CITY OF SOUTHLAKE PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 9, 1993 MINUTES Commission Present: Vice Chairman, Michael Richarme; Members: Kate Barlow, Nick McGarity, Randy Arnold, Ernest Johnson, and Lanny Tate. Commissioner Absent: Chairman Joe Wright City Staff Present: Community Development Director, Greg Last; Planner, Tom Elgin; Zoning Administrator, Karen Gandy; and Community Development Secretary, Glenda Jaynes. The meeting was called to order by Vice Chairman Richarme at 7:30 p.m. Agenda Item #2, Approval of Minutes. Motion was made to approve the Minutes of the August 19, 1993, Planning and Zoning Commission meeting. Motion: Arnold Second: McGarity Ayes: Barlow, McGarity, Arnold, Richarme, and Tate Nays: none Abstain: Johnson Approved: 5 -0 -1 Agenda Item #3, Administrative Comments. Community Development Director Greg Last referenced a copy of D /FW building permit statistics and commented that the City of Southlake is leading in many areas. Agenda Item #4, ZA 93 -63, Final Plat of Lots 1 & 2, Block 1, Fina Addition, Fina Oil & Chemical Co. and CITGO Refining & Chemical, Inc. Zoning Administrator Karen Gandy informed the Commission that the applicant's request is for a Final Plat of Lots 1 & 2, Block 1, Fina Addition, being 15.066 acres situated in the C.B. McDonald Survey, Abstract No. 1013. Located on the North side of S.H. 26 approximately one mile Southwest of S.H. 114. Owner is Fina Oil & Chemical Co. and CITGO Refining & Chemical, Inc. Applicant is Everage Consultants, Inc. Current zoning is "I -2" Heavy Industrial District. No notices were required. Ms. Gandy said that the owner proposes to final plat Lots 1 & 2, Block 1 at this time with the final plat of Lot 3 to follow at a later date. Gary Vickery of Everage Consultants was present to represent the owner. Mr. Vickery commented they had no problems with the Plat Review Summary dated 9/3/93 and had already made the revisions. Vice Chairman Richarme advised the audience that this item was a Public Hearing. Zoning Administrator Karen Gandy informed the Commission that the applicant's request is for a Plat Vacation of Oakwood Country Estates, Phase I, being 31.53 acres situated in the O.W. Knight Survey, Abstract No. 899. Located on the North side of E. Continental Blvd. between White Chapel Blvd. and S. Carroll Ave. Owner /Applicant is Timarron Land Corporation. Ms. Gandy said that the plat of Oakwood Country Estates was filed for record in March 1981, but the development was never constructed, and subsequently was acquired by Timarron. Timarron is requesting plat vacation so that the property can be platted as part of Timarron at a later date. Commissioner Johnson objected that no representative was present for this item. Vice Chairman Richarme advised the audience that this item was a Public Hearing. Zoning Administrator Karen Gandy informed the Commission that the applicant's request is for a Revised Concept Plan for Southlake Crossing, being 24.107 acres situated in the W.R. Eaves Survey, Abstract No. 500. Located Southeast of Randol Mill Rd. and South of F.M. 1709. Owner's are Southlake Joint Venture and Albertson's Inc., and the applicant is Tony Callaway of Callaway Architects. Current zoning is "C -3 General Commercial District. Ten notices C: \WPF \MTG \MIN09 -09.93 P & Z Meeting Minutes September 9, 1993 Page 3 were sent out and one response was received in favor; Pat Sheehey, a property owner to the South of Albertson's. Ms. Gandy said this plan reflects a name change to Southlake Marketing for marketing purposes, changes in the relocation of pad sites at the corner of Davis Blvd. and F.M. 1709, minor adjustments to interior lot lines to accommodate the "footprint" of Albertson's, and a requested variance to waive the placement of all interior bufferyards 'A' as shown on the plan. Ms. Gandy commented that the developer has stated that it is likely that the parcels shown will be platted for separate ownership in the future; however, only three lots will be platted at this time. Commissioner Johnson asked if those parcels not platted will be subject to conform to tonight's concept plan when they are platted in the future. Ms. Gandy responded that if the Staff decides that it does not substantially conform the developer would be required to submit another concept plan to the Commission. Tony Callaway of Callaway Architects was present to represent this item. Mr. Callaway described the concept plan and explained the differences requested. Mr. Callaway said that tonight's submittal was similar to the previous plan, but with emphasis on retail and landscaping. Mr. Callaway then asked the Commission to consider a variance to all interior bufferyards as shown on the concept plan because he feels they have provided other additional landscaping which exceeds those requirements. The Commission discussed development phasing, access points, parking spaces and the interior circulation. Developer John Drews commented that all the main access driveways will be built regardless of the sell of the out parcels and that those pads will be grassed and maintained until they are built on. Mr. Drews then said they expect to be built out by next summer. Public Hearing. No one responded and the Public Hearing was closed. Motion was made to approve ZA 93 -66, Revised Concept Plan for Southlake Crossing subject to the Plan Review Summary dated 9/3/93, recommending approval of the applicant's request for a variance to all interior bufferyards 'A' as shown on the concept plan. Vice Chairman Richarme advised the audience that this item was a Public Hearing. Zoning Administrator Karen Gandy informed the Commission that the applicant's request is for a Specific Use Permit for the sale of beer for off -site consumption per Ordinance No. 480, Section 45.1 (1) and 45.6, for property legally described as Lot 2, Block 1, Southlake Crossing, Phase I. Located Southeast of Randol Mill Road and South of F.M. 1709. Owner is Albertson's Inc. Applicant is Tony Callaway of Callaway Architects. Ten notices were sent out and one response received in favor from Pat Sheehey, property owner South of Albertson's. Ms. Gandy commented that the applicant meets the required 300 ft. set back from schools, churches, and hospitals. Tony Callaway of Callaway Architects was present to represent this item. Mr. Callaway explained that the request for the sale of beer was for the convenience and competitive purposes and it would only effect 2 -3% of Albertson's sales. Public Hearing. No one responded and the Public Hearing was closed. Motion was made to approve ZA 93 -67, Specific Use Permit for the sale of beer for off -site consumption for Southlake Crossing subject to the Plan Review Summary dated 9/3/93, recommending approval of the applicant's request for a variance to all interior bufferyards 'A' as shown on the concept plan. Vice Chairman Richarme advised the audience that this item was a Public Hearing. Zoning Administrator Karen Gandy informed the Commission that the applicant's request is for a Plat Revision of a portion of Lot 25, Block 1, Woodland Heights, being a 3.071 acre tract situated in the J.A. Freeman Survey, Abstract 529 and being revised to Lots 25R1 and 25R2, Block 1, Woodland Heights. Located on the South side of F.M. 1709 in the 1700 -block of East Southlake Blvd. Applicant's are Tel Support, Inc. and Burger & Eakins Custom Builders, Inc. Current zoning is "C -1" Neighborhood Commercial District (northern two - thirds of Lot 25) and "O -1" Office District (southern one -third of Lot 25). Nine notices were sent out: one written response in opposition was received from Jerry M. Adcock, 204 Westwood Drive; C: \WPF \MTG \MIN09 -09.93 P & Z Meeting Minutes September 9, 1993 Page 5 one verbal response in favor was received from George Barclay, 205 Westwood; two written responses in opposition were received from Pattie & Dennis Minder, 223 Eastwood and Mrs. Tuttle, 219 Eastwood who live outside the notification area. No one was present to represent this item. Public Hearing. George Barclay, 205 Westwood, although, in favor was concerned about the future uses. Ms. Gandy explained the uses for the zoning. There were no other responses and the Public Hearing was closed. The Commission commented they had no problem with the request, but objected to the fact that no one was present to represent this item. Motion was made to approve ZA 93 -68, Plat Revision of Woodland Heights subject to the Plat Review Summary dated 9/3/93.
