MINUTES Commissioners Present: Chairman, Joe Wright; Members: Bob Dowdy, Michael Richarme, Dennis McGrath, and Nick McGarity. Commissioners Absent: Larry Samartin and Lanny Tate City Staff Present: Zoning Administrator, Karen Gandy; City Planner, Greg Last; Secretary to the City Manager, Kim Bush. The regular meeting was called to order by Chairman, Joe Wright, at 7:30 p.m. Agenda Item #2, Approval of Minutes Motion was made to approve the Minutes of the May 7, 1992 Planning and Zoning Meeting as presented. Motion: McGrath Second: McGarity Ayes: Wright, Dowdy, Richarme, McGrath, McGarity Nays: none Approved: 5 -0 Agenda Item #3, Administrative Comments Commissioner Richarme expressed the need to reconsider the land use plan for the City because of the major changes and developments taking place within the City of Southlake. Chairman Wright requested that staff start the process for reviewing the land use plan with the Commission as soon as possible. Chairman Wright announced to the audience that the applicants have requested to table items #7 and #8, therefore, these items will be considered at this time in the event there is someone in the audience waiting to here these items. Agenda Item #7, ZA 92 -05, Prel. Plat, Timarron Phase III Motion was made to table and continue the public hearing of ZA 92- 05 until the regular P &Z meeting of June 18th as requested by the applicant. Plat Timarron Golf Course Motion was made to table and continue the public hearing of ZA 92- 06 until the regular P &Z meeting of June 18th as requested by the applicant. Motion: Dowdy Second: McGarity Ayes: Wright, Dowdy, Richarme, McGrath, McGarity Nays: none Approved: 5 -0 Agenda Item #4, ZA 92 -16, Zoning SF -1A, J.Tompkins Zoning Administrator, Karen Gandy, presented the zoning change request for 2.47 acres out of the Francis Throop Survey, Abstract No. 1511, Tracts 1S, 1T, 1T1, and 1U. Current zoning is "AG" Agricultural, with a request for "SF -1A" Single Family -1A Residential. Applicants are James M. and Linda Tompkins and the owner is Unique Incorporated. Ms. Gandy informed the Commission that the zoning request is in compliance with the land use plan for low density in this area. Ms. Gandy further stated that eleven notices were required to be sent, and as of this date two responses have been received in favor of the request: one from Ms. J.L. Cox and one from Mable Cate. Ms. Gandy commented that the tracts are adjacent to the west ROW line, but not a part of the ROW, of Torian Lane which has been dedicated to the City but never accepted by the City nor built to City standards. James Tompkins, applicant, was present to answer questions for the Commission. Mr. Tompkins stated that they plan to build their home on the property. Public Hearing: Mildred Sandal, Airline Drive in Grapevine, stated that she owned property to the north of these tracts. She had some questions and concerns related to property values and taxes and whether this zoning change would affect her property. Commissioner Wright suggested that she meet with City staff. There were no other comments during the public hearing. Motion was made to approve ZA 92 -16 as requested. Motion: McGrath Second: Richarme Ayes: Wright, Dowdy, Richarme, McGrath, McGarity Nays: none Approved: 5 -0 P &Z Meeting Minutes May 21, 1992 Page 3 Agenda Item #5, ZA 92 -17, Curtis Kidd (moved to end of agenda to give applicants time to arrive to the meeting) Agenda Item #6, ZA 92 -18, Final Plat, SouthRidge, Phase V Zoning Administrator, Karen Gandy, presented the Final Plat of SouthRidge Lakes, Phase V, Sections One and Two. Section One has 10.76 acres out of the A.A. Freeman Survey, Abstract No. 522, the Littleberry G. Hall Survey, Abstract No. 686, and the T.M Hood Survey, Abstract No. 706 and proposes sixteen lots. Section Two is 25.177 acres out of the T.M. Hood Survey, Abstract No. 706 and the Littleberry G. Hall Survey, Abstract No. 686 and proposes forty - three lots. The owner /applicant is Arvida /JMB Partners, L.P. II. Sean Randall, Arvida, was present to answer questions for the Commission. Mr. Randall stated that he has no problems with staff's review letter with the exception of item #5. Mr. Randall requested that the Commission consider allowing 20' building lines. The Commissioners and Mr. Randall reviewed each individual lot's characteristics and recommended the following: Block 2 Lot 68 change to 25' Lot 80 change to 20' Lot 50 change to 25' Lot 28 change to 25' Block 1 Lot 74 change to 20' Lot 91 change to 25' Commissioner McGarity questioned the need for 25' on lot 28. Motion was made to approve ZA 92 -18 subject to staff's review letter of 5/15/1992 with the following amendments to item #5: Block 2 - Lot 68 change to 25'; Lot 80 change to 20'; Lot 50 change to 25'; Lot 28 change to 25'; Block 1 - Lot 74 change to 20'; Lot 91 change to 25'. Motion: Dowdy Second: Richarme Ayes: Wright, Dowdy, Richarme, McGrath, McGarity Nays: none Approved: 5 -0 Agenda Item #5, ZA 92 -17, Concept Plan, Curtis Kidd Karen Gandy informed the Commission that the applicant had still not arrived for the meeting. P &Z Meeting Minutes May 21, 1992 Page 4 Chairman Wright stated that he did not feel comfortable discussing the Concept Plan without the applicant being available to answer questions. Motion was made to table and continue the Public Hearing of ZA 92- 17 until the next regular P &Z meeting on June 4 so the applicant could be present. Motion: Dowdy Second: Richarme Ayes: Wright, Dowdy, Richarme, McGrath Nays: McGarity Approved: 4 -1 Agenda Item #9, Rev. to Zoning Ord., 480, MH District Zoning Administrator, Karen Gandy, presented the revisions to Zoning Ordinance No. 480 Section 34.1 (e), "Accessory Uses," adding the "MH" district to the permitted districts for "private residential garages, carports, and unrelated storage buildings and greenhouses accessory to permitted residential uses." Ms. Gandy explained that staff believes this was just an oversight when Ordinance 480 was developed because carports are allowed in the other residential districts. The Commission agreed that they do not believe that carports will be a problem in Southlake as they have been in other areas mainly because of subdivision deed restrictions that will not allow carports. The Commission's main concern is that they do not want carports built in front of the building setback line. Zoning Administrator, Karen Gandy, informed the Commission that a carport would be considered a structure and would have to follow building code requirements. Zoning Administrator, Karen Gandy, commented that in addition to the issue related to carports, she has also been approached by a property owner of a "stick built" home on Timberline Ct., an area in the "MH" district (Ord. No. 480, Section 29). His home is considered a legal, nonconforming structure. Due to this status, he and others in the area are not allowed to expand and are experiencing difficulties in refinancing. David Winters, 1220 Timberline Ct., explained that he has tried to refinance his property and has been denied by the mortgage company because this property has a nonconforming use ( "stick built" home) in a mobile home park. It appears that they can not sell, refinance, or expand on these stick built homes. P &Z Meeting Minutes May 21, 1992 Page 5 Karen Gandy pointed out that our ordinance provides wording that states "it is the intent to allow these nonconformities to continue whether by same or different owner." Chairman Wright suggested that staff write the mortgage company explaining the City's grandfather clause. In reference to the issue of not being able to expand on these homes, Chairman Wright suggested that the owners try to make application for a zoning change to single family. Mr. Wright commented that we would not want to allow a single family zoning change in a mobile home park for any new construction. Ms. Gandy questioned "spot zoning." No other solution could be recommended. There were no other comments during the public hearing. Motion was made to take to no action on revisions to Section 29, "MH" Manufactured Housing District; on Section 34.1 (e) amend to include "MH" district to allow carports, private residential garages, and unrelated storage buildings and greenhouses accessory uses.
