Price, P.E., Director of Public Works Subject: Approve the purchase of right of way for FM1938 Phase 2 from the property at 1202 Randol Mill Avenue in the amount of $219,778 Action Requested: Approve the purchase of right of way for FM1938 Phase 2 from the property at 1202 Randol Mill Avenue in the amount of $219,778 Background Information: FM1938 is a TxDOT roadway which is planned from SH114 to FM1709. Phase I, from SH114 to the Randol Mill Bend, is located primarily in the Town of Westlake and is currently under construction. Phase II of the project, from the Randol Mill Bend to the intersection of FM1709 (Southlake Blvd.) is within the cities of Southlake and Keller. Tarrant County is currently acquiring the right of way necessary for the construction of the FM1938 Phase 2 roadway as well as the installation of the 30" water supply line and 8' trail along the east side of the roadway. The offer to the property owner was made for the City's right of way based upon an appraisal of the property. Settlement (based on appraisal) Parcel 243 — 1202 Randol Mill Avenue Right of way (3,324 SF @ $0.40) $1,330.00 Improvements* 2,517.00 Damages ** 215,931.00 Total $219,778.00 *value of improvement, less depreciation * *the difference in value between the original value of the parcel before the taking and the remainder value after the taking Language in the appraisal indicates that the residences were considered 100% depreciated due to the proximity of the 2 existing structures to the new right of line. The property owner has agreed to the offer of $219,778.00 for the right of way. Financial Considerations: Tarrant County's share of the project is the acquisition and funding of all necessary right of way for the construction of FM 1938. Strategic Link: The FM1938 project links to the city's strategy map relative to the focus areas of Mobility, Infrastructure, and Performance Management and Service Delivery. The specific corporate objectives that are met by this construction project include: Providing travel convenience within city and region; Providing high quality customer service; and Investing to provide and maintain high quality public assets. Citizen Input/ Board Review: N/A Legal Review: The standard right of way documents have been reviewed by the City Attorney's office. Alternatives: The City Council may approve or deny this purchase.
