"I am opposed to 12 the request because the City of Southlake has not provided adequate drainage for existing 13 subdivisions. To increase the run -off by allowing agricultural and open areas to be 14 developed without improvements in the drainage facilities endangers my home." 15 • Donald and Martha Reukema, 908 Shadywood Ct., Southlake, TX 76092, opposed. 16 "Increased traffic on Peytonville. Exit subdivisions to Davis. We were told when we bought 17 in Chimney Hill, Peytonville would remain two lanes." 18 Howard and Viola LaFevers, 1000 Shadywood Ct., Southlake, TX 76092, opposed to. "We • 19 are opposed to the zoning change: 1) Added congestion on Peytonville Road, 2) Potential to 20 change Peytonville from two to four lanes, 3) Further loss of rustic setting that drew us to 21 Southlake." 22 • Naomi R. I object to another 2 4 addition adding increased traffic flow on Peytonville." • Brandon and Kay Baker, 620 S. Peytonville, Southlake, TX. 76092, opposed, because of lot 26 sizes and not a smooth transition to larger acreage lots, loss of country atmosphere, 27 increased traffic, drainage, loss of trees. 28 29 A petition of opposition presented by Michael H. Lease, 370 South Peytonville, Southlake, TX 30 76092 was received with sixteen (16) signatures stating opposition to rezoning and platting. Fourteen 32 (14) of the respondents also signed letters which offered four (4) reasons for their opposition. 33 Briefly, these are: 34 1. The increased traffic that this proposed development will bring to South Peytonville is totally 35 unacceptable. The traffic is already at a dangerous level in the morning and afternoon. 36 2. Lots 2 through 7 should remain as platted to maintain the rural setting. Any change in this 37 original platting will upset the existing continuity. 38 3. Public safety vehicles may not have adequate access to this large of a development without 39 additional access roads. 40 4. Possible soils contamination due to years of questionable fuel, oil, and other hazardous 1 chemical storage and handling procedures need to be examined. 4 4 2 3 Mike Usseglio, 910 Shadywood, Southlake, TX 44 4, Martha Reukema, 908 Shadywood, Southlake, TX 45 Gloria Tarvin, 906 Shadywood, Southlake, TX Planning and Zoning Commission Meeting Minutes on August 8, 1996 Page 6 of 24 1 Cathy Thacker, 902 Shadywood, Southlake, TX 2 Al & Suzanne Spinks, 1413 Northridge, Southlake, TX 3 Howard LaFevers, 1000 Shadywood, Southlake, TX 4 Connie Harrell, 920 S. G. Allen 9 4 Survey, Abstract No. 18, Tract 2D as recorded on Page 1330 of Volume 9427 in the D.R.T.C.T. The property is located on north side of West Southlake Boulevard (F.M. 1709) and approximately 600' 26 northwest of the intersection of Randol Mill Ave. and West Southlake Boulevard (F.M. 1709). The 27 current zoning is "AG" Agricultural District. The requested zoning is "SP -2" Generalized Site Plan 28 District with "0-1" Office District in the back and "C -2" Local Retail Commercial District in the 29 front. The Owners are H.C. and Maxine Forester. The Applicant is Realty Capital Corporation. The 30 Land Use Plan indicates Low Density Residential and Mixed Use and 100 Year Flood Plain. The 31 Corridor Recommendation is Retail Commercial - F.M. 1709 (same as in CS, 0-1, C -1, C -2, C -3, 32 and B -1 districts) and Residential (any Single Family district). The property is in SPIN 33 Neighborhood #16. Twelve (12) written notices were sent to property owners within the 200' 34 notification area, and no responses have been received. 35 36 Richard Myers, Realty Capital Corporation, 210 Park Blvd., Suite 100, Grapevine, TX was present 37 to represent this item. He stated that he has amended his zoning request from straight "C -3" to "SP- 38 2" with "0-1" and "C -2" uses as per Staff Comments. He agrees with all Staff Comments, except 39 for the one comment regarding 500' between drives. He has moved his driveway as far to the west 40 of his property as possible and still does not quite have 500' spacing. He asked for a variance to this 41 requirement. 42 Planning and Zoning Commission Meeting Minutes on August 8, 1996 Page 14 of 24 1 Commissioner Schroetke questioned Mr. Myers about the species of trees on the property. Mr. 2 Myers stated that there are mostly native oaks, with some pecans and willows along the creek. He wants to keep the creek as natural as possible. 4 5 Vice - Chairman Potter asked the Applicant what type of tenant he is targeting for the "0-1" area of 6 the property. Mr. Myers stated he would be interested in any tenant listed in permitted uses for this 7 type of zoning, but agreed that radio recording, television broadcasting and heavy duplicating 8 services are not the businesses he is targeting. 9 10 Commissioner Edmondson questioned exactly how much work the applicant plans on doing in the 11 floodway. Mr. Myers said his main concern is retaining the water that comes off the roofs and 12 parking lots. 13 14 Chairman Wright opened the public hearing. 15 16 Robert Garner, 225 Timberline Lane, Southlake, TX was in favor. He stated that Mr. Myers had 17 promised him a 6' wrought iron fence with screening hedges between their two properties which is 18 approximately 540'. He is also in favor of the zoning change to "0-1" and thinks it is a much better 19 zoning than the original request of "C -3 ". He is also appreciative of the fact that the Applicant 20 intends to keep the group of trees on the northeast corner of the property. 21 22 Jim Bedgood, 220 Timberline Lane, Southlake, TX does not feel the property should be developed 23 as far back into the lot as proposed. He thinks it would eventually depreciate the value of the lots 7 4 in Timberline Estates. He also feels that it will create a traffic hazard as cars leaving this property attempt to merge into traffic on Southlake Blvd. (F.M. 1709) considering how close it is to the 26 intersection of Davis Blvd. 27 28 Ottis Collins, 224 Randol Mill Ave., Southlake, TX was in favor. He likes this site plan and hopes 29 the commission approves it. 30 31 Commissioner Potter asked the Applicant if he intends to have any two -story structures on this 32 property, and Mr. Myers stated he did not. 33 34 Commissioner Edmondson asked the Applicant approximately how many trees in the northeast 35 corner area of the concept plan he intends to keep. Mr. Myers stated that he cannot actually commit 36 to a specific number of trees tonight, but if trees do in fact extend as far out as shown on the concept 37 plan, he will commit to saving those trees. 38 39 Chairman Wright closed the public hearing. 40 41 Motion was made to approve ZA96 -85, Rezoning and Concept Plan for Stone Bridge Park subject 42 to Staff Review Letter dated August 2, 1996 deleting items #8 and #6A, adding a fence between this 43 property and the Garner's property, preserving the general outline of trees, removing the ability to 44 lease to radio recording, television broadcasting and heavy duplicating services, limiting the Planning and Zoning Commission Meeting Minutes on August 8, 1996 Page 15 of 24 1 buildings to one story, and reworking the public roads and cul -de -sacs to reduce the amount of 2 concrete. 3 4 Motion: Potter 5 Second: Murphy 6 Ayes: Potter, Murphy, Schroetke, Tate, Wright, Edmondson 7 Nays: None 8 Approved: 6 -0 9 Motion carried. 10 11 (Planning and Zoning Meeting, 08- 08 -96, tape 1, section #1595) 12 13 AGENDA ITEM #17, ZA 96 -86, SITE PLAN FOR ROCKENBAUGH ELEMENTARY SCHOOL: 14 Planner Chris Carpenter informed the Commission that the Applicant's request is for a Site Plan for 15 Rockenbaugh Elementary School which is approximately 15.357 acres situated in the O.W. The applicant has 27 provided a driveway throat depth of 50' for each driveway intersecting Byron Nelson Parkway. 28 29 Brent Kline, Total Program Management, Inc., 128 E. Texas Street, Southlake, TX discussed the item 30 listed above and explained how they have provided a lane for stacking inside the property which 31 would greatly reduce the stacking on Byron Nelson Parkway. He feels this lane addresses the city's 32 primary concerns. 33 34 Chairman Wright opened the public hearing. No one in the audience stepped forward to speak. 35 Chairman Wright closed the public hearing. 36 37 In regard to Staff Comment #15, Mr. Cheatham asked whether the front sidewalk was to be four foot 38 or six foot in width. Vice - Chairman Potter stated that the Trail System would call for it to be a six 39 foot trail if it is indeed along the Trail Master Plan. Mr. Cheatham said that if the Trail Master Plan 40 designated it as a six foot sidewalk then he would comply with that request. 41 42 Motion was made to approve ZA96 -86, Site Plan for Rockenbaugh Elementary School subject to 43 Staff Review Letter dated August 2, 1996 deleting Item #5. 44 Planning and Zoning Commission Meeting Minutes on August 8, 1996 Page 16 of 24 1 Motion: Murphy 2 Second: Tate 3 Ayes: Schroetke, Tate, Murphy, Wright, Potter, Edmondson 4 Nays: None 5 Approved: 6 -0 6 Motion carried. 7 8 (Planning and Zoning Meeting, 08- 08 -96, tape 1, section #2006) 9 10 AGENDA ITEM #19, ZA 96 -87, REZONING: 11 Planner Chris Carpenter informed the Commission that the Applicant's request is for the rezoning 12 of approximately 1.51 acres situated in the A.A.
