4 CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 480-222a OFFICIAL RECORD AN ORDINANCE AMENDING ORDINANCE NO. 480, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING LEGALLY DESCRIBED AS APPROXIMATELY 200 ACRES SITUATED IN THE RICHARD EADS SURVEY, ABSTRACT NO. 481, BEING TRACTS 1, 1A1, 1E, 2, 2A, 2B, 2B1A, AND 2C1, AND IN THE THOMAS MAHAN SURVEY, ABSTRACT NO. 1049, BEING TRACTS 2A, 2B, 2B1, 3, 3A, 3C, 5, 5C, AND 5D AND A PORTION OF TRACTS 1 AND 1B1 AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM "NR- PUD" NON - RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT TO "NR -PUD" NON - RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT, SUBJECT TO THE SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE AND ATTACHED HERETO AS EXHIBIT "B "; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and WHEREAS, the hereinafter described property is currently zoned as "NR -PUD" Non - Residential Planned Unit Development District under the City's Comprehensive Zoning Ordinance; and • 1 `t L WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off - street parking facilities; location of ingress and egress points for parking and off - street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health ad the general welfare; effect on light and air; effect on the over - crowding of the land; effect on the concentration of population, and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over - crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being approximately 200 acres situated in the Richard Eads Survey, Abstract No. 481, being Tracts 1, 1A1, 1 E, 2, 2A, 2B, 2B 1 A, and 2C1, and in the Thomas Mahan Survey, Abstract No. 1049, being Tracts 2A, 2B, 2B1, 3, 3A, 3C, 5, 5C, and 5D and a portion of Tracts 1 and 1B1 and more fully and completely described in Exhibit "A" from "NR -PUD" Non - Residential Planned Unit Development District to "NR -PUD" Non - Residential Planned Unit Development District subject to the specific requirements contained in this ordinance and attached hereto as Exhibit `B" and subject to the following conditions: 1) Subject to the applicant's agreement to bury utilities along S. H. 114 but understanding the applicant will need to receive approval from the utility companies; 2) Delete the stub on Blessed Lane as described by Councilmember Terrell; 3) To submit with the 2nd reading appropriate color renderings to comply with the technical plans showing the link to Kirkwood; 4) That the landscaping plan is not being approved at this time but on future application; 5) Subject to the recommendations of the Planning and Zoning Commission on July 5, 2007 which included granting the variance to allow a minimum 80' wide 4 lane undivided arterial with an addition 4 lane undivided arterial to extend from the E. Kirkwood Boulevard extension to SH 114 instead of a 100' wide 4 lane divided arterial. The applicant proposes an connection west of the church site. Applicant is willing to work with staff on alignment of Kirkland Blvd and Grace Lane to the west and applicant is willing to revisit the 100 foot median roadway and 4 lane divided arterial in the event the owners sold the property for residential use. 6) Include a variation to the Master Thoroughfare Plan as described by Planning Director Baker as to Grace Lane; 7) To require materials to be of similar type and amount indicated on renderings but noting the materials are not being approved at this time but being assured materials will be similar to what is depicted in drawings tonight. 8) Subject to the staff report presented this evening August 21, 2007; 9) Subject to the applicant agreeing the ultimate pond will be similar in size, approximately three acres, and location as depicted on the plan as presented; 10) Noting Council will reserve final placement of the utilities until site plan approval; 11) Noting the applicant will work with staff on the eastern alignment of Kirkwood Boulevard at Kimball Avenue; 12) Subject to the applicant complying with the airport restrictions as provided; 13) Granting the variances to the 80' right -of -way on Grace Lane and Blessed Lane; 14) Noting the applicant has agreed to the divided road and extra width from S.H. 114 back a certain distance as depicted on the plan presented this evening; 15) The applicant will dedicate the necessary right -of -way for the extension of Kirkwood Boulevard at such time as needed by the City; 16) Subject to Concept Plan Review Summary No. 6, dated August 15, 2007. SECTION 2. That the City Manager is hereby directed to correct the Official Zoning map of the City of Southlake, Texas, to reflect the herein changes in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over - crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least fifteen (15) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. Southlake Blvd., Suite 100 Southlake, Texas 76092 Re: Zoning and Consolidated Land Use Plan Amendment Narrative Gateway Church North Side of S.H. 114, between Carroll Ave. and Kimball Ave. Mr. Killough: As you are aware, Gateway Church, currently located at 2121 East Southlake Blvd. in Southlake, Texas, has purchased the referenced property to be developed as a new church site for their continued expansion. Background: The build -out of the expansion onto this site may consist of an 8,000 seat auditorium and its associated parking. Additionally, the first phase may also contain space for children, youth and adult ministries, as well as administrative office space. Gateway Church chose to develop this site for its location, visibility, ease of access and natural beauty. Though intended to be a large development, both Gateway Church and the consultant team are focused on preserving the natural environment to the extent possible. This is evident in the manner that the site has been designed to: 1. Protect views from the residential areas along East Highland Street 2. Promote sensitive solutions to storm water management 3. Utilize existing trees and tree stands as buffers; shade for pedestrians and to signify important way - points within the site. Gateway Church understands that the subject property is located in a highly visible area of the community along S.H. 114. The importance of well planned, quality development has not gone unnoticed by church staff. Our intention is to create a prominent civic institution along this primary corridor within the City of Southlake, providing a strong visual link to the expanding Town Center mixed - use development to the south. 1 r _ Kimley -Horn Mr. Dennis Killough, August 13, 2007, Page 2 and Associates, Inc. Land Use: The subject property is classified as "Mixed -Use" on the City's Consolidated Land Use Plan. As indicated on the Concept Plan, the proposed development of the church in Parcel B does not reflect the Consolidated Land Use Plan's definition of a Mixed -Use land use. For this reason, we are requesting an amendment to the Consolidated Land Use Plan that would remove Parcel B from the "Mixed -Use" designation and designate it as "Public /Semi- Public ". We are requesting that the remaining Parcels (A, C and D) remain designated as "Mixed - Use". Please refer to our Consolidated Land Use Plan Amendment Request application and supporting letter, tables and exhibit for further information. Zoning: In order to develop the property in a manner that is suitable to the needs of a church the size of Gateway church, the property will need to be rezoned. Currently zoned per NR -PUD #480 -222, church uses are permitted under the CS — "Community Services" district by S.U.P. only. Our request is to allow church uses under the CS — "Community Services" district by right. All other uses which currently require an S.U.P. under NR -PUD #480 -222 will continue to require an S.U.P. under the requested zoning. Additionally, we are requesting the current height restriction of 35' (thirty -five feet) to be revised for church uses to be changed to 70' (seventy feet). Please refer to the building section enclosed with this document. The current limit of three stories will remain. The current height restrictions for other uses under NR -PUD #480 -222 will remain the same under the requested zoning. Though current City ordinances do not permit any ancillary residential uses in a Non - Residential PUD, this was not the case when the existing zoning was approved. Gateway Church understands that current ancillary residential development rights will be lost upon the approval of the requested zoning. The subject property, denoted as "Tract III" in the current NRPUD zoning text, is broken into seven parcels, labeled as parcels A through G. Tracts A through D are intended to continue with the format of the current zoning. Tracts E and F were created to facilitate a land -swap with the Carroll Independent School District. Tract G was created to permit the tract to remain in a "Mixed -Use" land use category. This site shall abide by the uses and regulations established by NR -PUD # 480- 222 with the following exceptions: Parcels A, B, C, D, E, F and G: 1. The City Council shall have the right to grant a variance to the building setback, buffer yard, maximum impervious coverage, maximum lot coverage, facade articulation, landscape, and parking requirements at site plan approval. To receive a variance, the applicant must demonstrate one of the following: a. A variance will reduce the impact of the project on surrounding residential properties; or b. Compliance with the ordinance(s) would impair the architectural design or creativity of the project; or c. A variance is necessary to assure compatibility with surrounding developed properties; or d. The proposed construction is an addition to an existing project that does not meet the requirements of the ordinance(s); or e. The required setback creates an unusual situation or localized anomaly that is not consistent with setbacks to other adjacent properties; or f. A variance will reduce the impact of the project on environmental features on or adjacent to the site; or g. A variance is necessary to allow the project to fit in with the natural topography of the site. 2. Residential uses are removed as permitted uses, due to this use no longer being permitted by the Zoning Ordinance # 480, as amended, as an ancillary use within a Non - Residential Planned Unit Development. 3. A maintenance building shall be a permitted accessory use. 5. Connectivity shall be required between the City's trail and sidewalk network and the proposed buildings. These connections shall be provided at the Site Plan stage. 6. There will be no impervious coverage permitted in the flood plain with the exception of pedestrian trails, roadways and required parking and will only be permitted if flood plain is adjusted so downstream properties have no adverse impact. 7. Under "Design Guidelines ", state the following: a. The Church shall design the site and buildings in accordance with the P.U.D. that governs the site, and the SH 114 Corridor Overlay requirements. b. Site Entrances: the design and location of the site entrances are critical in setting the proper tone when new comers visit the site. The idea is to create a campus like feel that provides a consistent experience from the street to the building. Circulation, whether vehicular or pedestrian, will be clear, concise, and intuitive. Signage will no doubt play an important role in supporting this vision. The signage will comply with the zoning requirements, but will also be designed to compliment the site and building architecture. To that end, we foresee the use of some of the same materials from the building being incorporated throughout the site and into the signage. c. Site Lighting: lighting will also be an important site consideration, not only for security, but to promote pedestrian activity. The fixture styles will be in keeping with the architecture and shall comply with the zoning requirements. Lighting will generally point away from adjacent properties, being mindful of light spillage. As a goal, lighting will be more intense at the buildings, and taper off as you approach the edges of the site. d. Building Entrances: an important factor in making the circulation intuitive is designing the building entrances so that they stand out. One of the worst things that can happen is when a newcomer visits the site and they don't know where the front door is, or where to drop their children off. As a result, our building designs will incorporate typical entrance features such as covered drop offs, windows to announce lobby spaces, and possibly some outdoor plaza spaces to promote fellowship before E 11/1 Kimley -Horn Mr. Dennis Killough, August 13, 2007, Page 5 and Associates, Inc. and after service. All elements will be compatible with the overall style and detail of the campus. e. Facades: the Church vision is to create buildings, while potentially large, have a warm and inviting feel, and fit well on the site. This will be achieved by surrounding the larger volumes with smaller structures to help scale the buildings down as they approach entrances and pedestrian spaces. The use of the natural grade on site will also go a long way to mitigating building height, as we have tucked a considerable portion of the first floor and parking garages below grade. f. Building Materials: the primary building material shall be masonry. We have not determined the exact material to date, but it shall comply with the 80% masonry requirement (exclusive of glazing), and it shall be consistent with either stone, brick, cast stone, glass fiber reinforced concrete, pre -cast concrete panels, stucco, or split face concrete masonry units. Other materials may be used as accent materials (less then or equal to 20 %), including but not limited to synthetic stucco, tile, composite metal panels, and painted steel. 8. Under "Environmental Resource Protection ", state the following: a. To the extent possible, the proposed site design shall protect the existing ponds and maximize tree preservation. b. To the extent possible, the proposed site design shall limit the impact of large surface parking by incorporating parking garages. c. Any existing flood plain and wetlands on the property shall be impacted to the minimum extent possible and a contiguous open space network shall be provided through the site that incorporates a natural, 8' (eight foot) trail. Parcels B and E: 1. Religious Institutions shall be a permitted use by right, without approval of a Specific Use Permit. 2. Multi -level parking garages, book store, day care center, coffee shop, restaurant, recording studio, production studio, television studio, and athletic activities center shall be a permitted accessory use. 3. The maximum building height for a religious institution building within the "CS" classification shall be 70' (seventy feet) in height and 3 (three) stories, per the height calculation standards in Zoning Ordinance # 480. i 1 t ❑ Kimley -Hom Mr. Dennis Killough, August 13, 2007, Page 6 and Associates, Inc. Southlake Blvd., Suite 100 Southlake, Texas 76092 Re: Gateway Church Comprehensive Plan Amendment Request Dear Mr. Killough: As you are aware from our previous meetings and submittals regarding the Rezoning, Concept Plan and Preliminary Plat for the proposed Gateway Church on S.H. 114, an amendment to the Consolidated Land Use Plan will be required. Per the requirements of the new Consolidated Plan Amendment Application process, this letter is intended to further explain the reasons behind the request, and why it is a sensible, logical request with the best interests of both the City of Southlake and Gateway Church in mind. It is no secret that Gateway Church has experienced what many would consider an amazing growth rate since its inception in the fall of 1999. Currently, the church holds three worship services on Saturday evenings with an additional three on Sunday mornings. Without additional room for development on their current campus on Southlake Blvd., it has become apparent that a new location with significant room for growth be found in order to continue to support the growing membership of the church. For these reasons — the need for room to grow and for facilities with both adequate traffic capacities both within and around the church — Gateway Church has elected to purchase and develop a property which will support continued growth over time and the traffic needs associated with that growth. Few other available properties within the City of Southlake provided these important resources to Gateway Church. If one looks at the available land in the City that provides such a significant amount of property and is surrounded by infrastructure which supports significant traffic volumes, it would be very difficult, if at all possible, to find such a property that wasn't classified in the Consolidated Land Use Plan as Mixed Use, Office Commercial, Retail Commercial or Industrial. • TEL 817 335 6511 FAX 817 335 5070 ri Kimley -Hom Mr. Dennis Killough, August 13, 2007, Page 2 and Associates, Inc. The church has purchased approximately 189 acres along the north side of S.H. 121, between Carroll Avenue and North Kimball Avenue. This land, currently zoned as Non - Residential P.U.D., is classified as "Mixed Use" in the City's Consolidated Land Use Plan. Per comments received as a result of previous staff submittals, it has been brought to our attention that the proposed development is not in compliance with the Consolidated Land Use Plan because the Plan recommends a maximum of 10% civic uses in a Mixed Use development and limits that those uses to 10,000 square feet of built area. Since the proposed development exceeds both of these limits, staff has requested that an application be made for a change in designation from Mixed -Use to Public /Semi- Public. Of the approximately 189 acres purchased by Gateway Church, only 90.65 acres are included in this request for a change in land use designation. The balance of the property is expected to retain its Mixed Use designation and be held for future, undetermined uses or sold for development by others. When considering this request for an amendment to the Consolidated Land Use Plan, it is important to take into account the dynamics of a church of the size and growth potential of Gateway Church. As stated previously, the current facilities, equipped with a 1,500 seat worship center, have been considerably outgrown by the membership. The impact created by the traffic generated from six services per weekend has created a significant disruption in traffic flow on Southlake Blvd. Based on our review of the City's Consolidated Land Use Plan, the S.H. 114 Area Plan and the Southlake 2025 Plan, it is our opinion that our request to reclassify the subject property from Mixed Use to Public /Semi- Public is appropriate. Though a large portion of the 90.65 acres will be developed, the proposed design of the site either protects or recreates, through significant landscaping and water features, the natural environment — an important goal of all three referenced documents. Additionally, the proposed development supports the Southlake 2025 Plan through the implementation of the trail connections (Goal #5) as outlined in the Trails Master Plan and supports Goal #4 by reducing significant traffic volumes on Southlake Blvd. and moving them to S.H. 114, which has the capacity to support the current and future traffic volumes that will be generated by the church. Southlake Blvd., Suite 100 Southlake, Texas 76092 Re: Gateway Church Design Narrative Dear Mr. Killough: Gateway Church has purchased the property located north of S.H. 114 between Carroll Ave. and Kimball Ave. and south of Highland. The church desires to build an 8,000 seat sanctuary and associated class rooms, administration, parking and roadways. This design narrative will explain the overall development and indicate the potential timing of the development. Roadway / Access A TIA has been completed for the project and it was determined that two access points onto S.H. 114 (Grace Lane and Blessed Way) and a connection to Kimball (E. Kirkwood Boulevard) will be required for the development. Regardless of the initial development, the roadways mentioned are the minimum necessary. In the full build -out condition, both connections to S.H. 114 will be 4 -lane from S.H.114 to E. Kirkwood Boulevard. At S.H. 114, both roadways will include a median to allow for stacking. Blessed Way will straddle the property line with the adjacent property owned by Greenway -Berk. Gateway Church attorney has prepared the development agreement for the ROW dedication required by both Gateway and Greenway -Berk. In the agreement, Greenway -Berk will agree to reimburse Gateway for one half of the roadway cost along their west property line and one half of the deceleration lane costs once they move into development. E. Kirkwood Boulevard road alignment will straddle the existing property line with the CISD property in order to reduce the impact to an existing stand of trees. An agreement has been reached with the School Board to allow a land swap to occur. The Gateway Church attorney has prepared the agreements for the land swap and the documents have been approved by the School Board. The agreement is contingent on the at least two lanes of E. Kirkwood Boulevard construction and the filing of the final plat. The roadway will connect the site to Kimball and eventually connect to Carroll. The Carroll connection will not be part of the Gateway development. The present alignment will allow for a future connection to Highland. The TIA indicates that, at least initially, only two lanes are required to connect Grace Lane and Blessed Way to Kimball. The other two lanes will be designed and constructed when the need is there either from the Gateway site or other future developments. The improvements to Kimball will be necessary to coincide with this Gateway development. The improvements should extend at least to the E. Kirkwood Boulevard location. Both driveways, Grace Lane and Blessed Way, have been submitted to TxDOT for permit. Utilities Sanitary Sewer: The site is currently served by a 12" sanitary sewer line at the southeast side of the site. We plan to connect to the existing line at an existing manhole. We will extend a 10" line to serve the main building and will extend service to the future Prayer Center to the north and west to a future development. Water: The site is currently served by a 12" water line along S.H. 114 that stops approximately 1000 feet from the property on the east and stops approximately 600 feet from the property on the west. That 12" water line will be extended as part of this project. There is also a 12" water line that exists in Kimball that will be connected to the new line on S.H. 114. A 12" water line will be installed along E. Kirkwood Boulevard that will serve fire hydrants along the road and will be extended in the future to Carroll. 8" water lines in Grace Lane and Blessed Way will connect the S.H. 114 12" water line to the E. Kirkwood Boulevard water line. An 8" water line will be extended through the site for fire hydrant service, fire sprinkler system service and domestic service to the buildings. Storm Sewer Presently, a box culvert system from under S.H. 114 drains to the stock pond in the center of the site. That drainage from the south side of S.H. 114 will be collected in a box system and will be rerouted around the existing pond to the linear pond north of the Greenway -Berk property. The linear pond outfall to the larger detention pond to the east will be improved. The design will include a weir and ditch section. The stock pond off S.H. 114 will be drained and will be reconfigured into a water feature in a future phase. The water coming from south of S.H. 114 has been detained and will be released thru our site un- detained. We I I I risn Kimley -Horn Mr. Dennis Killough, August 13, 2007, Page 3 and Associates, Inc. will however detain our water in two of the existing ponds. The site drains to two distinct basins — one to the north and one to the east. The storm drainage presently going to the north will be detained in the existing pond and will be released at a pre - development rate to the drainage way north of Highland. The outlet structure in the north pond will be a weir (morning glory) design connected to the existing culvert crossing Highland. The drainage going to the east will be collected in the existing large pond at the east side of the site and will be released to the wetland area north of E. Kirkwood Boulevard at a pre - development rate. The outlet structure will be the culvert passing under E. Kirkwood Boulevard to the north. The volume storage required to the north is 16,000 cf and to the east is 405,000 cf. A preliminary drainage study has been prepared and submitted to the City. On -site, the storm sewer will consist of curb inlets, area drains, and roof drains connected to RCP that conveys the water to the ponds. The draining of the stock pond off S.H.114 will occur in phase 1. Presently, water extends from the pond to the culvert system under 114. City staff has made it clear that this is not a desirable condition due to the inability to maintain the culverts while full of water. We have reviewed the pond and have determined that it is not connected to the waterway to the east and therefore it is non jurisdictional. In fact, the USACE has written a letter that agrees with our findings. Plans to construct the box culvert to accept the drainage from south of S.H.114 have been prepared and will be submitted for review very soon. The process for draining the pond will be: • Remove as many fish as possible by electro -shock and transplant to the larger pond to the east — this has been completed. • Plan to drain the pond in the July /August timeframe for two reasons — first, it is a drier time of year and will allow the pond to fully dry out; and second, it is a less likely time of wild life nesting around the perimeter of the pond. • Prior to draining the pond, construct a ditch to allow the water from the culverts to bypass the pond. The ditch will not be fully connected until the pond is near empty. The ditch will be lined with a geotextile fabric and rock check dams will be installed on 100' centers to control erosion. • Provide two pumps — one on the north side of the berm and one on the south side of the berm. This will allow the pond to drain quickly and will keep the drainage from being concentrated. Filter sock check dams will be installed every 100' at each pump outfall to make sure erosion and channeling is kept to a minimum. • Once the pond is drained to approximately 80% the ditch will be breached allowing the pond to fully empty. ❑ Kimley -Horn Mr. Dennis Killough, August 13, 2007, Page 4 and Associates, Inc. Overall Development Overall, the development will consist of an 8000 seat, 3 story sanctuary, a 3 story adult education and administration section, a 3 story children's education section, a 3 story youth and family life center, a chapel, a prayer center, a mechanical building and a maintenance building. Parking will consist of surface parking lots and three structured parking lots two levels each. Unknown at this time is how many of the seats will be constructed in the first phase and which other sections of the building will be built in the first phase. That decision will dictate how many parking places are required and which parking structures will be constructed. A likely first phase may include a 4,000 seat sanctuary located where the youth building is currently shown in the concept plan, classrooms for adults and children around the sanctuary, and build -out of approximately one - third of the children's building. A first phase may include approximately 2,300 parking places and associated storm sewer, water, sanitary sewer and landscaping. At this time, we are designing for full build out and the plans will be adjusted once phase one parameters are established. Please feel free to contact us with any questions you may have. Under Section 404, the USACE regulates the discharge of dredged and fill material into waters of the United States, including wetlands. Our responsibility under Section 10 is to regulate any work in, or affecting, navigable waters of the United States. We have determined that this site does not include navigable waters of the United States under Section 10. Based on the report that you submitted, and other information available to us, it appears that waters of the United States under Section 404 do exist on the site. We concur with the draft determination of waters of the United States that is made in the above referenced report. The basis for this approved jurisdictional determination (JD) is enclosed. The North Tarrant County Area Office in conjunction with the District Access Variance Committee, has reviewed the concept plan for the proposed acceleration lanes and for the proposed driveway access points at the location mentioned above. We decided to grant a conditional variance for approval of the driveway locations along SH 114 WB frontage road without acceleration lanes. The conditions for granting the variance for the elimination of the acceleration lanes is that the developer obtains a written commitment from the City of Southlake committing to providing the law enforcement necessary to assist with traffic control during those days and times that Church Services are conducted to assist motorists to ingress and egress the development in a safe and efficient manner and to try and minimize any inconvenience that this may create for the traveling public using our roadway system. As mentioned in the traffic impact study, the City of Southlake Master Thoroughfare Plan will need to be adjusted in conjunction with this project. These include the following: (1) The alignment of E. Kirkwood Boulevard will need to adjust slightly to the north; and (2) The proposed four -lane divided arterial connecting E. Kirkwood Boulevard to the SH 114 WB Frontage Road will be replaced with two (2) four -lane undivided collector facilities (Grace Lane and Blessed Way). The change in alignment for E. Kirkwood Boulevard is insignificant — it simply moves the alignment slightly to the north. It ultimately allows for a four -lane divided arterial between Kimball and Carroll north of SH 114. The second change actually provides an increase in capacity from the currently adopted Master Thoroughfare Plan and helps to better serve the proposed site. Gateway Church intends to construct its proportional share of the roadway facilities necessary to support its traffic.
