Subject: Approve the purchase of right of way for FM1938 Phase 2 from
the property at 1202 Randol Mill Avenue in the amount of
$219,778
Action
Requested: Approve the purchase of right of way for FM1938 Phase 2 from the
property at 1202 Randol Mill Avenue in the amount of $219,778
Background
Information: FM1938 is a TxDOT roadway which is planned from SH114 to
FM1709. Phase I, from SH114 to the Randol Mill Bend, is located
primarily in the Town of Westlake and is currently under
construction. Phase II of the project, from the Randol Mill Bend to
the intersection of FM1709 (Southlake Blvd.) is within the cities of
Southlake and Keller.
Tarrant County is currently acquiring the right of way necessary for
the construction of the FM1938 Phase 2 roadway as well as the
installation of the 30" water supply line and 8' trail along the east
side of the roadway. The offer to the property owner was made for
the City's right of way based upon an appraisal of the property.

Language in the appraisal indicates that the residences were
considered 100% depreciated due to the proximity of the 2 existing
structures to the new right of line.
The property owner has agreed to the offer of $219,778.00 for the
right of way.
Financial
Considerations: Tarrant County's share of the project is the acquisition and funding
of all necessary right of way for the construction of FM 1938.
Strategic Link: The FM1938 project links to the city's strategy map relative to the
focus areas of Mobility, Infrastructure, and Performance
Management and Service Delivery. The specific corporate
objectives that are met by this construction project include:
Providing travel convenience within city and region; Providing high
quality customer service; and Investing to provide and maintain
high quality public assets.

Being a 0.076 acre (3324 square foot) tract of land situated in the B.J. Foster Survey, Abstract
Number 519, Tarrant County, Texas, and being a portion of that certain tract of land to Richard W.
and Teri Bridges, as recorded in Instrument #D204070330, Deed Records, Tarrant County, Texas
(D.R.T.C.T.) and being more particularly described by metes and bounds as follows;
BEGINNING at a set 5/8 inch iron rod with Transystems cap on the Proposed Easterly Southlake
Right -of -Way line, a 16 foot wide right of way, from which a found 1/2 inch capped iron rod bears
South 5 °48'59 "West, a distance of 0.33 feet and being South 89° 40' 29" West, a distance of
300.20 feet from a found 1/2 inch iron pipe along the North line of a tract of land to John and
Marilyn Radich, as recorded in Volume 11400, Page 1189, D.R.T.C.T., also being along the South
line of a tract of land to Doris J. Downard, Volume 9166, Page 1049, D.R.T.C.T.;
(1) THENCE South 0 °00'44 "West, with the Proposed Easterly Southlake Right -of -Way line, a distance
of 207.71 feet to a set 5/8 inch iron rod with Transystems cap, from which a found 1/2 inch capped
iron rod bears South 89 °16'23 "West, a distance of 0.22 feet along the South line of said Bridges
tract and the North line of a tract of land to Lisa A. Atkinson, as recorded in Volume 13597, Page
433, D.R.T.C.T.;
(2) THENCE South 89'l 6'23"West, with the South line of said Bridges tract and the North line of said
Atkinson tract, a distance of 16.00 feet to a set 5/8 inch iron rod with Transystems cap being the
Southwest corner of said Bridges tract, the Southeast corner of tract of land to the State of Texas, as
recorded in Instrument # D203191466, D.R.T.C.T. and along the Proposed Easterly Right -of -Way
line of F.M. 1938
(3) THENCE North 0 °00'44 "East, with the West line of said Bridges tract and Proposed Easterly
Right -of -Way line of F.M. 1938, a distance of 207.82 feet to a set 5/8 inch iron rod with
Transystems cap along the North line of said Bridges tract and the South line of said Downard tract;
(4) THENCE North 89 °40'29 "East, with the North line of said Bridges tract and the South line of said
Downard tract, a distance of 16.00 feet to the POINT OF BEGINNING, containing 0.076 acre
(3,324 square feet) of land, more or less.
