Don Plunk, 5485 Beltline Road, Dallas, was present to represent the Applicant, Versailles, Ltd., on this item. Mr. Plunk stated that this item had been tabled from the September 22, 1994 Planning and Zoning meeting so that concerns could be addressed with the neighboring property owners and with the issue of the realignment of Carroll Ave. He informed the Commission that it is the intent of Versailles, Ltd. to move forward with this request, however, there is no final revision to the plan as yet. He stated that three properties are now under contract and pending further discussion, and that Versailles' intent is for the location of Carroll Ave. to correspond with the Thoroughfare Plan. He respectfully asked that this item be tabled to the December 8, 1994 Planning and Zoning meeting to allow additional time to resolve the issues and bring forth a viable plan before the Commission. Mr. LeBlanc explained that Hanover Development Company owns property to the North which is already zoned "C -3" and they are trying to acquire several other properties adjacent and near this property to total an 18 acre site. Their plan is to assemble enough property to develop a large retail site. Depending on the acquisition of the various properties, they will either develop one large site or a combination of quality retail sites to fit the property acquired. Mr. LeBlanc stated he is aware of the Corridor Study and that he attended the most recent Public Meeting regarding the Study. Public Hearing. Karen LaBrand, 152 Stonegate Ct., Bedford, suggested that there were conflicts in the acreage according to the deeds on the property. Chairman Wright explained that the Commission was addressing the zoning for the property being described and presented by Staff tonight and that information on deed records could be discussed in a separate meeting with Staff. Rezoning and Concept Plan/Southlake Church of Christ Zoning Administrator, Karen Gandy, informed the Commission that the Applicant's request is for the Rezoning and Concept Plan for Southlake Church of Christ, being 4.007 acres of land situated in the J.G. Allen Survey, Abstract No. 18, Tract 5C2 and Tract 5C3 and Concept Plan approval of the existing Lot 3, J.G. Allen No. 18 Addition. The location is in the 2500 block of W. Southlake Blvd., approximately 450 feet West of Brock Dr. The Current Zoning is "AG" Agricultural and the Requested Zoning is "CS" Community Service District. The Owner /Applicant is Southlake Church of Christ. The property is located in SPIN Neighborhood #15. Nine written notices were sent out and one written response was received within the 200' notification area in favor. WPD Planning and Zoning Meeting October 20, 1994 Page 4 Commission of the neighbors' concerns of drainage, tree preservation, lighting issues and debris on the property. Ms. Gandy presented an overhead visual and showed the location where the new worship center will be built, and she pointed out the existing structures on the property. She stated that the existing house would be used for a nursery school and would need a Specific Use Permit to operate. In answer to Commissioner Johnson's comment on existing debris being removed, Ms. Gandy explained that if the existing debris is not cleaned up, Code Enforcement could get involved and if the matter is still neglected, it can be taken to Municipal Court and a fine imposed. John Logan, 221 Eastwood Drive, was present to represent the Applicant, Southlake Church of Christ, on this item. Mr. Logan stated that Ms. Gandy had given a very good summary of the request. He stated that the parking lot would be moved to save trees, that the metal barn on the west property line would be removed, and that any existing debris would be removed from the property and the area cleaned up. Chairman Wright asked about the lighting concerns and Community Development Director, Greg Last, explained that lighting issues are addressed at the Site Plan stage. Mr. Last provided Mr. Logan a copy of the Plan Review Summary dated October 14, 1994 and Mr. Logan was in agreement with all of Staffs comments. Public Hearing. Alan Peters, 322 Brock, commented that there were too many loose ends and he feels that the neighbors' concerns are not being addressed. He stated that the church property already drains onto his property and floods his garage, takes out his septic system, and that the air conditioning fans on the temporary building are loud. He is concerned that there will be more drainage problems with new construction and he is concerned that lighting from the parking lot will shine into his home. Mr. Last stated that the Engineering Staff will look at the drainage impact and evaluate any negative effect it has on adjacent property owners at the Site Plan stage. Lighting is also addressed at the Site Plan stage. Commissioner Johnson clarified that the rezoning request is for property to the West of the existing Church property and that some of the problems that the neighbors are encountering are from existing structures and circumstances. He asked if the entire picture could be looked at including new and existing problems. Mr. Last explained that the city could not commit to fix existing problems with new improvements but that every effort would be made to take the neighbors' concerns into account. Public Hearing Closed. The Commission discussed concerns addressed in writing from neighboring property owners and concerns introduced by Mr. Peters. The location is on the East side of S. Peytonville Ave. at 701 S. Peytonville Ave., being approximately 1/2 mile South of W. Southlake Blvd., and North of W. Continental Blvd. The Current Zoning is "AG" Agricultural and the Requested Zoning is "SF -1A" Single - Family Residential District. The Land Use Category is Medium Density Residential/100 -year Flood Plain. The Owner is Naomi R. Morrison and the Applicant is The Nelson Corporation. The property is located in SPIN Neighborhood #14. Fourteen written notices were sent out and two written responses were received within the 200' notification area in favor and one was opposed. One written response was received from the SPIN representative listing concerns. Commissioner Johnson asked if sewer was available or where the nearest sewer hook up is. City Engineer, Ron Harper, stated that he would need to check the plans to see if and where a stub was located. Chairman Wright commented that sewer was at least close enough that a lift station would get sewer to Chimney Hill. Helen -Eve Liebman, 5999 Summerside Drive, Dallas, was present to represent the Applicant, The Nelson Corporation, on this item. Ms. Liebman explained that this request had come before the Commission previously and the concerns of neighboring property owners were larger lot sizes and conformance to the Land Use Plan. The request was changed from "R- P.U.D. to 20,000 sq. ft. lot size minimum to the East (ZA 94 -128) and (4) one acre minimum lots in this request. Phil Jobe, 3838 Oak Lawn, commented that sewer would be stubbed to these one acre lots. Public Hearing. No Discussion. Public Hearing Closed. Motion was made to Approve ZA 94 -127 Rezoning Request. W PD Planning and Zoning Meeting October 20, 1994 Page 7 Agenda Item #10, ZA 94 -128 Zoning Administrator, Karen Gandy, informed the Commission that the Applicant's request is for the Rezoning and Concept Plan for Stone Lakes Phase IV, being 24.64 acres situated in the James Thornhill Survey, Abstract No. 1505, and being a portion of Tract 2A. The location is East of S. Peytonville Ave., South of Stone Lakes, East of Monticello Estates and North of Southlake Hills. The Land Use Category is Medium Density Residential/100 -Year Flood Plain. The Owner is Naomi R. Morrison and the Applicant is The Nelson Corporation. The Current Zoning is "AG" Agricultural and the Requested Zoning is "SF -20A" Single - Family Residential District. The property is located in SPIN Neighborhood #14. Twenty -four written notices were sent out and two written responses were received within the 200' notification area in favor, one was undecided and four were opposed. Chairman Wright stepped down and requested that Vice - Chairman Tate preside over this item. Helen -Eve Liebman, 5999 Summerside Drive, Dallas, was present to represent the Applicant, The Nelson Corporation, on this item. Ms. Liebman stated that all of Staffs comments in the Plan Review Summary dated October 14, 1994 would be addressed before the next City Council meeting. She stated that the adjacent property owner (Mrs. Morrison) has no opposition to minimum 20,000 sq. ft. adjacent lots. She explained that the Concept Plan did not show the existing tree cover but that the Preliminary Plat, which is the next case before the Commission, did show the existing tree cover. She said that the next Concept Plan submittal would reflect this. Commissioner McGarity asked to go on record and say that he commended the Applicant for saving existing trees on the Plat to be discussed next. Public Hearing. John Blackburn, 1003 Chimney Hill Trail, stated that he was representing the subdivisions of Stone Lakes, Chimney Hill, and Southlake Hills. He distributed an alternate proposal drawn by the Applicant which eliminated the connection of Chimney Hill Trail and Creekview. He stated that the property owners were adamantly opposed to the through streets as shown on the original proposal. Safety of children and additional crime in the neighborhood in addition to the increased traffic are the main concerns. He also stated that meetings had been held with Fire Marshal, Roger Stewart, and Director of Public Safety, Billy Campbell. Mr. Stewart said there would be no impact to fire response time with the elimination of the through streets (due to the central location of the existing fire station). Mr. Campbell said that response time could be impacted if a patrol car was in the southern part of Stone Lakes Phase IV and had to respond to a call in Chimney Hill or South Lake Hills, however the loss of time would be only 45 seconds to one minute. The property owners of the three subdivisions are willing to sacrifice this time in exchange for the elimination of the through streets. G: \W PF\MTG\MIN \10- 20 -94. W PD Planning and Zoning Meeting October 20, 1994 Page 8 Gene Hansen, 1306 Lake Way, stated that he had petitions by 85 -90% of the property owners (82 %, 86% and 90% from the three subdivisions) which offer support of what Mr. Blackburn had presented to the Commission. Rex Potter, 303 Waterford Ct., Chairman of the Board of the Stone Lakes Homeowner's Association, stated that the Stone Lakes residents do not want the increased traffic or the potential increase in crime resulting from connecting through streets from F.M. 1709 to Continental Blvd. Pamela Gagnon, 1005 South Lake Hills Drive, SPIN Representative for the neighborhood, stated that there are 50 children under the age of 10 years in the small development of South Lake Hills. Continuing the streets and connecting the subdivisions will bring more traffic and cause an even greater safety issue. Melissa Ripley, 901 Chimney Hill Trail, feels that there is enough opportunity for interaction within the communities of Southlake through the schools and churches without connecting the subdivisions. Dennis McGrath, 2403 Carroll, commented that 30,000 sq. ft. lots should be required next to the property that was just zoned "SF-1A". He feels that by allowing 20,000 sq. ft. lots and not following the zoning ordinance requirements, future problems will occur. Elizabeth G. Niewald, 1203 Meadow Ridge Ct., said that in addition to her comments in her letter to the Commission regarding a sense of community, increased crime, and increased traffic, she is also very concerned about the drainage situation. She stated that a creek behind her house has shifted in size due the amount of water going through, just since May. Jeff Chenworth, 904 Chimney Hill Trail, feels that keeping the subdivisions separate is more appealing than the alternative of connecting the streets and dealing with the results stemming from increased traffic and its effect on children's safety. Public Hearing Closed. The Commission discussed fire safety and public safety issues, and response times with Staff. Discussion of providing collector streets per the Thoroughfare Plan was addressed. Other discussion included possible future sites of fire stations, requirements of turnarounds for fire trucks at street stubs, liability, and landscaping of street stubs. Motion was made to approve ZA 94 -128 Rezoning and Concept Plan for Stone Lakes Phase IV, subject to the agreement that the developer agrees to work with the Homeowners Associations on the drainage; that the roads be closed off and not be connected; utilize the alternate second plan presented to the Commission tonight; and delete item #5 of the Plat Review Summary regarding the requirement of 30,000 sq. ft. adjacent lots; and subject to the first Plat Review Summary dated October 14, 1994. The location is on the East side of S. Peytonville Ave., approximately 1/2 mile South of W. Southlake Blvd., and North of W. Continental Blvd. The Current Zoning is "AG" Agricultural and the Requested Zoning is "SF-1A" and "SF -20A" Single - Family Residential. The Owner is Naomi R. Morrison and the Applicant is The Nelson Corporation. The property is located in SPIN Neighborhood #14. Thirty written notices were sent out and two written responses were received within the 200' notification area in favor, one was undecided and four were opposed. Helen -Eve Liebman, 5999 Summerside Drive, Dallas, was present to represent the Applicant, The Nelson Corporation, on this item. WPD Planning and Zoning Meeting October 20, 1994 Page 10 Rex Potter, 303 Waterford Ct., explained that the procedure that the homeowners had chosen was the petition process and to have only a few representatives speak for the entire Homeowners Association. He asked the Commission if they felt this type of representation carried weight at the City Council meeting or if the homeowners should appear in person. Chairman Wright and Commissioner Arnold expressed their appreciation at the professional, well prepared representation of the Association, however, Chairman Wright said sometimes quantity did make a statement. Public Hearing Closed. Motion was made to Approve ZA 94 -129 Preliminary Plat for Stone Lakes Phase IV subject to Plat Review Summary dated October 14, 1994, deleting item #7 regarding changing the street name of Creekview, deleting item #9 regarding the west line of Lot 101, Block 7 being 125', and deleting item #10 requirement of 30,000 sq. ft. lots being adjacent to Lot 2, Block 10, and subject to the revised Plat that conforms to the Concept Plan.
