2011-07-14 gl CITY OF SOUTHLAKE TEXAS 1 REGULAR ZONING BOARD OF ADJUSTMENT MEETING: JULY 14, 2011 1 3 Location: Southlake Council Chambers 4 1400 Main Street, Southlake, Texas 5 6 Members Present: Board Members Shawn McCaskill (Acting Chairman); Chad Patton; Lisa 7 Amend, Alternate 1; and Dustin Andrews, Alternate 2. 8 9 Members Absent: Board Members Laird Fairchild; Kate Smith; Phyllis Lambert. 10 11 Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard 12 Schell, Planner 11; and Dianna Brawner, Board Secretary. 13 14 Agenda Item No. 1 — Call to Order: Acting Chairman McCaskill called the July 14, 2011 15 Zoning Board of Adjustment meeting to order at 6:30 p.m. 16 17 Agenda Item No. 2 — Approval of the Minutes: Acting Chairman McCaskill opened the 18 discussion for the minutes of the Zoning Board of Adjustment meeting held on June 30, 2011. 19 20 A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on 21 June 30, 2011, as presented. 22 23 Motion: Patton 24 Second: Amends 2 5 Ayes: Andrews, Patton, Amends, McCaskill 26 Nays: None 27 Abstain: Patton 28 Vote: 4-0-0 29 30 Motion: Carried 31 32 Agenda Item No. 3 — Administrative Comments: Richard Schell, Planner 11, announced that 33 the next scheduled meeting is July 28, 2011, a meeting will be held at that time due to one of 34 tonight's cases being moved to that night. 35 36 Agenda Item No. 4 - ZBA -609, Variance to Front and Rear Yard Setbacks: Variance to 37 Ordinance No. 480, Section 29.6 (b), requiring a front yard setback of not less than fifteen (15) 38 feet and Section 29.6(d), requiring a rear yard setback of not less than twenty -five (25) feet, 39 except that the principal building may encroach as close to fifteen (15) feet to the rear property 40 line as long as no more than fifty percent (50 %) of the area between the twenty -five (25) foot 41 and fifteen (15) foot rear yard area and the ten (10) foot side yard setbacks is encroached. The 42 applicant is requesting a front yard setback of (10) feet and a rear yard setback of ten (10) feet. 43 The property is located at 1135 Haven Circle, being described as Lot 18R, East Haven Addition, 44 an addition to the City of Southlake, Tarrant County, Texas and being approximately 0.195 45 acres. The current zoning is MH — Manufactured Housing District. The applicant is Jeff Tufts. 46 Zoning Board of Adjustment Meeting — July 14, 2011 Page 1 of 3 47 Acting Chairman McCaskill stated on Item # 4, ZBA -609 let the records reflect Mr. Andrews has 48 recused himself from this case which leaves the Board without a quorum therefore the case will 49 be moved to July 28, 2011. 50 51 Agenda Item No. 5 - ZBA -615, Special Exception Use Permit for an accessory building of 52 a size greater than permitted. Special Exception Use Permit per Ordinance No. 480, Section 53 44.12 (3), permitting the construction of accessory buildings or structures of a size or aggregate 54 size greater than permitted. Zoning Ordinance No. 480, Section 14.5(e) requires that the sum 55 total of all accessory buildings or structures shall not exceed six hundred (600) square feet. The 56 applicant is proposing to construct an approximate seven hundred thirty (730) square feet pool 57 house, being the sum total for all accessory structures on the lot to approximately 922 square 58 feet. 59 60 The property is located at 1005 Deer Hollow Boulevard, being described as Lot 4, Block 6, 61 Southlake Woods, Phase 1, and addition to the City of Southlake, Tarrant County, Texas, and 62 being approximately 0.854 acres and the owner is Ken and Patty Ann Migliaccio.
