WPD REGULAR PLANNING AND ZONING COMMISSION MEETING OCTOBER 5, 1995 MINUTES COMMISSION PRESENT: Chairman Joe Wright; Vice - Chairman Ernest Johnson; Members: Randy Arnold, Arthur Hobbs, Rex Potter, and Dona Schroetke COMMISSION ABSENT: Jim Murphy CITY STAFF PRESENT: Planner Tom Elgin and Secretary Laurie Sheets The meeting was called to order by Chairman Wright at 7:05 p.m. Agenda Item #2. Approval of Minutes Vice - Chairman Johnson commented that on page 7, ZA95 -90, Site Plan, motion for approval, item #2, the sentence needs to be rearranged. Motion was made to approve the minutes of the Planning and Zoning Commission Meeting on September 21, 1995 as amended. Motion: Johnson Second: Hobbs Ayes: Wright, Johnson, Arnold, Hobbs, Potter, and Schroetke Nays: none Approved: 6 -0 (Planning and Zoning Meeting, 10- 05 -95, tape 1, section #0 -121) Agenda Item #3, Administrative Comments Commissioner Potter commented to the Staff that there is a conflict in determining the density of dwellings between the Land Use Plan (uses "net versus gross ") and the Zoning Ordinance No. 480 (uses "gross versus net "). He recommended for Zoning Ordinance No. 480 and Land Use Plan to be consistent in the determining the density of dwellings. Planner Tom Elgin commented that they have two different standards in which they determine the density. Vice - Chairman Johnson recommended not to revise the ordinance until the next review of the Land Use Plan. The property is located at 1835 N. Peytonville Ave (on the east side), approximately 2100 feet South of West Dove Road. The current zoning is "AG" Agricultural District, and the requested zoning is "SF -1A" Single Family Residential District. The Land Use Plan is Low Density Residential. The Owners and Applicants are Carleo and Regina Capili. Ten (10) written notices were sent out to property owners within the 200 feet notification area, and the Staff has not received any written response. Carleo Capili, 914 Raven Court, Southlake, Texas 76092, was present to represent this item. Mr. Capili stated to the Commission that his intention for the rezoning request is to build another residence on the property. Chairman Wright opened the public hearing. No discussion from the audience. Chairman Wright closed the public hearing. Motion was made to approve ZA95 -98, Rezoning Request from "AG" Agricultural District to "SF- 1 A" Single Family Residential District. Vice - Chairman Johnson asked for Staff clarification on the lot numbers of the Plat Showing. Planner Tom Elgin commented that the Staff bases the naming of Plat Showings by using the survey name the tract is in for the addition name with the lot numbers assigned in sequence. Lot 1 (Fahrenbrook tract) is immediately to the north of the property. Vice - Chairman Johnson asked for the dimensions of the two lots at the right -of -way, building line, and along the "dog -leg" of the property. Planner Tom Elgin stated the dimensions are not indicated on the plat. He stated that the lots were sized to meet the 100 feet lot width requirement. Vice - Chairman Johnson commented on item #9C (Lot 3 does not meet the intent of the 100 feet minimum lot width) on the Plat Review Summary No. 1 dated September 29, 1995. Planner Tom Elgin commented that the "dog -leg" does not meet the intent of the requirement. Vice - Chairman Johnson asked the Staff for clarification on the tract location; the Vicinity Map shows the tract being north of Plantation and the Tract Map shows the tract being adjacent to the edge of Plantation. He recommended that the Applicant's Surveyor reflect a concise tract location on the vicinity map. Chairman Wright asked the Staff about item #7B (provide a 10 feet Utility Easement centered on the existing utility line(s) crossing the site) on the staff review letter. Planner Tom Elgin commented that an existing electrical line crosses one lot to service the lot. The City requires all utility lines that cross a property to be placed in a Utility Easement or that the Applicant furnish a letter from the electrical company stating that they will relocate the service into one lot. This requirement will be beneficial to the two lots, if they have different ownership in the future. Carleo Capili, 914 Raven Court, Southlake, Texas 76092, was present to represent this item. Chairman Wright asked Mr. Capili if he had an opportunity to review the Plat Review Summary No. 1 dated September 29, 1995. Mr. Capili commented that he had not had an opportunity to review the letter because he had not received a copy. It was determined that a proper mailing address was not provided. The Commission recommended that the Applicant note dimensions on the plat, and the Commission would probably delete item #9C on the staff review letter. Mr. Capili requested to table the Plat Showing to give him sufficient time for revisions. The Commission recommended that the Staff, Applicant, and Applicant's Surveyor work together on the items of the staff review letter that need to be addressed. Motion: Hobbs Second: Arnold Ayes: Wright, Johnson, Arnold, Hobbs, Potter, and Schroetke Nays: none Approved: 6 -0 (Planning and Zoning Meeting, 10- 05 -95, tape 1, section #937 -2668) Chairman Wright called for a recess at 7:50 p.m. Chairman Wright reconvened the meeting at 8:02 p.m. Agenda Item #6, Revisions to Subdivision Ordinance No. 483 -D Planner Tom Elgin presented the Commission with some examples of curvilinear design in platted subdivisions for discussion on agenda item #6, Revisions to Subdivision Ordinance No. 483 -D. Planner Tom Elgin informed the Commission that a consensus had been reached on the proposed revisions except for section 5.03(A)2 -4 regarding curvilinear design. He presented plats of various existing subdivisions that have curvilinear design. He stated that the current zoning ordinance has the following general curvilinear requirements: 1) One acre lot additions are excluded, 2) Subdivisions 10 acres or less are excluded, and 3) Only 50% of lots are required to be curvilinear. Vice - Chairman Johnson recommended for the Staff to inform the "development community" on the standards for curvilinear design. (Planning and Zoning Meeting, 10- 05 -95, tape 1, section #2670 -7062) REGULAR PLANNING AND ZONING MINUTES OCTOBER 5, 1995 PAGE 5 The Commission recommended the following curvilinear standards: 1) keeping the 800 feet radius street center line standard, 2) counting lots on cul -de -sac fronting from the radius point to 500 feet along the center line, and 3) for cul -de -sacs that align reducing the distance to 250 feet. The Commission recommended the following % of lots to be curvilinear: Gross 10+ to 20+ to 30 30+ to 40+ to 70+ acres Acreage 20 acres acres 40 acres 70 acres Minimum % 30% 35% 40% 50% 60% Curvilinear The Commission recommended comparing these percentages to existing platted properties, especially platted subdivisions over 70 acres, for example, the Highlands and the Dominion. Look at the items in the 50% bracket. Chairman Wright opened the public hearing. No discussion from the audience. Commission's recommendations: 1) delete 5.04(B)2, 2) verify frontage requirements in 5.04(B)3, 3) delete 5.04(B)4, 4) 5.04(C) change the words "will be denied" in the first paragraph to "may be denied ", 5) 5.04(C)7 add "Equestrian Trails" and delete the words "or cross ", 6) 5.04(D)2 delete the word "concrete" from the second sentence, 7) 5.04(D)3 add a cross - reference to the homeowner's association in a different location or rearrange sections in the revisions, 8) 5.04(D)5, 6 add the word "prior" to sections mentioning written consent, 9) 5.04(E) change the title and relocate it to the front of the document, 10) 5.04(E)1 verify the timing when the private streets need to be transferred from the developer to the Homeowner's Association, 11) 5.04(E)2 delete the reserve fund section, 12) 5.04(E)4 clarify research on the "hold harmless" section, 13) 5.04(F) research the reason for difference of: a) 80% from private to public vote in subsection 1 b) 100% from public to private vote in subsection 2, and 14) 5.04(F)2 delete this section.
