Community Development Director, Greg Last, commented that information pertaining to the

included in the Commissioners' packets. He also advised the Commission that a meeting regarding
the trails system would be held on Monday at City Hall if members wished to attend.
Agenda Item #4, ZA 95 -01 Rezoning Request
Chairman Wright stepped down and Vice - Chairman Lanny Tate presided over this item.
Zoning Administrator, Karen Gandy, informed the Commission that the Applicant's request is for
rezoning of 9.494 acres situated in the H. Granberry Survey, Abstract No. 581, Tract 111. The
location is on the West side of S. White Chapel Blvd., midway between W. Southlake Blvd. and W.
Continental Blvd., South of Lake Crest Addition and North of Princeton Park Addition. The Current

Agenda Item #5, ZA 95 -02, Rezoning Request
Zoning Administrator, Karen Gandy, informed the Commission that the Applicant's request is for
Rezoning of 16.63 acres situated in the R.D. Price Survey, Abstract No. 1207, Tract 2C. The
location is North of Quail Creek Estates Addition and adjacent and West of Harbor Oaks Addition.
The Current Zoning is "AG" Agricultural and the Requested Zoning is "SF -1A" Single - Family
Residential District. The Land Use Category is Low Density Residential. The Owner is Peggy H.
Denton and the Applicant is H. Creek Development. The property is located in SPIN
Neighborhood #3. Seventeen written notices were sent out (two more than should have been sent).
Five written responses were received within the 200' notification area opposed and one written
response was received from outside the 200' notification area undecided.
Mr. Last explained the limitations of the flowage easement. He also advised the Commission and
the audience that an exhibit showing a conceptual plan for the development of the property was
given to Staff just before the meeting and the Applicant would address this exhibit in his
presentation.
Tom Mathews, President of H.Creek Development, was present to represent this item.
Mr. Mathews stated they chose to bring the zoning request before the Commission without a plat to
get a feel for what they will eventually decide to do with the property. The exhibit shown is only
a conceptual drawing of what could be done with the property and Mr. Mathews wishes to focus on
the zoning aspect tonight. It is recognized that this piece of property is unique and the Applicant
wants to work with the homeowners of Harbor Oaks to reach solutions to their mutual interests such
as a bridle path, the lots sizes, and access to the Corp property. Currently Harbor Oaks residents
have no formal right to cross this property to get to the Corp property. Mr. Mathews commented

that he has met with City Staff and is aware of restrictions regarding septic and flowage of water.
Plans are for a soft development with a rural character with curvilinear streets to maintain as many
trees as possible. Access to the Corp property through this property, preferably tying into the bridle
path, will be provided to the residents of Harbor Oaks. The path will be complimented to meet the
property lines and match what has been done through Harbor Oaks, being a 20' easement.
Building restrictions will maintain the rural character; there will be no stockade fences; a minimum
3200 sq ft. living area will be required; and there will be strict architectural controls. Mr. Mathews
asked the Commission to please grant this zoning request which is consistent with the neighboring
"SF -1A" Single - Family Residential zoning.
Public Hearing
Rod Zielke, 1090 Burney Lane, stated this property is unique due to its proximity to the Corp land.
He wants to see two acre lots on this property to coincide with Harbor Oaks. If "SF-1A" is approved
without a Concept Plan, homeowners of Harbor Oaks cannot be sure what the developer will do with
the property.
Chris Packard, 875 Harbor Ct., is opposed for the same reasons as Mr. Zielke. There is no plat and
he feels that a zoning request and a plat should go hand in hand. Once "SF -1A" zoning is approved,
the developer is not bound to do anything other than provide one acre lots, which will not be
compatible to Harbor Oaks. Mr. Packard stated there has been no contact with the developer to
work out anything.
David Alexander, 904 Quail Creek Ct., agrees with the two previous speakers. He, also, would like
to see what the developer proposes.
Mr. Last explained length requirements as established in the Subdivision Ordinance for a cul -de -sac
and advised the Commission that there is currently no equestrian easement crossing this property
now.
Chairman Wright commented that a significant amount of time has been spent discussing this
particular piece of property in the past and nothing could be worked out. He stated he is in favor of
this zoning, however, in all fairness to the homeowners, a plat that will adhere to the property
should be presented to the Commission before it considers a recommendation. With all the history
associated with this property, meeting with the homeowners and working out a happy medium is
probably the best course to follow at this time.
Commissioner Arnold stated that Harbor Oaks is "SF -1A" and she has no problem with this property
having the same zoning. Commissioners Hobbs and Murphy want to see a more detailed plan
presented.
Mr. Mathews said he would meet with the homeowners and come back before the Commission in
two weeks and present a Concept Plan.

Mr. Last discussed the various thoroughfare issues regarding new Carroll Ave. with the
Commission, including points of access into the development. He advised that at this time, Staff
does not know the planned status of new Carroll Ave.
Art Clayton, 3129 Lake Drive, was present to represent the Applicant South Hollow, Ltd. on this
item.
Mr. Clayton stated he had no problems with any comments on the Plan Review Summary down to
5D. He stated he would like to continue under the assumption that new Carroll Ave. will go in and
if it does not, that they not be made to donate the turn lane and the additional 10' at the time of Final
Plat. Mr. Last explained this comment and turn lanes more clearly to the Commission in addition
to discussing transition lanes.
Commissioner McGarity brought up comment #7 regarding the deletion of the North street stub
connecting Carlisle Lane. Mr. Clayton commented that the property owners would like to limit
access and limit the number of cars going through the development.
Commissioner McGarity commented that limiting access and forcing entry and exit from F.M.1709
is creating additional bottlenecks in subdivisions in Southlake.

Janice Miner, 860 Carlisle, commented that she is concerned with three subdivisions going in and
being surrounded by fences. She is concerned with theft and with increased traffic and safety.
Juanita Peters, 840 Carlisle, said three subdivisions are just too much and asked why they had to be
developed all at once.
Vice - Chairman Tate answered and said the property owners have the right to develop their property.
Alternative entrances to funnel traffic were discussed and it was suggested to connect Avondale Ct.
to Rainbow Street.
Carl Miner, 860 Carlisle, commented that he Versailles project (which is one of the three
developments going in next to his property) has been up in the air and dragging on for almost ten
months and the new Carroll Ave. alignment issue has been the main reason for all of the delay. He
said that John Dickerson has recently contacted him and said that in the last week he has talked with
the Mayor and City Council members, and now the mayor is asking why do we even need a new
Carroll. Mr. Miner said it made no sense why this question was raised after ten months of
discussion. He suggested that the Planning and Zoning Commission and the City Council get
together and communicate better to simplify these types of situations. This has caused much
heartache and loss of sleep for all concerned.

Summary dated February 3, 1995, amending item 5D to provide a 12' x 150' transition right -of -way

notices were sent out and two written responses were received within the 200' notification area in
favor and three responses were opposed. Ms. Gandy also stated that item 10C on the Plat Review
Summary regarding perpendicular lot lines should be amended and these were discussed with the
Commission. Mr. Last addressed the overlapping 5' utility easement with the 20' Diamond
Shamrock easement.
Art Clayton, 3129 Lake Drive, was present to represent the Applicant South Hollow, Ltd.
Mr. Clayton stated that Staffs comment 7E on the Plat Review Summary calls for a 12' x 300'
dedication on Continental and Mr. Clayton is asking for a 12' x 150' dedication. He said that lot
lines will be worked on and when Avondale is extended North, rectangular lots will front on
Avondale and lot line changes will occur. Also item #14 will be changed to a public landscape
easement.
Staff, the Applicant and the Commission discussed bufferyard areas, common areas and public
landscape easements over bufferyards. In this case the lot lines extend to the right -of -way and the
fence is 10 feet from the right -of -way. The homeowner owns the area outside the fence to the right -
of -way, however, this bufferyard area becomes a public landscape easement maintained by the
homeowners. Several of the Commissioners were concerned with the homeowners liability outside
of the fence and with the homeowners maintaining the property outside the fence. Mr. Clayton
stated there would be no Homeowners Association to maintain this area but that the deed would
specify the requirement. Mr. Clayton said he needs to incorporate the area outside of the fence to
maintain the lot sizes.
Mr. Last read the definition of a Public Landscape Easement.
Public Hearing.
No one in the audience spoke to this item.
Discussion regarding easements on the South property line and continuation of a masonry fence were
addressed. Further discussion regarding the public landscape easement resulted in Mr. Clayton
agreeing to a Homeowners Association to maintain the area.
Members of the Commission suggested to the Applicant that a preliminary plat with changes
reflected in the discussions and comments on the Plat Review Summary be submitted before they
make a recommendation on this item.

Commissioner Murphy made a motion to Deny the request, and after further discussion by the
Commission, he withdrew his motion.

the Preliminary Plat of Lots 1 and 2, Block 1, Yates Corner Addition, being 3.701 acres situated in
the Francis Throop Survey, Abstract No. 1511, Tracts IAA, lE and 1E1. The location is the
Northwest corner of N. Kimball Ave. and E. Dove Street. The Current Zoning is "SP -2" Generalized
Site Plan District. The Land Use Category is Mixed Use. The Owner /Applicant is Rickey
McPherson. The property is located in SPIN Neighborhood #5. Eight written notices were sent out
and no written responses were received within the 200' notification area. Ms. Gandy clarified that
Lot 2 is zoned "C -1" and discussion regarding 40' versus 30' building lines were addressed.
Rick McPherson, 1900 Dove Road was present to represent this item.
Mr. McPherson stated that his surveyor has researched and found no official markings for Torian
Lane and said that he has maintained Torian Lane for 16 years. He explained that he has a utility
easement running through his property and the 30' building line on Torian Lane to the South of the
utility easement will affect the total number of buildings he plans on Dove Rd. He does not have
a problem with a 30' building line on Torian Lane to the North of the utility easement and he does
not have a problem with ROW dedication for Kimball Ave. He is aware of the 17' ROW dedication
for Dove Rd., however, if the City requires more ROW dedication for Dove Rd., and with the 30'
building line on Torian Lane South of the utility easement, a large piece of his property will be
affected and the original building proposed on the previous Concept Plan will not fit.
Mr. Last stated that a survey on the plat shows that Torian Lane is filed and provides access to
several lots North of Mr. McPherson's property and to property to the West. Mr. McPherson stated
he has no argument that there is a Torian Lane, he is simply saying that it has never been maintained
and it would only be accessible to someone with a tractor. It is for this reason that he has the
problem with the 30' building line requirement.

Ron Weller, 1721 W. Plano Pkwy, Suite 131, Plano, was present to represent the Applicant,

Mr. Weller stated he is in agreement with the amended comment 9D, however, he is not in
agreement with 7C regarding the 84' ROW extending the entire West property line. He said the plat
is consistent with the Thoroughfare Plan and shows 84' at F.M.1709 and Peytonville Ave. tapering
to a 64' transition. Mr. Weller discussed the transitioning of R.O.W, location of entrances, and
common access easements with the Commission. He stated that a berm and landscape will cover
the ditch pipe in the back and the landscape will act as a sound buffer to the homes behind the site.

The Commission discussed final revisions of Ordinance No. 506 -A, amendments to Sign
Ordinance No. 506 with Mr. Last. Chairman Wright asked if the audience had any comments and
there were none. The Public Hearing was closed.
Motion was made to forward Ordinance No. 506 -A, amendments to Sign Ordinance No. 506, with
modifications to the City Council meeting to be held on February 14, 1995.
