traffic through this subdivision. 10 11 Esther Spickler, 926 Turnberry Lane, Southlake, Texas, stated that she thinks Coventry Manor has 12 a great deal of commuter traffic going to work and who are in a tremendous hurry. She asked that 13 Turnberry Lane be removed from the Master Thoroughfare Plan. 14 15 Chairman Wright stated that the only thing the Commission has the capability of recommending is 16 for this street to stay on the Master Thoroughfare Plan or to not stay on the Master Thoroughfare 17 Plan. They do not have the capability to send the police somewhere or to add signage on streets. 18 19 Marjette Simmons, 1400 Ramsgate, Southlake, Texas, asked the Commission to remove Turnberry 20 Lane from the Master Thoroughfare Plan. She stated that because there is a great deal of new 21 construction in that area and the cement trucks and moving trucks are parked on the street, it is very dangerous with the speed of traffic moving down the street weaving in and out of the trucks. 24 Gavin Phillips, 911 Turnberry Lane, Southlake, Texas, stated that his eleven (11) year old son is not 25 allowed to cross the street without supervision because of the severity of the traffic situation. He 26 does not feel this is right. 27 28 Chairman Wright stopped to take a consensus of the Planning and Zoning Commission on their 29 feelings regarding this issue. He stated that he does not have a problem with removing Turnberry 30 Lane from the Master Thoroughfare Plan and asked the Commissioners if they did. He reminded 31 the public that this will not stop one single vehicle from traveling that street, but the residents can 32 address the safety issues with the city staff and with the City Council. 33 34 Linda Summit, 1504 Coventry Lane, Southlake, Texas, asked the Commission what she can do as 35 a resident to get another cut - through for Highland Street which would not go through this 36 neighborhood. 37 38 Chairman Wright responded by saying that maybe the Commission needs to look at that again, and 39 that the Commission is required by law to update the Master Thoroughfare Plan every four (4) years. 40 He told Ms. Summit that the Commission can amend the Plan at any time, though. Chairman Wright 41 asked city staff to put that issue back on the calendar to review again. 42 Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 3 of 16 Chairman Wright reminded the public that it will be the recommendation of the Planning and Zoning Commission to the City Council to remove Turnberry Lane from the Master Thoroughfare Plan. The 3 final decision will be the City Council's. 4 5 Art Sorenson, 1201 Oakhurst Court, Southlake, Texas, addressed the letter that went out to residents 6 entitled, "Do You Want To See 1709 In Your Backyard ?" He disputed the fact that White Chapel 7 Blvd. and Continental Blvd. are going to be made into the same type of thoroughfare as F.M. 1709 8 is today. He stated that Continental Blvd. has been depicted on the Master Thoroughfare Plan as far 9 back as 1972 as it is today with an 84' right -of -way (R.O.W.). He said that the impression he is 10 receiving is that the proposed Master Thoroughfare Plan intends to widen the R.O.W. on Continental 11 Blvd. which is not the case at all. He stated the Master Thoroughfare Plan is addressing the type of 12 road needed at build -out some years in the future, not today. 13 14 Monte Ford, 805 Potomac Place, Southlake, Texas, asked the Commission to please remove 15 Continental Blvd. from the Master Thoroughfare Plan as a five (5) lane road. He stated that there 16 are approximately 210 mature trees and another 240 immature trees along Continental Blvd. He said 17 there are several points on Continental Blvd. in which he measured and do not appear to have 18 enough room for five (5) lanes. He asked the Commission to remove Continental Blvd. as a five (5) 19 lane road on the Master Thoroughfare Plan. He said he does not feel this road has enough traffic to 20 warrant being expanded to a five (5) lane road, but he does believe that "if you build it, they will 21 come." Sherry Berman, author of "Do You Want 1709 In Your Backyard ?" 818 Parkdale Drive, Southlake, 24 Texas, thanked the Commission for their hard work on the Master Thoroughfare Plan. She also 25 apologized to city staff for any hysteria that this article may have caused. She believes that it is 26 necessary to leave it on the Master Thoroughfare Plan as a five (5) lane road for future development 27 in order for the city to obtain R.O.W., but she does not want it built any time soon at all. 28 29 Chairman Wright stated that the only legal way for the city to obtain the R.O.W. is for it to be shown 30 as it is on the Master Thoroughfare Plan. If it is not shown on the Master Thoroughfare Plan, the 31 city cannot require future developers to dedicate the R.O.W. He stated that just because the Master 32 Thoroughfare Plan shows five (5) lanes, does not mean that it will necessarily be five (5) lanes when 33 it is built; the City will look at that again when the time comes. Chairman Wright also said that 34 Continental Blvd. could be a four (4) lane road instead, but the Commission felt it was safer to have 35 a continuous, middle turn lane. 36 37 Ms. Berman asked if Continental Blvd. is shown as a five (5) lane road with off -road and on -road 38 hike and bike trails. Director Last stated that is a true statement, but that there are areas in which the 39 parkways will be constrained. Ms. Berman asked if it was true that the surveyor made a mistake 40 and that there is not enough room for these trails across from Chimney Hills Subdivision. Chairman 41 Wright stated that is true. 42 Jeffrey Chinworth, 904 Chimney Hill Trail, Southlake, Texas, stated that virtually all of the Timarron neighborhoods are already built -out and there is not a traffic problem now. He said that by widening Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 4 of 16 Continental Blvd., the City of Southlake will be serving neighboring cities more than their own citizens. He said the City of Southlake would best be served by removing this from the Master 3 Thoroughfare Plan. 4 5 Tony Carosa, 500 Vicksburg Way, Southlake, Texas, stated he does not believe Southlake's tax 6 dollars should be spent by serving surrounding communities which is exactly what would occur if 7 Continental Blvd. is widened. 8 9 Mike McCormick, 115 Stonewood Court, Southlake, Texas, is concerned because the pool for his 10 subdivision is located across the street on Continental Blvd. This is already an unsafe situation as 11 it is today. Continental Blvd. actually goes through his neighborhood. 12 13 Robert Omudy , 919 Midland Creek Drive, Southlake, Texas, said that his children also have to 14 cross Continental Blvd. in order to get to the pool. He doesn't think the City of Southlake should 15 be serving surrounding communities which is what would be happening if Continental Blvd. is 16 widened. If the road eventually needs to be widened, then let the residents come to the city; the city 17 should not be telling the citizens it needs to be widened. 18 19 Louis Huie, 709 Windsor Creek, Southlake, Texas, said that his house backs up to Continental Blvd., 20 and he is extremely concerned about his property value decreasing. He also believes that "if you 21 build it, they will come." Michael Boute, 716 Ashleigh Lane, Southlake, Texas, spoke in behalf of SPIN Neighborhood #9 24 Representative, Laura Miklosko, who could not be present. She has received countless calls from 25 concerned residents in the subdivisions surrounding Continental Blvd. They have expressed to her 26 the following concerns: safety, crime, property values, noise, pollution, division of the community 27 of Timarron, and the killing of many trees. Mr. Boute stated that the Commission should consider 28 the quality of life for the people in the Timarron communities. 29 30 Lee Roe, 1109 Longford Circle, Southlake, Texas, stated that Continental Blvd. is a residential 31 street, and he does not want to see widened. 32 33 Mark Whitsman, stated that Timarron is a group of villages and Continental Blvd. is a central point 34 for those villages. He indicated that to widen Continental Blvd. would be destroying the quality of 35 life for the surrounding residents. 36 37 Dana Comfort, 604 Vicksburg Court, Southlake, Texas, was concerned about property values and 38 the safety of children. She would like to see the quality of life in Southlake stay the same as it is 39 today. 40 41 Dale Tomlin, 1203 Oakwood Trail, Southlake, Texas, stated his concern about property values and 42 the safety of children. His children travel this road often to go to their friends' houses, and if it was widened, they could no longer do that. Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 5 of 16 Dave Aurzada, 1204 Scenic Drive, Southlake, Texas, stated that as long as Continental Blvd. goes L from nowhere to nowhere, there is only so much traffic that will want to use it. It would primarily 3 be used by the people that live on it. He would like to see it completely removed from the Master 4 Thoroughfare Plan. 5 6 Ashok Agnihotri, 115 Yale, Southlake, Texas, stated that he took about one (1) year to decide where 7 to move his family when he decided upon Southlake. He believed Southlake to be the premier area 8 in the metroplex. He believes in the old saying, "if it ain't broken, don't fix it." He does not think 9 Continental Blvd. needs to be widened. It is a residential street right now and if it is increased to five 10 (5) lanes, it will no longer be a residential street. He is not concerned about losing money on his 11 house, but he is concerned about the City of Southlake losing its reputation. 12 13 Ronnie Kendall, SPIN liaison Representative for Bent Creek, stated her concern about encouraging 14 developers to come by expanding Continental Blvd. She feels that increasing it to five (5) lanes, 15 Southlake will be opening up the door to commercial and retail development along Continental Blvd. 16 17 Tom Knighthardt, 715 Windsor Creek Drive, Southlake, Texas, does not think a five (5) lane 18 highway should be placed right in the middle of one of Southlake's premier areas to live. He thinks 19 by doing so will adversely affect prospective residents as they look at this community. He asked the 20 Commission to please remove Continental Blvd. from the Master Thoroughfare Plan. He stated that 21 the minute the City Council approves the Master Thoroughfare Plan, he will put a "For Sale" sign in his front yard because he feels that this expansion would be that serious. 24 Rob Wilcockson, 609 Winding Creek Court, Southlake, Texas, asked Mr. Hoffman what the current 25 traffic count is on Continental Blvd. between White Chapel Blvd. and Davis Blvd. Mr. Hoffman 26 responded by saying about 4,200 vehicles per day. Mr. Wilcockson then asked Mr. Hoffman what 27 the maximum number of vehicles a two (2) lane road could facilitate. Mr. Hoffman said about 28 8,500 -9,000 vehicles per day. Mr. Wilcockson said he would rather deal with increased traffic than 29 the expansion of Continental Blvd. 30 31 Debra Graves, 808 Elmbrook Court, Southlake, Texas, asked the Commission if a decision will be 32 made on this issue tonight. Chairman Wright stated that he did not know because deliberation 33 between the Commissioners had not begun yet. 34 35 Jean Schwinn , 505 Vicksburg Way, Southlake, Texas, stated that when she bought her home, she 36 thought Continental Blvd. would stay the same. She does not understand why a city would place 37 a freeway in the middle of prime residential real estate. She asked the Commission to remove 38 Continental Blvd. from the Master Thoroughfare Plan. 39 40 Ken Countess, 712 Ashley Lane, Southlake, Texas, has recently moved to Southlake from South 41 Florida. He was very disappointed to learn that Continental Blvd. is under consideration to be a five 42 (5) lane road. With the schools along this road, he does not understand why the city would increase the number of lanes. He is very concerned about the safety of his children. Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 6 of 16 Joe Pollock, 1226 Ridgewood Circle, Southlake, Texas, stated that there are eighty (80) homes in his subdivision, and seventy -nine (79) of them signed a petition of opposition to the plan to increase 3 Continental Blvd. to five (5) lanes. He asked the Commission to remove Continental Blvd. from the 4 Master Thoroughfare Plan. 5 6 Jill Roe, 1109 Longford Circle, Southlake, Texas, moved to Southlake four (4) months ago from 7 Cleveland, Ohio. She lived in Shaker Heights which is one of the most charming and most pristine 8 communities in the nation. She was drawn to Southlake because she had the same feeling about it 9 as she did for Shaker Heights. She would like to see this community to remain just as it is today. 10 11 Chairman Wright stated that he is hearing what the residents are saying, but he does not feel like it 12 is an option to remove it entirely from the Master Thoroughfare Plan. He does not think a 50' 13 R.O.W. is going to be sufficient in the future, and without it being on the Master Thoroughfare Plan, 14 that would be all the city could do. 15 16 Darlene Dusso, 803 Caroline Lane, Southlake, Texas, stated that the city would be giving people 17 from North Richland Hills a thoroughfare which would be through a residential area. Currently, 18 people from North Richland Hills are taking Davis Blvd. to F.M. 1709 and by leaving Continental 19 Blvd. on the Master Thoroughfare Plan, the city would be giving them one (1) more option. 20 21 Judy Collins, 1470 Bent Trail Circle, Southlake, Texas, asked the Commission to preserve the residential area they put there, which is Timarron. She asked them to please remove Continental Blvd. from the Master Thoroughfare Plan. 24 25 Scott Bennett, 800 Princeton Court, Southlake, Texas, doesn't think the traffic counts are correct 26 because they also count the temporary traffic such as dump trucks and construction vehicles. He 27 stated that after this area is entirely built out, there will not be as much traffic as there is today. 28 29 Chairman Wright stated that after hearing the comments tonight he feels the Commission is 30 obligated to table this item and to take another hard look at Continental Blvd. 31 32 George Runey, 909 Chimney Hill Trail, Southlake, Texas, asked the Commission to remove 33 Continental Blvd. from the Master Thoroughfare Plan. 34 35 Kamran Saadatjoo, 385 Highland Oaks Circle, Southlake, Texas, said that he thinks the citizens of 36 Southlake need to have a referendum. He asked the Commission to please leave Continental Blvd. 37 as it is today. 38 39 Chairman Wright asked city staff how long Continental Blvd. has been on the Master Thoroughfare 40 Plan as being at least a four (4) lane road. Director Last stated that the April 1988 Master 41 Thoroughfare Plan listed Continental Blvd. as a five (5) lane road. Chairman Wright stated that he 42 believes Continental Blvd. has been shown to be a four (4) lane road for approximately twenty -five (25) years. Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 7 of 16 Chairman Wright called for a recess at 9:20 p.m. L Chairman Wright called the meeting back to order at 9:40 p.m. 3 4 Karen Cienki, 803 Shadow Glen Drive, Southlake, Texas, stated that there was a meeting in April 5 or May at Bicentennial Park in the White Chapel Room regarding the Master Thoroughfare Plan 6 and there was a group of 15 -20 residents who spoke to the previous Planning and Zoning 7 Commission regarding their opposition to Continental Blvd. being on the plan. Chairman Wright 8 stated that was true, but since that time there has been countless public meetings regarding the 9 Master Thoroughfare Plan in which no residents have been in attendance. 10 11 Hal Greenburg, 700 Prince George Court, Southlake, Texas, stated that sometimes planners make 12 mistakes, and he suggested that maybe the planner made a mistake regarding Continental Blvd. He 13 asked the Commission how such a project as this would be funded. Chairman Wright stated that it 14 would be funded through a bond issue through the city which would be voted for by the citizens. 15 16 Ken Countess, 712 Ashley Lane, Southlake, Texas, stated that when the new school opens next year 17 on Byron Nelson Parkway, the traffic count will decrease significantly because there will be less 18 traffic to Carroll Elementary. He asked the Commission how a decision was made earlier in which 19 a street was removed from the Master Thoroughfare Plan. Chairman Wright stated that was a 20 consensus, not a firm decision and not a vote. 21 Jill Roe, 1109 Longford Circle, Southlake, Texas, asked why the developers did not tell the prospective home owners of the city's intention to widen Continental Blvd. She questioned why the 24 city did not inform homeowners about the widening of Continental Blvd. 25 26 Sherry Berman, 818 Parkdale Drive, Southlake, Texas, asked if the Commission can change their 27 minds about the R.O.W. needed after developers have final platted their subdivisions. Chairman 28 Wright stated that the fact that a developer has given the R.O.W. does not preclude the Commission 29 from changing their minds and doing something different. 30 31 Chairman Wright stated that in talking with city staff during the break, the date of January 6, 1997 32 was discussed as the date for a workshop which would mean this item would be tabled until the 33 January 23, 1997 Regular Planning and Zoning Commission Meeting. 34 35 Vice - Chairman Potter asked city staff if they could get him the number of lots that have been platted 36 in the City. He stated that the configuration of the building has changed since the original site plan 25 approval by the Commission and the City Council. Mr. Silverman stated that it was agreed with City 26 Council on the original site plan to double the plantings of canopy trees on the south side due to the 27 fact that the building did not meet the articulation requirements on that same side. He stated that he 28 has moved the driveway on Village Center Drive to the north of where it was originally located 29 because Home Depot and PetsMart have had this configuration before, and it worked well being on 30 the center property line. He asked for an exception to Staff Comment Item #7 to delete the 31 requirement that it be gated and to amend the masonry wall to 10'. 32 33 Commissioner Schroetke asked Mr. Silverman what size the canopy trees will be on the south side 34 of the building. Mr. Silverman stated they will be 3" caliper trees in the 8' - 12' range. She asked 35 Mr. Silverman to increase the size of the canopy trees from 3" to 4" or 5" in at least the first 36 plantings. Mr. Silverman committed to place 4" caliper canopy trees on all of the plantings on the 37 south side of PetsMart. 38 39 Commissioner Schroetke said that Mr. Silverman agreed to create a 6' berm on the area behind the 40 Kroger in Phase I of Village Center, and he has yet to do that. 41 42 Commissioner Edmondson asked Mr. Silverman the status of the large dirt pile on the PetsMart site. Mr. Silverman stated that they are very fortunate because it is a high quality dirt which can be used for landscaping and paving. Mr. Silverman stated that he talked to the contractor this past week Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 9 of 16 about determining exactly how much of this dirt they can use and how much can be hauled off. He z, stated that much of it will be removed within a month. Commissioner Edmondson stated her 3 concern about the suffocation of the large tree closest to the dirt pile. Mr. Silverman stated that the 4 tree now has a fence around it, and they are doing everything they can to save it. 5 6 Commissioner Schroetke asked Mr. Silverman about the problem with the lighting on the Kroger 7 site. He stated that he will inform his lighting people to take another look at it. 8 9 Chairman Wright opened the public hearing. The 41 property is bordered by the following thoroughfares: State Highway 114 on the north; Southlake 42 Boulevard (F.M. 1709) on the south; and North Carroll Avenue on the west. He addressed some concerns brought up at the work session earlier in the week. 12 He stated that there were concerns about the status of new trees once multi -deck car parking was 13 built. His solution to this would be to relocate or replace the trees elsewhere on the property. 14 15 Commissioner Edmondson asked Mr. Stebbins to please address the actual Concept Plan and not 16 the "vision" as is placed in front of the Commission. She stated that it is very confusing going 17 back and forth between the two plans. 18 19 Mr. Stebbins stated that they have created building envelopes in order to address concerns 20 regarding building setbacks. He distributed to the Commission a revised Concept Plan which 21 creates a building envelope which, in turn, restricts the size and use on each block. He said that the buildings are 150' back on all blocks facing F.M. 1709 and Carroll Ave. He purposely left the blocks facing State Highway 114 unrestricted because they intend to have larger users facing 24 that road. 25 26 Mr. Stebbins stated that he is the most unclear of the users on the two (2) centermost blocks and 27 would like to maintain the most flexibility in those two (2) areas. He also said he has purposely 28 left a greater rear setback on those two (2) blocks. These blocks will be among the last areas to 29 be developed. Commissioner Edmondson asked him what is the approximate acreage of those two 30 (2) blocks. Mr. Stebbins said that they are approximately 8.5 acres each. 31 32 Commissioner Creighton asked Mr. Stebbins if the space shown for the building envelope on the 33 Concept Plan includes any multi -deck car parking. Mr. Stebbins stated that parking structures 34 would be exempt from the building envelopes. 35 36 Chairman Wright asked Mr. Stebbins what the percentage of overall coverage is on this site, and Mr. 37 Stebbins said it is 60 %. Commissioner Creighton asked if the overall percentage of coverage 38 includes parking, and Mr. Stebbins said that it does. 39 40 Chairman Wright asked Mr. Stebbins asked how many levels the parking garages might be. Mr. 41 Stebbins stated that under their proposal, there is a 52' height limit. He would intend to build 3 42 levels over grade. Mr. Stebbins referred to David Schwarz regarding the type of materials that would be used in the parking garages. Mr. Schwarz stated that the height of a parking garage depends entirely on the structural system and the economics of structural systems changes from month to Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 11 of 16 month. It depends which system is the most economical at the time. The difference in height can L vary approximately 8' from system to system. Mr. Schwarz stated the maximum height for a three 3 (3) story parking garage including the parapet wall would be 50'. 4 5 Commissioner Creighton asked why the buildings on State Highway 114 aren't identified. Mr. 6 Stebbins stated that the potential users they are talking to are approximately 25, 000 to 50,000 square 7 feet which is what is shown on the vision, but until they identify the user, he would rather not lock 8 in an exact location on the Concept Plan. Commissioner Creighton said she has heard rumors that 9 a third large building is going to be located on State Highway 114. Mr. Stebbins stated that is not 10 true at the moment, but he would like to leave that option open. 11 12 Vice - Chairman Potter stated that he understood that all screening issues and landscaping would be 13 deferred to site plan, but he does not see that reflected in any of their documents. Frank Bliss said 14 that they have amended their original application, and that it is stated in Section 12 that landscape 15 planning be deferred to site plan approval. 16 17 Commissioner Tate asked if there will be multi -deck parking on all of the blocks except for the two 18 (2) large blocks fronting State Highway 114. Mr. Stebbins said the lot to the west which also fronts 19 State Highway 114, the eastern-most lot, and the southeast lot which fronts F. M. 1709 do not have 20 multi -deck parking. 21 Vice - Chairman Potter asked Mr. Stebbins why he left the "C -3" zoning on the bandshell park area on F.M. 1709. Mr. Stebbins referred to David Schwarz on this subject. Mr. Schwarz stated that he 24 originally thought this would be a great location for a bandshell park, but upon further study of the 25 level of traffic on F.M. 1709, he now feels this particular area would have too much noise to be 26 enjoyable. He and Mr. Stebbins have different views on this subject. He suggested to Mr. Stebbins 27 that he commit to having a bandshell park somewhere on this project, and that over time, the 28 Commission grant him the flexibility to move it where it is best suited. Mr. Schwarz also stated that 29 he would like to see the area where the bandshell park is now located closed in by another building 30 which creates a more intimate town square. He believes that if a developer allows too much to 31 happen in one place, nothing can happen. In its conception, he believes the bandshell park to be 32 crucial to the town square, but he sees it becoming too crowded eventually and would like to move 33 the bandshell elsewhere on the project. Mr. Stebbins feels that if the open space and bandshell park 34 are crucial to this project being passed, then they will dedicate it as open space. His preference 35 would be to dedicate it for a period of time, and then ten (10) or fifteen (15) years from now, have 36 the flexibility to move it to a more suitable location. Commissioner Schroetke asked Mr. Schwarz 37 if he has thought of where the bandshell might be moved someday. Commissioner Edmondson 38 stated that she would like to see the "C -3" zoning removed from the bandshell park and have it 39 dedicated as open space. 40 41 Commissioner Edmondson asked Mr. Stebbins if he made the point at the SPIN Meeting that this 42 drawing of Southlake Town Center was only a "vision" and probably not exactly how it will end up looking. Mr. Stebbins said he made it very clear to the residents that this plan was a ten (10) to fifteen (15) year build out, and that things could change somewhat over time. Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 12 of 16 Commissioner Creighton thinks that the point is being made about the green space and the bandshell park because this is one of the most beautiful properties in Southlake, and people want to see as 3 much green space on F.M. 1709 as possible. 4 5 Chairman Wright stated that he thinks it should be left up to the citizens using the bandshell park 6 to decide if it is too loud, and move the bandshell park to another location at that time. 7 8 Mr. Stebbins listed the exclusion from the "C -2" Local Retail Commercial District as Item #21 - 9 filling stations or service stations and the exclusions from the "C -3" General Commercial District 10 as: Item #10 - electrical and gas appliances and supply sales; Item #16 - lodges, sororities, and /or 11 fraternities; Item #18 - mortuaries, funeral homes, and undertakers; and Item #23 - plumbing and 12 heating appliances, repair and installation services. 13 14 Vice - Chairman Potter asked Mr. Stebbins how he plans on screening the Home Depot to the east of 15 this project. Mr. Stebbins said there is a tree line at the back of Home Depot which will help screen 16 the building from this site. Frank Bliss stated that there is a 25' strip of land that is owned by 17 Diamond Shamrock under which there is a pipeline and which will remain a green zone and Rialto 18 has a 15' bufferyard on that side which will create a distance of 40' minimum. Mr. Schwarz stated 19 that he doesn't think it is fair to penalize Mr. Stebbins because Home Depot built an ugly building. 20 21 Commissioner Creighton asked Zoning Administrator Karen Gandy what is a "dry goods store ". Ms. Gandy stated that is an old time store which sells clothing, fabric, shoes, etc. She would not classify a Wal -Mart as a dry goods store which would be significantly smaller in size. 24 25 Mr. Stebbins asked if Item #10 - electrical and gas appliances and supply sales would exclude a 26 Circuit City, Best Buy or Sears. The Commission decided that Item #10 was addressing propane 27 sales, not the other stores listed. Commissioner Creighton asked what Mr. Stebbins is thinking by 28 not excluding Item #17 - medical care facilities. Mr. Stebbins said that there might be a place where 29 an assisted living facility would be appropriate on this site. 30 31 Commissioner Creighton stated that without a more specific Concept Plan, it is difficult to eliminate 32 uses without considering which of these uses might be more appropriate in some areas than others 33 such as medical services. Chairman Wright asked if it would be appropriate to say that anything that 34 accommodated an overnight stay would require a Specific Use Permit. This would not be saying 35 that Mr. Stebbins could not rent a space to a doctor who would provide medical services, but without 36 the overnight stay. Mr. Stebbins agreed to that idea. 37 38 Chairman Wright asked Mr. Stebbins if he would be willing to articulate vertically the portion of the 39 parking garages which were exposed to the street in order to match the surrounding buildings. Mr. 40 Schwarz stated that he purposely tried to design this to where the parking garages were not 41 particularly visible from the street. He urges the Commission not to require Mr. Stebbins to spend 42 a huge sum of money "dressing up" the parking garages because that money will be taken from the overall project budget. Commissioner Edmondson asked Mr. Schwarz to show her on the "vision" Planning and Zoning Commission Meeting Minutes on November 21, 1996 Page 13 of 16 where the parking garages will be located and how they will be hidden. He agrees that parking garages on streets should be screened, not parking garages on private drives. 3 4 Commissioner Edmondson asked if Mr. Stebbins intends to have adequate security in the parking 5 garages, and he said that he definitely would and that is a crucial factor in leasing. 6 7 Chairman Wright clarified that at the beginning of development there would be parking lots and that 8 the parking garages would come at a later stage of development and Mr. Stebbins agreed. 9 10 If the new City Hall is put on this property, Chairman Wright asked Mr. Stebbins how much land 11 the city would acquire for that site. Mr. Stebbins said the land where the City Hall would be located, 12 the open space in front of it or the Town Square, and enough parking to allow per code that the 13 building would require. Chairman Wright then asked if the six acre open space on F.M. 1709 would 14 be dedicated to the city or retained by the developer. Mr. Stebbins said it would be dedicated open 15 space, and the city has not given an opinion regarding ownership. 16 17 Vice - Chairman Potter told Mr. Stebbins that once they get to the site plan stage, he will take another 18 look at the bufferyard on the east side of the property next to Home Depot. 19 20 Chairman Wright opened the public hearing. 21 Larry Mahan, 470 South View Trail, Southlake, Texas, is concerned about spillover lighting from this site, loud music coming from the bandshell park and annoying surrounding neighborhoods, and 24 the height of the parking garages. He asked the Commission to please take careful consideration up 25 front and to not make mistakes that can't be repaired. 26 27 Chairman Wright asked Mr. Schwarz if they will automatically build the parking garages as the 28 buildings are erected. He said absolutely not. The site self parks at one story, and due to the extreme 29 costs of parking garages, they will not be built at all until needed. 30 31 Chairman Wright asked what would happen if a block was completely built out all except for one 32 (1) building. He asked if they would go ahead and build the parking garages or if they would wait 33 for that one (1) building to be constructed. Mr. Schwarz also suggested something similar to the 34 following language to be added to their restrictions: No parking garage parapet shall above the site 35 line and eye height from the curb level of the adjacent R.O.W.
