Item 6B MemoCity of Southlake, Texas MEMORANDUM October 12, 2011 TO: Shana Yelverton, City Manager FROM: Ken Baker, Director of Planning and Development Services SUBJECT: Item 6B — 2nd Reading, Revisions to Chapter 9.5 of the City of Southlake's City Code Article IV — Oil and Gas Well Drilling and Production Action Requested: Consider approval of 2 nd Reading after the following: • Discuss any additional changes to Chapter 9.5 of the City of Southlake's City Code Article IV (Ordinance 880 -B) — Oil and Gas Well Drilling and Production to date; including the provision of the establishment of a setback requirement from City Parks and modification of insurance requirements. Background Information: October 4, 2011; City Council reviewed comments received from third - party professional consultants and approved the 1 St Reading of proposed ordinance with additional revisions. September 6, 2011; City Council reviewed an overview of all proposed ordinance revisions to date; followed by a public comment session. August 23, 2011; City Council reviewed, discussed and made additional changes to the proposed ordinance revisions. August 16, 2011; City Council reviewed, discussed and made additional changes to the proposed ordinance revisions. August 2, 2011; City Council reviewed, discussed and made additional changes to the proposed ordinance revisions. June 21, 2011; City Council voted to extend the previous moratorium on the acceptance of applications for gas drilling and production an additional 120 days to November 14, 2011. The City Council also agreed to the Gas and Oil Drilling Ordinance meeting schedule; the schedule is below: Basis for the initial proposed changes to the ordinance included the following: 1) Incorporation of conditions from recent gas drilling and production specific use permit (SUP) cases; 2) Incorporation of best management practices (BMP) regulations that other cities have adopted; and Resolution No. 11 -033 October 12, 2011 Page 2 of 2 Financial Considerations: Citizen Input/ Board Review: Legal Review: Alternatives: Supporting Documents: 3) Clarification of processing requirements.
