45.1 (2), Ordinance No. 480. to locate in "ALL"
zoning districts with a specific use permit
approved by the City Council.

PLANNING AND ZONING COMMISSION MEETING
April 23, 1992 7:30 p.m.
MINUTES
Commissioners Present: Chairman, Joe Wright; Members: Lanny Tate,
Bob Dowdy, Michael Richarme, Dennis McGrath, and Nick McGarity.
Commissioners Absent: Larry Samartin.
City Staff Present: Zoning Administrator, Karen Gandy; City
Planner, Greg Last; and Secretary to the City Manager, Kim Bush.
A work session was held beginning at 6:30 p.m. to discuss Timarron
Development Site Plan.
The regular meeting was called to order by Chairman Joe Wright at
7:35 p.m.
Agenda Item #2, Approval of Minutes
Motion was made to approve the minutes of the April 9, 1992 P &Z
Meeting as presented.

Agenda Item #3, Administrative Comments
There were no comments from staff or the Commission.
Agenda Item #4, ZA 92 -04, Dev. Site Plan, Timarron, Ph. III
(Chairman Joe Wright stepped down, and asked that Lanny Tate chair
the meeting in his absence.)
Zoning Administrator, Karen Gandy, presented the Development Site
Plan for Timarron, Phase III, a "R- P.U.D." Residential Planned Unit
Development, a 300.82 acre tract of land out of the Hall Medlin
Survey, Abstract No. 1037, the Hollingsworth and Barrett Survey,
Abstract No. 797, the O.W. Knight Survey, Abstract No. 899, and the
M. Davenport Survey, Abstract No. 432. Ms. Gandy stated that
sixty -seven notices were sent. Four (4) responses were received
from persons surrounding the project: E- Systems and Norman J.
Brown were in favor; Noah Pond was opposed; and Lois O'Dair was
undecided. Three citizens from other areas responded: Carol Lee
Hamilton and Aloha Payne were opposed; and Larry Goldstein was in
favor.
Dennis Jerke, Carter and Burgess, explained that the project
proposes courtyard and patio homes with no common walls.
A discussion was held on the different product types and their
characteristics.

Public Hearing:
Nicholas Di Sibio, 106 Belmont, commented that they moved to
Southlake because of the larger lots. They enjoy the larger lot
concept and would not like to see the City compromise the
community.
There were no other comments from the audience during the Public
Hearing.
Susan Evans, President Timarron Land Development, commented that
they have reviewed staff's comment letter of 4/16/1992 and will
have no problem complying.
Commissioner Richarme stated that he has the same concerns as
before with the small lot sizes. He commented that he has spoken
with at least 37 citizens. Thirty -four of those citizens did not
support this type of development.
Commissioner Dowdy stated that he had a problem with smaller lot
sizes but not as presented in this plan within a cluster. Each PUD
and each phase of a PUD is considered individually.
Commissioner McGrath stated that he feels if you allow this type of
development, you will see no end to smaller lot development. He
believes this plan destroys the atmosphere of Southlake, and the
majority of citizens moved here because of the country atmosphere.
Commissioner McGarity stated that he was not concerned so much with
the lots near the golf course because they are enclosed; he is
concerned with the lot sizes north of Continental, and feels the
PUD ordinance has been stretched.
Susan Evans stated that this will either be a golf course community
or not. She stated that they have come in with their best shot on
this plan. Ms. Evans commented that this plan is what they need to
make a golf course work.
Motion was made to deny ZA 92 -04.

Susans Evans asked that since they have complied with City
ordinances, she would like to know the Commission's basis for the
rejection.
Commissioner Tate stated that he thinks the plan does meet the City
ordinances. His problem is the size of the lots north of
Continental. He wished that Mobil would have tried to compromise
and work a little with the Commission on the size of those lots.

Commissioner Tate thought that if they had compromised even a
little, the vote would have been different.
Commissioner Richarme stated that the Commission had an all or
nothing situation with no discussion of modification.
Commissioner McGrath expressed that he felt Mobil picked the
scenario that best fit Mobil and not the community.
Commissioner McGarity stated that Mobil's modifications to set
backs, etc. was very fruitful; he felt this was a quality job and
there is a need in Southlake for different product types.
Agenda Item #5, ZA 92 -05 Prel. Plat Timarron, Phase III
Susan Evans, President Timarron Land Dev., requested that ZA 92 -05
be tabled time certain 5/21/1992.
Motion was made to table at the request of the applicant time
certain 5/21/1992.

Agenda Item #7, Rev. to Zoning Ord. 480, Section 45, SPU, Churches
Zoning Administrator, Karen Gandy, presented the proposed revision
to Zoning Ordinance No. 480, Section 45, "Specific Use Permits,"
amending to allow churches, synagogues, temples and other similar
facilities for worship, fellowship and education, subject to
certain conditions listed in Section 45.1 (2), Ordinance No. 480,
to locate in "ALL" zoning districts with a specific use permit
approved by the City Council.
Commissioner Richarme commented that he has a problem with a church
locating to an industrial area on a permanent basis. He also
commented that he has concerns about day care services within
churches. Commissioner Richarme further stated his safety concerns
because of traffic generated by industrial operations and the
impact of noise.
Zoning Administrator, Karen Gandy, commented that limitations and
conditions can be placed on each S.U.P. request.

It was the consensus of the Commission that a limit of three (3)
years with a one -year extension period be allowed. If a permanent
use is needed, then a request for "CS" zoning should be made.
Motion was made to approve the revisions to Zoning Ordinance No.
480, Section 45 to allow the districts where churches are permitted
to read "ALL" instead of enumerating only certain districts; and
establish a three (3) year maximum period with a one year renewal.
