SUBJECT: Ordinance No. 480 Revision: Section 45
On March 3, 1992, the City Council directed Staff to seek the
Planning and Zoning Commission's recommendation on a revision to
Section 45.1 (2), "Specific Use Permits" to allow churches,
synagogues, temples and other similar facilities for worship,
fellowship and education to make application for this permit in
"ALL" zoning districts.
Currently, the zoning ordinance allows religious institutions to
locate in the "CS" Community Service district as a permitted
right and to locate in certain residential zoning categories by
specific use permit.
This action was prompted by a request of Rev. Joe Bob
McGinnis, pastor of the Rockhaven Church, to relocate to a
Southlake site currently zoned "I -1" Light Industrial.
Attached please find copies of Section 8, "CS" Community
Service, Section 45.1 (2), "Specific Use Permits ", and Rev.
McGinnis' letter.

SECTION 8
"CS" COMMUNITY SERVICE DISTRICT
8.1 PURPOSE AND INTENT - The "CS" Community Service District is
designed to permit those institutional and related uses which
are established in response to the educational, safety and
welfare needs of the community. These uses are separated from
others in the community due to their unique service and often
very special area requirements. Their placement should not
be arbitrary, but should be located to respond to the
community needs.
8.2 PERMITTED USES
a. Public, semi - public and parochial /private kindergartens,
elementary and secondary schools whose curricula satisfy
the requirements of the State Public School Laws and the
regulations of the State•Department of Education.
b. Higher education institutions: Junior and senior
colleges, universities, conservatories and seminaries,
offering curricula recognized by collegiate, academic and
professional organization accrediting boards.
c. Museums, libraries, fine arts centers, and similar
cultural facilities sponsored, operated or maintained
for the benefit of the general public.
d. Golf courses (except commercially operated miniature golf
courses and commercially operated golf driving ranges)
on a site containing a total area of not less than forty
(40) acres; parks, playgrounds, community centers and
country clubs.
e. Institutions, rehabilitation and training centers
offering non - academic programs, when operated or
sponsored by chartered educational, religious, or
philanthropic organizations, but excluding uses such as
trade schools, which are operated primarily on a
commercial basis.
f. Public safety facilities: Civil defense operational
centers, police and fire stations and training
facilities.
g. Utility buildings and structures: power sub- stations,
water tanks and reservoirs, water and sewage .treatment
plants.
h. Religious institutions: churches and facilities for
worship, fellowship, and education.
i. City halls or other municipal office uses.

SECTION 45
SPECIFIC USE PERMITS
45.1 GENERAL PROVISIONS - GENERAL PROVISIONS - The uses listed in
this section are prohibited in the City of Southlake unless
and until a specific use permit is granted for such use by the
City Council in accordance with the requirements and
procedures set forth in this Section. A specific use permit
shall be required for the following uses (as amended by
Ordinance No. 480-D):

a. The City Council shall impose such
reasonable conditions as it deems necessary to
protect the residential neighborhoods, in so far
as practicable, from the detrimental effects of
noise, traffic, fire, etc. and to protect the
character of the neighborhood and the value of
surrounding properties;
b. In granting or denying such application,
the City Council shall consider such items as the
total land area to be devoted to the religious
use, the size of the church structures and the
congregation, the frequency of church services,
other activities which take place on the
premises, and the suitability of the property for
residential use.
The City Council shall consider all effects of
such a facility, both beneficial and detrimental,
and shall deny such application when the
detrimental effects substantially outweigh the
beneficial effects.

c. Children's nurseries, child day care
centers, and kindergartens may be approved as a
part of the main or accessory religious building
provided exterior instructional or play areas are
suitably fenced from any adjacent street, parking
area or property.

Dear Ms. Gandy:
Please be advised that the Smock & Hussein Joint Venture has authorized me to respond to your
request for the zoning change on the property adjacent to their property in Southlake.
As I will be unable to attend the public hearing on Thursday, April 9, 1 would like to make the
following points:
1. The Smock & Hussein Joint Venture is opposed to downgrading the use of the proposed
property. We believe self- storage type warehousing depreciates the value of property in
the neighborhood, and proposes a use which is not consistent with the office,
commercial, and residential zoning in the area.
2. Current zoning for property adjacent to the subject tract is either zoned commercial or
residential. We do not believe that the proposed zoning will act as a suitable buffer
between the residential and office zoning districts.
3, The requirement for concrete masonry construction to be uttliied in this zoning request
has little effect on self - storage buildings. The exclusion of metal doors from the 80
percent requirement will allow these buildings to be constructed of CMU block walls and
metal doors.
4. We continue to object to the exhibit illustrating Benz Drive extends to the property line
and implies that at some future date will be extended on to the Smock/Husseini property.
In the last discussion with City Council, it was determined that a cul- de-sac would
terminate Benz Drive at the property line. The property owners have no intentions of
dividing the property by extending Benz Drive at this time.

5. As a minimum, should the zoning be considered, a landscape buffer with proper
irrigation should be installed around the perimeter. As a suggestion, 48 inch photenia
planted on 36 inch spacing should be installed to screen the site from all directions.
We appreciate your consideration of the objections of the zoning request. We would urge that
you deny this request in order not to further impact the property values in this area.

INSTRUCTIONS
1. All oaths, affidavits, or affirmations made within this State
may be administered and a certificate of the fact given by:
a. A judge, clerk, or commissioner of any court of record;
b. A notary public;
c. A justice of the peace or a clerk of a justice court;
d. Any member of any board or commission created by the laws
of this State, in matters pertaining to the duties
thereof;
e. The Secretary of State of Texas;
f. An employee of the Secretary of State of Texas who has
duties related to the reports required by Title 15,
Election Code, in matters pertaining to those duties;
g. The Lieutenant Governor of Texas;
h. The Speaker of the House of Representatives of Texas; and
i. The Governor of Texas.

2. The mayor may administer oaths of office.
