Item 9C13 SOUTHLAI<,,E CITY OF Department of Planning & Development Services STAFF REPORT October 24, 2011 PROJECT: Tree Conservation /Mitigation Plan, Portion of Lot 2, Block 2, Gateway Plaza, 3100 E. Southlake Boulevard (Adjacent to Bank of America Building and DFW Connector Project) EXECUTIVE SUMMARY: Terry Wilkinson, of Wyndham Properties Ltd. and Northgate Contractors are requesting approval of a Tree Conservation/ Mitigation Plan to allow removal and mitigation of protected trees located along the eastern boundary of Lot 2, Block 2 Gateway Plaza in order to allow this area to be filled to grade with the adjacent Bank of America site and the proposed grade of S.H. 114 and F.M. 1709 in conjunction DFW Connector Project. REQUEST DETAILS: The affected area was designated as a natural open drainage channel with native tree and under growth which extended between the Calico Corner and Bank of America site. The DFW Connector project required acquisition of a large portion of the natural channel area, some of the Bank of America site and most of the Calico Corner site. In order to prevent having a small area with a deep retaining wall, the owner along with TxDOT' s contractor, Northgate Contractors, is proposing to fill the hole to grade, replace a significant amount of the trees and revise the proposed detention area in order to preserve a large native post oak that was previously designated for removal in the DFW Connector plan. Additionally, the property owner is proposing to reserve the eastern portion of the Bank of America site for a future City portal structure. The Applicants are requesting approval of the mitigation plan which places twelve (12) — three (3) inch mitigation trees on the Bank of America site, preserves a 49 inch post oak previously designated for removal and installs several plantings a varying species along the TxDOT right of way area as indicated on the attached landscape plans. It is the applicant's responsibility to contact the department representative shown above and make modifications as required by the comment. --------------------------------------------------------------------------- --------------------------------------------------------------------------- TREE CONSERVATION COMMENTS: Northgate Contractors is proposing to remove all of the existing trees within the open space/ drainage channel area in the east portion of the Gateway Plaza /Bank of America property. Although they are removing all of the existing trees within the area, only the existing trees within a triangular space located within the private lot boundary of the Bank of America Site (Lot 2, Block 2) are protected. All tree within the within the TXDOT right -of -way are exempt from tree preservation. In order to remove the trees Northgate Contractors must submit a tree removal permit and mitigate the trees removed within the triangular area not within the right -of -way. The amount of protected trees within the non - right -of -way portion of the area is eighteen (18) trees totaling two - hundred - forty -two (242) diameter inches. Mitigation is required to be provided by replacing canopy trees at a minimum of 3 "' caliper size equal to the 242 inches removed or by payment into the reforestation fund at a rate of approximately $150 per caliper inch on any deficiency. Northgate Contractors is currently proposing to mitigate the removal of the trees by planting twelve (12) — 3" caliper trees on the triangular Gateway Plaza Bank of America property, preserve 49 inches of native post oak previously designated for removal in TxDOT ROW and supplement with a variety of accent trees and other plantings as shown on the attached landscape plan. Because accent trees do not count toward mitigation trees, this leaves a remaining one - hundred - fifty -seven inches (157 ") or remaining approximately 52 — 3 inch trees or provide payment into the Reforestation Fund of $23,471.50. The Applicants are requesting approval of the mitigation plan as proposed by placing mitigation trees (12 - 3 inch canopy trees) on the Bank of America site, preservation of the a 49 inch post oak previously designated for removal and installation of several plantings a varying species along the TxDOT right of way area as indicated on the attached landscape plans.
