2011-08-25 V CITY OF SOU THLAKE TEXAS 1 REGULAR ZONING BOARD OF ADJUSTMENT MEETING: AUGUST 25, 2011 2 3 Location: Southlake Council Chambers 4 1400 Main Street, Southlake, Texas 5 6 Members Present: Chairman Laird Fairchild, Vice - Chairman Kate Smith and Board Members 7 Chad Patton, Shawn McCaskill, Phyllis Lambert and Alternate Daniel Kubiak. 8 9 Members Absent: Alternates Lisa Amend and Dustin Andrews. 10 11 Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard 12 Schell, Planner 11; and Stephanie Breitbarth, Acting Board Secretary. 13 14 Agenda Item No. 1 — Call to Order: Chairman Fairchild called the August 25, 2011 Zoning 15 Board of Adjustment meeting to order at 6:31 p.m. 16 17 Agenda Item No. 2A — Approval of the Minutes: Chairman Fairchild opened the discussion 18 for the minutes of the Zoning Board of Adjustment meeting held on July 14, 2011. 19 20 A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on 21 July 14, 2011, as presented. 22 23 Motion: Lambert 24 Second: Patton 25 Ayes: Patton, McCaskill, Lambert, Smith, Fairchild 26 Nays: None 27 Abstain: Kubiak 28 Vote: 5 29 30 Motion: Carried 31 32 Agenda Item No. 2B — Approval of the Minutes: Chairman Fairchild opened the discussion 33 for the minutes of the Zoning Board of Adjustment meeting held on July 28, 2011. 34 35 A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on 36 July 28, 2011, as presented. 37 38 Motion: McCaskill 39 Second: Smith 40 Ayes: Patton, McCaskill, Lambert, Smith, Fairchild 41 Nays: None 42 Abstain: Kubiak 43 Vote: 5 44 45 Motion: Carried 46 Minutes - Zoning Board of Adjustment Meeting — August 25, 2011 Page 1 of 2 47 Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner II, introduced new 48 board member Daniel Kubiak and announced that one case has been submitted for the next 49 scheduled meeting scheduled for September 15, 2011. 50 51 Mr. Schell announced that the applicant for ZBA -609 has submitted a letter requesting to 52 withdraw their request before the board. 53 54 Agenda Item No. 4 - ZBA -609, Variance to Front and Rear Yard Setbacks: Variance to 55 Ordinance No. 480, Section 29.6 (b), requiring a front yard setback of not less than fifteen (15) 56 feet and Section 29.6(d), requiring a rear yard setback of not less than twenty -five (25) feet, 57 except that the principal building may encroach as close to fifteen (15) feet to the rear property 58 line as long as no more than fifty percent (50 %) of the area between the twenty -five (25) foot 59 and fifteen (15) foot rear yard area and the ten (10) foot side yard setbacks is encroached. The 60 applicant is requesting a front yard setback of (10) feet and a rear yard setback of ten (10) feet. 61 The property is located at 1135 Haven Circle, being described as Lot 18R, East Haven Addition, 62 an addition to the City of Southlake, Tarrant County, Texas and being approximately 0.195 63 acres. The current zoning is MH — Manufactured Housing District.
