May 7, 1992 7:30 p.m.
MINUTES
Commissioners Present: Chairman, Joe Wright; Members: Lanny Tate,
Bob Dowdy, Michael Richarme, Dennis McGrath, and Nick McGarity.
Commissioners Absent: Larry Samartin
City Staff Present: Zoning Administrator, Karen Gandy; City
Planner, Greg Last; and Secretary to the City Manager, Kim Bush.
The regular meeting was called to order by Chairman, Joe Wright, at
7:35 p.m.
Agenda Item #2, Approval of the Minutes
Commissioner Richarme requested that his comments, in reference to
churches in all districts, include that he has traffic and noise
concerns.
Motion was made to approve the Minutes of the April 23, 1992 P &Z
Meeting as amended.

Agenda Item #3, Administrative Comments
Commissioner McGarity commented that he did not feel the Council
understands how strongly the commissioners felt on placing a time
limit on churches operating in an industrial area.
Chairman Wright suggested the Commissioners contact the
Council regarding their concerns.
Chairman Wright informed the audience that Agenda Item No. 7, ZA
92 -15, has been withdrawn from the agenda at the request of the
applicant.
Agenda Item #4, ZA 92 -12, Concept Plan, Don Butler
Zoning Administrator, Karen Gandy, presented the Concept Plan
approval for office /warehouse facilities on Block B, Lot 4R, North
Davis Business Park, being 0.77 acres out of the T.J. Thompson
Survey, Abstract No. 1502. Current zoning is "I -1" Light
Industrial zoning district. Located at 2104 Greenbriar Drive at
Greenwood Drive. The owner of the property is Mr. Don Butler. Ms.
Gandy stated that thirteen notices were sent and one response was
received from Mercantile Bank in favor of the request.

Don Butler, 4301 Hidden Valley Court, Colleyville, was present to
answer questions for the Commission. Mr. Butler stated that he
had no problem complying with staff's review letter.
There were no comments during the Public Hearing.
Motion was made to approve the Concept Plan as presented subject to
staff's review letter of 5/1/1992.

Agenda Item #5, ZA 92 -13, Plat Showing, Sunshine Lane, Mr /Mrs
Darden
Zoning Administrator, Karen Gandy, presented the Plat Showing for
Lots 1 and 2, F. Throop No. 1511 Addition, being 11.994 acres out
of the Francis Throop Survey, Abstract No. 1511, Tract 3A1C.
Current zoning is "SF -1A" Single Family -1A Residential. Located on
the west side of the 1500 block of Sunshine Lane. Owners of the
property are Joel and Virginia Darden. Ms. Gandy stated that
fourteen (14) notices were sent, but no responses were received.
Joel Darden, 2936 W. Royal Lane #2144, Irving, was present to
answer questions for the Commission. Mr. Darden commented that he
would have no problem complying with staff's review letter.
Public Hearing:
Raymond Yatko, 1559 Sunshine, questioned the procedure for platting
but offered no opposition. He also commented that the drawing he
received with the notice was very difficult to read because it was
so small.
There were no other comments from other persons during the Public
Hearing.

letter dated 5/1/1992.

Agenda Item #6, ZA 92 -14, SUP, TV Satellite Dish, R.Mullis
Zoning Administrator, Karen Gandy, presented the request for a
specific use permit for the installation and use of a television
satellite dish per the requirements of Ordinance No. 480, Section
45.1 (35) for property legally described as Lot 22, Block 2, Chapel
Downs. Current zoning is "SF -20A" Single Family -20 A residential.
Address is 101 Churchill Circle; owner /applicant is G. Richard
Mullis. Ms. Gandy briefed the Commission on the requirements for
permitting the use and placement of satellite dishes. Eleven

notices were required to be sent. One notice was received in favor
of the request from Mr. David Carpenter, 106 Churchill Cr. and one
notice was received opposing the request from Mr. James J. Evers,
102 Belmont Place.
G. Richard Mullis, 101 Churchill, was present to answer questions
for the Commission. He stated that they had purchased and erected
the satellite dish unaware that there were permitting requirements.
He also commented that they purchased the satellite dish because
cable television is not available.
Public Hearing:
Robert Dondero, 104 Belmont Place, commented that the dish was
visible from his back yard and living areas, and he found it very
unappealing and detrimental to his resale value.
James Evers, 102 Belmont, commented that the satellite dish is
aesthetically unpleasant. He questioned why the cable company has
not provided service to this area.
Dennis Windmuller, 101 Belmont Place, stated that he felt the
satellite dish was no more of an eye sore than tree houses, jungle -
gyms, or basketball hoops. He stated that this is a neighborhood
and we should expect these types of things in a neighborhood.
Nick DiSibio, 106 Belmont Place, commented that he feels the whole
problem started because the cable company has not provided service
to this subdivision. He questioned what could be done to make sure
these types of things do not cause problems for the community in
the future.
City Planner, Greg Last, suggested that those interested in the
status of the cablevision franchise should write the City Manager
for more information.
There were no other comments from other persons during the Public
Hearing.
Commissioner Dowdy commented that he feels the applicant has tried
to place the satellite dish in an area where it would be the least
unsightly, and he agrees that the satellite dish is no more
unsightly than a jungle gym.
Commissioner Richarme commented that ignorance of the law is no
excuse, but what the Commission has to look at now is whether or
not this request meets the requirements of the ordinance. He
stated that he believes it does, and the applicant has the right to
put it up regardless if cable is available or not.
The Commission commented that they hoped that the neighbors and the
developer would be able to work something out on the landscaping as
offered, but landscaping is not a requirement of the zoning
ordinance for this request.
