MINUTES
Commission Present: Chairman, Joe Wright; Members: Randy Arnold,
Michael Richarme, Ernest Johnson, and Dennis McGrath.
Commissioner Absent: Nick McGarity and Bob Dowdy
City Staff Present: City Engineer, Eddie Cheatham; Planner, Tom
Elgin; Zoning Administrator, Karen Gandy; and Community Development
Secretary, Glenda Jaynes.
The meeting was called to order by Chairman Wright at 7:30 p.m.
Agenda Item #2, Approval of Minutes.
Commissioner Johnson asked that Item No. 5 of the May 6, 1993
reflect that Planner, Tom Elgin received several compliments on the
first draft of the Land Use Plan - Text.
Motion was made to approve the Minutes of the May 6, 1993, Planning
and Zoning Commission meeting as amended.

Agenda Item #3, Administrative Comments.
Zoning Administrator Karen Gandy presented an agenda to the
Commission and informed them that a joint work session with the
City Council and the Planning and Zoning Commission will be held on
May 25, 1993 to discuss the Land Use Plan.
Commissioner McGrath commented that the Southlake Chamber of
Commerce is sponsoring a "Jigglin Gelatin Slide" tonight and
Commissioner McGarity along with Mayor Fickes will be going down
a slide into a tub of "green jello ". This event will benefit the
National Multiple Sclerosis Society.
Agenda Item #4, ZA 93 -19, Rezoning for Tracts A and Al of the
Burger Addition, James E. & Emma F. Burger.
Chairman Wright advised the audience that this item was a Public
Hearing.
Zoning Administrator Karen Gandy informed the Commission that the
applicant's request is for approval of rezoning for approximately
2.85 acres situated in the Thomas M. Hood Survey, Abstract No. 706,
Tracts A and Al of the Burger Addition. Location is on the East
side of N. Peytonville Ave., Southeast of Trail Creek Addition and
being more commonly known as 1355 & 1375 N. Peytonville Ave.

Owner /Applicant is James E. & Emma F. Burger. Current zoning is
"AG" Agricultural and the requested zoning is "SF -1A" Single Family
Residential District. Ms. Gandy said that this property was
originally platted in 1980 as a "gift of love" and at that time
zoning was not required; however, now the applicant wants to adjust
lot lines which requires rezoning the property. Six notices were
sent to surrounding property owners with no responses to this date.
Owner, James E. Burger was present to answer any questions.
Chairman Wright asked if anyone in the audience wanted to speak on
this item. No one responded and the Public Hearing was closed.

Chairman Wright advised the audience that this item was a Public
Hearing.
Zoning Administrator Karen Gandy informed the Commission that the
applicant's request is for approval of a preliminary plat for Owens
Addition being 19.995 acres situated in the Little Berry G. Hall
Survey, Abstract No. 686, Tracts 3F and 3G. Located in the 800 -
block of West Southlake Blvd. (F.M. 1709), South of Southridge
Lakes, East of Ginger Creek Estate and West of Shady Oaks Drive.
Owner /applicant is Ernest R. Owen. Current zoning is "AG"
Agricultural and will remain "AG ". Ms. Gandy said that Mr. Owen is
proposing to have one single family residence and grazing livestock
on this property. Eighteen notices were sent to surrounding
property owners and three responses were received. Ms. Gandy said
that Terri Sivey, 316 Blanco Circle, Ned Conner, 320 Blanco Circle,
and Roy Stacy, 320 N. Shady Oak Dr. all approved of the request
based on having one house on the property.
Paul McCracken, Engineer for Carter and Burgess was present to
represent the applicant. Mr. McCracken commented that they had
reviewed the City's Staff plat summary and had no problems with
meeting all the requirements.
Chairman Wright asked if anyone in the audience wanted to speak on
this item. No one responded and the Public Hearing was closed.

Agenda Item #8, Land Use Plan Update - Text
Chairman Wright advised the audience that this item was a
continuation of a Public Hearing.
Tom Elgin, Planner I presented the Commission with the second draft
of the Land Use Plan - Text. Mr. Elgin said this draft
incorporates the written and verbal comments received from the
Commissioners.
Commissioner Arnold commented that Mr. Elgin had done an excellent
job on the preparation of the Land Use Plan - Text.
Commissioner Richarme expressed concern that the description of
Public Parks /Open Space in the Land Use Categories, did not reflect
what the Commission had discussed. Also, that the Transitional
category should elaborate on degrees of low and high intensity
uses.

After further discussion it was the consensus of the Commission to
leave the descriptions as written and to forward draft two of the
Land Use Text to the Council.

the text portion of the Land Use Plan.

Zoning Administrator Karen Gandy informed the Commission that the
applicant's request is for final plat of Oakwood Estates, Phase II,
being 20.21 acres situated in the R.D. Price Survey, Abstract No.
1003 and the H.A. Throop Survey, Abstract No. 1273, and being
subdivided into Lots 9 -22, Block 1, and Lot 1, Block 2. Located

John Zimmerman, 3824 Murray Ct., Ft. Worth, Tx. informed the
Commission that Tim Fleet had an emergency and he asked him to be
present tonight to answer any questions that the Commission might
have. Mr. Zimmerman commented he had not seen the Staff's plat
summary. Planner Tom Elgin reviewed the summary with Mr.
Zimmerman.
Chairman Wright asked Mr. Zimmerman if he agreed to meet all the
requirements in the Staff's plat review summary dated 5/14/93. Mr.
Zimmerman commented he saw no problems and agreed to meet all the
requirements.
Commissioner Johnson expressed disappointment to the Consultant in
the failure to minimize items which should have been addressed at
preliminary plat stage.

Phase II subject to the Staff's plat review summary dated 5/14/93.

Agenda Item #9, Revisions to Zoning Ordinance No. 480 - L
Zoning Administrator Karen Gandy informed the Commission that
Ordinance No. 480 -L provides a variance procedure to properties
within the "P.U.D," "S -P -1," and "S -P -2" districts. Ms. Gandy said
that for properties zoned "P.U.D, ", "S -P -1," and "S -P -2," no
districts regulations are established by ordinance and are created
through the approval of the concept or site plan accompanying the
zoning request. Currently, there is no provision which allows an
applicant within these districts to seek a variance, and the Board
has no authority to grant variances to these districts because they
would essentially be rezoning the property. Ms. Gandy also
commented that the approval of Ordinance No. 480 -L would provide
the applicant's within these districts due process.
Commissioner Richarme expressed concern regarding the limitations
of what the Board of Adjustment can approve within the 10% of the
required yard. After reading Section 44 "Board of Adjustment," of
the Zoning Ordinance, Commissioner Richarme felt satisfied with
their approval process.

4. Correct the plat record label of Phase I from Slide 210 to Page 210.
5. Lot 17 does not meet the minimum 100' lot width at the setback line.
6. Show the Bob Jones R.O.W. along the north end of the Tucker tract as
it currently exists.
7. Although some lot lines are not perpendicular or radial to the
R.O.W., they appear to meet the intent of this requirement with the
exception of lot line 12 -13 which staff feels should rotate
clockwise somewhat as per the approved preliminary plat.

* No driveway access across C.O.E. property to Bob Jones Road will be
allowed for any of the lots in Phase II.
* Additional off -site R.O.W. for the southerly extension of Walnut
Drive or temporary pavement in Lot 9, Block 1 will be required to
allow sufficient: turning movements onto the cul -de -sac.
* We recommend this plat not be filed until the construction plans
have been substantially approved. This will ensure adequate
easements and finish floor elevations.
* The Developer's Agreement for this addition should consider
drainage, park dedication requirements, off -site grade -to -drain
permission, and off -site R.O.W. acquisition.

1. Vicinity map should include Lot 1, Block 2 portion of Phase II, and
change Medlin Road to Walnut Drive.
2. Please make the following changes in the title block:
a. Change lot and block references to Lots 9 -22, Block 1;
Lot 1, Block 2
b. Add "15 Lots" and date of preparation
3. The format for the owner's dedication and notary should be as per
the subdivision ordinance appendix two.
4. Indicate the property lines, record owner names, and corresponding
deed records for all unplatted property within 200' to include
property east of Bob Jones Road and Indian Creek Lots.
5. Correct the plat record label of Phase I from Cabinet '1' to Cabinet
'I', Page 210,
6. Label P.O.B. on plat.
7. Provide street names (Walnut Drive & Brooks Court.)
8. Lots should be numbered consecutively beginning with 'Lot 9' for the
lot in the northern corner of Walnut Drive and Brooks Court as per
review letter on preliminary plat (Block numbers 3 & 4 should be re-
labeled to indicate Block 1.)
9. The designation for the triangular shaped lot south of Walnut Drive
should be Lot 1, Block 2.
10. Label the R.O.W. width on Walnut Drive.
11. Lot 6, Block 4 (Lot 17) does not meet the minimum 100' lot width at
the setback line.

12. Show the Bob Jones R.O.W. along the north end of the Tucker tract as
it currently exists.
13. Provide intermediate distances to the Common property line of Lots
13 & 14, Block 1 for the N 89 ° 58'37" E - 169.92' call.
14. The southwest building line of Lot 9, Block 1 should be 40'.
15. Verify 101.70' dimension of Lot 15, Block 1 and provide intermediate
dimension for the line segment west of that call on Lot 14, Block 1.
16. Although some lot lines are not perpendicular or radial to the
R.O.W., they appear to meet the intent of this requirement with the
exception of lot line 12 -13 (4 -5, Block 3) which staff feels should
rotate clockwise somewhat as per the approved preliminary plat.
17. Provide a 15' utility easement between Lots 17 & 18, Block 1 for the
6" water line as per the revised preliminary utilities & drainage
plan.
* No driveway access across C.O.E. property to Bob Jones Road will be
allowed for any of the lots in Phase II.
* Additional off -site R.O.W. for the southerly extension of Walnut
Drive or temporary pavement in Lot 1, Block 3 will be required to
allow sufficient turning movements onto the cul -de -sac.
* Although not required by ordinance, staff would appreciate placing
"Case No. ZA 93 -22" in the lower right corner for ease of reference.
* We recommend this plat not be filed until the construction plans
have been substantially approved. This will ensure adequate
easements and finish floor elevations.
* The Developer's Agreement for this addition should consider
drainage, park dedication requirements, off -site grade -to -drain
permission, and off -site R.O.W. acquisition.
